on the retention of driving licences to drivers who are unable to pay the fine imposed on them in block proceedings for road traffic offences on the spot
The Federal Ministry of the Interior shall provide, in agreement with the participating central authorities, pursuant to Article 16 (1) (a) of Decree No. 54 / 1953 Coll., on road traffic, as amended:
§ 1
A driver of a motor vehicle who is subject to a fine in a roadblock infringement proceedings (1), although willing to pay, but unable to do so on site, shall be detained by a member of the National Security Corps carrying out a block driving licence and shall send him a postal order to pay the fine imposed.
§ 2
(1) A national safety authority's national safety authority, when holding a driving licence pursuant to Article 1, shall at the same time issue a driving licence to the driver of a motor vehicle authorising him to drive those groups of motor vehicles which are registered in a detained driving licence.
(2) Driving authorisation is valid for 30 days from the date of issue; within this period, the driver of the motor vehicle shall pay the fine imposed.
§ 3
If a road traffic offence is committed by a driver of a motor vehicle to whom a driving licence has been issued pursuant to Article 2 (1) and cannot pay on the spot the fine imposed on him in block proceedings, that offence shall be notified to the competent county transport inspector for consideration.
§ 4
(1) Driver of a motor vehicle who pays the fine imposed within the period referred to in Paragraph 2 (2) and proves it to be confirmed by the fourth part of the postal order shall return the district transport inspector responsible for his permanent residence.
(2) The driver of a motor vehicle which has no permanent residence in the territory of the Czechoslovak Socialist Republic shall, upon fulfilment of the condition referred to in the preceding paragraph, return the detained driving licence to the district transport inspector whose perimeter the offence occurred.
§ 5
(1) If, within the period referred to in Paragraph 2 (2), the driver of a motor vehicle does not prove that he has paid the fine imposed, the district transport inspector shall refer the matter to the competent national district committee for enforcement.
(2) After the execution of the decision by the competent district national committee, the district transport inspector referred to in Section 4 shall, at the request of the driver of the motor vehicle, return the retained driving licence; the same procedure shall be followed if the driver of the motor vehicle proves that he has paid the fine imposed before the execution of the decision.
§ 6
(1) A member of the National Security Corps shall not hold a driving licence in cases where the driver of a motor vehicle proves in a credible manner that he could not continue driving without a driving licence without causing serious damage or other damage.
(2) If the driver of a motor vehicle proves the facts referred to in the preceding paragraph after the possession of a driving licence, the district transport inspector shall return the licence to him without complying with the condition set out in Paragraph 4 (1) and shall refer the matter to the competent district national committee for enforcement.
§ 7
This Decree shall take effect on 1 January 1982.
