DECLARATION
of 28 May 2018
on the technical competence and periodic roadworthiness tests of military vehicles
The Ministry of Defence provides for the Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended by Act No. 546 / 2005 Coll. and Act No. 46 / 2016 Coll.:
GENERAL PROVISIONS
Subject matter
This decree regulates
(a) the types and categories of military vehicles and military working machinery and the method of approving their technical competence;
(b) conditions for the recognition of type-approval certificates for military vehicles issued by another State;
(c) technical conditions, design and design of military vehicles and possible exemptions;
(d) assumptions of technical incompetence and prohibition on the operation of military vehicles;
(e) additional equipment and equipment for military vehicles; and
(f) the manner and dates for carrying out periodic roadworthiness tests of military vehicles and tests of designated technical equipment of military vehicles.
Basic concepts
For the purposes of this decree:
(a) the total mass of a military vehicle, its largest authorised mass;
(b) by authorised axle load, the maximum permissible axle mass of the military vehicle;
(c) supplier of the manufacturer, sales representative of the manufacturer or seller of the military vehicle;
(d) testing equipment intended for conducting tests in the framework of the approval of the technical competence of military vehicles and of designated technical equipment of military vehicles;
(e) a towing vehicle of a military vehicle with its own power source connected to the trailer;
(f) a combination of towing vehicles with one or more military trailers;
(g) the identification number of the military vehicle, a group of characters clearly assigned to a specific military vehicle;
(h) by military superstructure, a separate component of a military vehicle manufactured separately from a military vehicle and assembled with a military vehicle; the military superstructure may be a cargo of general purpose, special or special cargo,
(i) a trailer towed by a vehicle which is equipped with a coupling device enabling horizontal and vertical forces to be transferred to the towing vehicle and the axle of which is located behind the centre of gravity of the vehicle when the load is distributed evenly; for the inclusion of a semi-trailer in the relevant category of military vehicles, the sum of the authorised axle load shall be determined;
(j) a trailer towed by a vehicle with at least one axle equipped with a coupling device which allows vertical movement in relation to the trailer, drives the direction of the front axle or axles and does not cause significant loads on the towing vehicle;
(k) a trailer with a central axle towed vehicle equipped with a towing device which cannot move vertically in relation to the trailer and which has a axle or axles located close to the centre of gravity of the vehicle at a uniform distribution of the load so that the towed vehicle has a static vertical load not exceeding 10 per cent of the load generated by the total mass of the trailer or load not exceeding 1000 daN, using the lower of the values given;
(l) supplementary equipment and equipment for military vehicles, a technical unit, a unit or a part of a military vehicle which is equipped with a military vehicle in excess of its approved technical competence and which, in its operation, affects active and passive safety or environmental impacts;
(m) by the conversion of a military vehicle, a modification of a substantial part of the military vehicle mechanism or structure, or such modification of an operated military vehicle where a change has occurred.
1. a type of propulsion by incorporating another type of engine,
2. bodywork, vehicle and wheel buoyancy causing change of authorised load;
3. the type of bodywork or superstructure which also changes the purpose and method of use of the military vehicle; or
Category 4,
(n) the mandatory label of the manufacturer of the label or the plate affixed to the vehicle by the manufacturer indicating the essential technical data necessary to identify the vehicle and the information relating to the total mass of the military vehicle;
(o) an off-road military vehicle of a military vehicle having specific technical characteristics enabling its use outside normal roads;
(p) by checking the technical condition of a military vehicle, its systems, components and separate technical units and their environmental performance in order to detect or eliminate the defects set out in Section 26.
SPECIES AND CATEGORIES OF MILITARY VEHICLES AND MILITARY INSTALLATIONS
Military vehicle types
(1) Military vehicles are subdivided into:
(a) military combat vehicles;
(b) military security vehicles;
(c) military special vehicles; and
(d) military working machinery.
(2) Military combat vehicle means a vehicle which is manufactured and intended to train and perform the combat tasks of the armed forces.
(3) Military security vehicle means a vehicle which is manufactured and intended for the training and transport of military tasks.
(4) Military special vehicle means a vehicle which is manufactured and intended for training and for the performance of rescue, diagnostic, geniuses or special tasks of the armed forces.
