GOVERNMENT REGULATION
of 30 March 2009
amending Government Regulation No 224 / 2004 Coll., on certain details of the implementation of the common market organisations under the system of import and export licences and advance fixing certificates for agricultural products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No 224 / 2004 Coll., on certain details of the implementation of the common market organisations under the system of import and export licences and advance fixing certificates for agricultural products is amended as follows:
1. At the end of footnote 1, the following is added:
"Commission Regulation (EC) No 1301 / 2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences, as amended.
Chapters II and III of Part III of Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended.
Commission Regulation (EC) No 376 / 2008 of 23 April 2008 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products, as amended. '
2. In the first sentence of Article 2 (1), the words "if an application is made in a way which allows remote access, this shall be confirmed in writing within 3 days of the date of its submission '.
3. In Paragraph 2 (2), the second sentence is deleted.

Execution of records and certificates of copy No 1 of the licence and certificate
(1) Entry into copy No 1 of the licence or copy No 1 of the certificate shall be made by the party concerned or the customs office responsible (3).
(2) The record and confirmation of copy No 1 of the certificate for agricultural products not listed in Annex 1 to the Treaty establishing the European Community shall be carried out by the Fund4. ';
5. In Paragraph 5 (2), the comma at the end of point (b) is replaced by a dot and point (c) is deleted.
Efficacy
This Regulation shall enter into force on the day of its publication.
