GOVERNMENTS OF THE CZECH REPUBLIC
of 26 February 2021 No 200
on the adoption of crisis measures
Following the Government Resolution No. 196 of 26 February 2021 by which the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency in accordance with Article 5 (a) to (e) and (6) of the Act No. 240 / 2000 Coll., on health threats related to the detection of coronavirus / known as SARS CoV-2 / in the territory of the Czech Republic, a decision on the adoption of emergency measures within the meaning of Sections 5 (b) to (e) and § 6 (1) (b) of the Crisis Act, as amended.
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
1. the operation of universities pursuant to Act No. 111 / 1998 Coll., on Higher Education and amending and supplementing other laws (Act on Higher Education), as amended, including foreign universities and their branches operating in the territory of the Czech Republic (hereinafter referred to as "higher education"), by prohibiting the personal presence of students in teaching and examinations, if more than 10 persons take part at one time in the examination, in the study of higher education and participants in lifelong learning courses; the prohibition of the presence of students under this point shall not apply to:
(a) participation in the clinical and practical teaching and practice of students in general medical, dental, pharmacy and other medical studies programmes and students in educational and practical training in primary, primary and secondary schools or in educational establishments for the performance of constitutional and protective education;
(b) participation in university entrance examinations with a maximum of 10 persons;
(c) participation in individual consultations (only one student and one academic worker),
2. the operation of universities by prohibiting the provision of accommodation to students of higher education who have a different residence in the Czech Republic in the accommodation facilities of higher education, except for students who may participate in the training referred to in point 1;
3. the operation of secondary and higher vocational schools and conservatories pursuant to Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (the Education Act), as amended, by prohibiting the personal presence of pupils and students in secondary and higher vocational education in schools and in the Conservatory under the Education Act, with the exception of:
(a) schools established in establishments for the exercise of constitutional or protective education;
(b) schools established by the Ministry of Justice,
(c) practical training and training of pupils and students in health and social services establishments;
(d) individual consultation (only one pupil or student and one pedagogical worker);
(e) the holding of entrance examinations, final examinations, graduate examinations, discharge tests and internationally recognised trials, without limitation of the number of persons;
(f) conducting examinations at higher vocational schools with a maximum of 10 persons;
(g) holding of agency repair and replacement examinations at secondary schools and conservatory,
with the fact that preschool teaching must take place in fixed classes, departments or groups of pupils or students,
4. the operation of primary schools under the Education Act by prohibiting the personal presence of pupils at primary school, except:
(a) primary schools for medical institutions;
(b) schools established in establishments for the exercise of constitutional or protective education;
(c) individual consultation (only one child or pupil, one pedagogical worker and, where appropriate, legal representative);
having regard to the report of the Committee on Budgetary Control (A8-0021 / 2015),
5. the operation of nursery schools under the Education Act by prohibiting the personal presence of children in pre-school education in a kindergarten, with the exception of a nursery school in a medical institution;
6. the operation of primary schools of art, language schools with the right of state language examinations under the law of the school and educational institutions providing one-year foreign language courses with daily teaching according to Act No. 117 / 1995 Coll., on State Social Support, as amended, by prohibiting the personal presence of pupils or participants in basic artistic education in primary art school, in foreign language courses with daily teaching in educational institutions and in language education in a language school with the right of state language examination; state language examinations may be held with a maximum of 10 persons;
7. the operation of leisure centres by prohibiting the personal presence of children, pupils and students and other participants in this private education;
8. the operation of school clubs and school satellites by prohibiting the personal presence of children, pupils and students and other participants in this education;
9. the operation of educational and accommodation facilities by prohibiting the provision of accommodation to pupils of schools and students of higher vocational schools under the Education Act who have a different residence in the Czech Republic in educational establishments (youth home, boarding school), with the exception of pupils and students who can attend preschool courses under this emergency measure, and prohibit school in nature and school trips,
10. the operation of schools and educational establishments under the Education Act and the operation of universities in such a way that there is no singing in education, except:
(a) nursery schools;
(b) the fields of secondary and higher vocational education and study programmes of universities in which singing is a core part of a framework or accredited training or study programme;
11. the operation of schools and educational establishments under the Education Act and the operation of universities by prohibiting sports activities as part of education, except:
(a) nursery schools;
(b) the fields of secondary and higher vocational education and university study programmes in which the sport activity is a central part of a framework or accredited training or study programme;
12. the operation of parent, primary and secondary schools, conservatories, higher vocational schools and school establishments by allowing third parties (except children, pupils, students or participants and staff) to enter the premises of the school or school establishment only where strictly necessary, with the restriction of the contact of third parties with persons on the premises of the school or school establishment.