(5) A military working machine means a vehicle intended for carrying out specified work or other activities not intended for transport and transport.
Determination of categories of military vehicles
(1) Individual types of military vehicles shall be subdivided into categories for the purpose of determining the technical conditions according to their purpose of use. It shall include a military vehicle in the relevant category as part of the approval of its technical competence by the Military Police.
(2) The basic breakdown of types of military vehicles shall be carried out within general and specific categories.
(3) For the purposes of the general categorisation of military vehicles, the following species shall be considered:
(a) military combat vehicles, their machine underwear or trailer chassis specially designed for this purpose and not classifiable in the categories of military security vehicles or military special vehicles, as the general category of military combat vehicles (VBV category);
(b) military security vehicles designed and constructed for the training and transport of military tasks, as a general category of military security vehicles (VZV category);
(c) military special vehicles which are specially designed for this purpose and cannot be classified in other categories of military vehicles, as general categories of military special vehicles (category ZVV); and
(d) military working machinery intended to carry out specific work and activities.
The categories of military combat vehicles shall be subdivided into the following specific categories:
(a) military combat vehicles on a belt chassis with a weapon assembly to conduct combat activity (category VBV-PBP);
(b) military combat vehicles on a belt chassis with a special purpose superstructure which does not serve to conduct combat activity directly (category VBV-PSP);
(c) military combat vehicles on wheeled chassis with a weapon assembly to conduct combat activity (category VBV-KBP); and
(d) military combat vehicles on wheeled chassis with a special purpose superstructure which does not serve to conduct combat activity directly (category VBV-KSP).
(1) The categories of military safety vehicles are subdivided into the following specific categories:
(a) military vehicles having a maximum of 4 wheels (category VL),
1. two-wheel or three-wheel military vehicles, a light quadricycle with an engine of a cylinder capacity of not more than 50 cm3 or a light quadricycle with a maximum design speed of not more than 45 km.h-1, for any type of propulsion of less than 350 kg unladen mass (category VL1),
2. a two-wheel military vehicle without a sidecar or with an engine with a cylinder displacement exceeding 50 cm3 or a maximum design speed exceeding 45 km.h-1 at any type of propulsion (category VL2);
3. a three-wheel military vehicle with wheels placed symmetrically in relation to the median longitudinal plane or quadricycle, other than VL1, with an engine having a cylinder capacity exceeding 50 cm3 or a maximum design speed exceeding 45 km.h-1, at any type of propulsion, the unladen mass of which is less than 400 kg or, in the case of vehicles intended to carry equipment and equipment, less than 600 kg (category VL3),
(b) self-propelled military vehicles intended for the transport of persons (category VM),
1. a military vehicle with its own power supply intended for the carriage of only seated persons, their equipment and equipment, and having a maximum of 8 seats for the carriage of persons, except for the driver (category VM1),
2. a military vehicle with its own propulsion power source having more than 8 passenger seats, excluding the driver's seat, and whose total mass does not exceed 5000 kg (category VM2),
3. a military vehicle with its own propulsion power source having more than 8 seats for the carriage of passengers, except for the driver, and having a total mass exceeding 5000 kg (category VM3);
(c) self-propelled military vehicles (category VN),
1. a military vehicle with its own power supply, the total mass of which does not exceed 3,500 kg (category VN1);
2. a military vehicle with its own power supply, the total mass of which exceeds 3,500 kg but does not exceed 12000 kg (category VN2),
3. a military vehicle with its own power supply, the total mass of which exceeds 12000 kg (category VN3);
4. a special car designed for carrying out designated work,
5. a tractor designed to tow a semi-trailer or a trailer, one or more axles of which may be driven by a towing vehicle; in the case of a tractor intended for towing a semi-trailer, its mass in standby condition increased by the mass corresponding to the maximum static vertical load applied by the trailer on the tractor and, where applicable, the maximum mass of the tractor's own load,
(d) tractors (category VT)
1. a military tractor with wheels or belts and at least two axles, the function of which is given by a towing force and which is designed to tow, push, carry or drive military working machinery or military trailers, the maximum design speed of which generally does not exceed 40 km.h-1;
2. a military tractor as referred to in point 1, manufactured for the carriage of accompanying workers' machinery,
(e) military trailers (category VO) which include military vehicles not having their own propulsion power source intended for the transport of military equipment or persons, or for temporary accommodation of persons, towed by motor vehicle or tractor, or tractor, as the case may be,
1. a single axle military trailer whose total mass does not exceed 750 kg (category VO1),
2. a military trailer whose total mass does not exceed 3,500 kg unless it belongs to category VO1 (category VO2);
3. a military trailer with a total mass exceeding 3,500 kg but not exceeding 10,000 kg (category VO3),
4. a military trailer whose total mass exceeds 10 000 kg (category VO4),
(f) military tractor trailers (category VOT) which include military vehicles without their own propulsion power source intended for the transport of military equipment or persons, as appropriate, or for accommodation of persons towed by a military tractor,
1. a military trailer whose total mass does not exceed 1 500 kg (category VOT1),
2. a military trailer whose total mass exceeds 1 500 kg but does not exceed 3 500 kg (category VOT2),
3. a military trailer whose total mass exceeds 3,500 kg but does not exceed 6,000 kg (category VOT3),
4. a military trailer whose total mass exceeds 6 000 kg (category VOT4).
