DECLARATION
Ministry of Fuel and Energy
of 3 October 1962
amending Decree No 8 / 1959 of the Ú. l issue basic conditions for the supply of heat
The Ministry of Fuel and Energy, in agreement with the customer ministries (central offices and authorities) and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Decree No 8 / 1959 of the Ú. l issuing the basic conditions for the supply of heat shall be amended as follows:
1. Paragraph 9 (2) reads as follows:
"(2) Tolerance for compliance with heat supply in tnp for production purposes shall be + 3%, for heating in homes and settlements ± 10%. The pressure and temperature of the steam or hot or hot water may vary from the minimum to the maximum value agreed in the contract. '
Article 22 (1) reads as follows:
"(1) For failure to deliver, withdraw or exceed the monthly (for heating supplies in homes and settlements) or quarterly (for heat supplies for production purposes) quantities of heat (tnp) agreed in the contract shall be determined by the following property penalties:
(a) if the supplier does not deliver to the customer the quantity of heat agreed by the contract for the month or quarter for each sampling point, he shall pay the customer a lump-sum penalty equal to 10% of the price for each undelivered tnp;
(b) if the customer does not collect the quantity of heat agreed by the contract for the month or quarter for each point of purchase, he shall be obliged to pay the supplier a one-off penalty equal to 10% of the price for each item not taken,
(c) where the customer exceeds the quantity of heat agreed by the contract per month or quarter for each point of purchase, he shall be obliged to pay the supplier a one-off penalty of 10% of the price, i.e. a Kčs 3,40 for each excess tnp for heating in residential houses and settlements, or a Kčs 40, respectively, - for each exceeded tnp for production purposes. ';
This Decree shall take effect on 1 November 1962.