(2) An off-road military vehicle of category VM or VN shall be marked with the letter "G 'after the letter and the figure identifying the category of military vehicle.
(1) The categories of military special vehicles (categories ZVV) are subdivided into the following specific categories:
(a) a military vehicle on wheeled chassis which serves to perform rescue work (KZP category);
(b) a military vehicle on a belt chassis which serves to perform rescue work (PZP category);
(c) a military vehicle on wheeled chassis which serves to perform special tasks within the armed forces (category SKP);
(d) a military vehicle on a belt chassis for carrying out special tasks within the armed forces (SPP category);
(e) a military trailer on a wheeled or belt chassis which serves to perform rescue or special tasks within the armed forces (VZV-VO category).
(2) An off-road military vehicle of category KZP or SKP shall be marked with the letter "G 'after the letter identifying the category of military vehicle.
The categories of military working machinery shall be subdivided into the following specific categories:
(a) a military working machine carried, which moves on a vehicle and forms a single unit with it (VPN category); the driving gear to which the military work machine may be equipped is not in contact with the ground,
(b) a self-propelled military work machine with its own power supply (VPS category);
(c) a military work machine towed without its own power source, which can be connected by a vehicle designed and adapted (VPV category).
Types of military bodies
Military superstructures are divided into:
(a) a fixed military superstructure (VNP) which is manufactured separately from a military vehicle and is assembled with a military vehicle in primary production or in multi-stage production;
(b) a military replacement replacement (VVV), which is a separate technical unit, which is connected to the essential military vehicle, as the carrier of the replacement superstructures, in a detachable connection.
TECHNICAL ELIGIBILITY APPROVAL
APPROVAL OF A MILITARY VEHICLE TYPE
General provisions
Tests when type-approval of a type of military vehicle shall be carried out by the service.
Documentation for the approval of a type of military vehicle
(1) Approval of a type of military vehicle shall be based on:
(a) the final design of a military vehicle, a military vehicle from a verification series of manufacture or an imported sample of a military vehicle;
(b) the relevant technical documentation; and
(c) the supplier's request for the approval of a type of military vehicle delivered to the Military Police.
(2) In order to verify technical and operational parameters of a type of military vehicle, the supplier shall provide the technical service with the necessary time to carry out the tests of the military vehicle to be approved.
Approval of a type of military vehicle
(1) The technical competence of a type of military vehicle shall be approved by the Military Police if the test laboratory or, where appropriate, the legal person responsible for conducting approval tests on military vehicles by the Military Police carries out an approval test on a type of military vehicle, its components, equipment or accessories with a positive result.
(2) Military police shall, on the basis of the approval of a type of military vehicle, issue to its supplier a certificate of technical competence of a type of military vehicle, its superstructure or a military working machine, annexed to which is a basic technical description of the military vehicle, its superstructure or the military working machine. The model of the basic technical description of the military vehicle is set out in Annex 1 to this Decree.
(3) The technical competence of a type of military vehicle, superstructure or military working machinery for the use of the armed forces is set at 2 years; technical competence may, where justified, be set at 3 years, depending on the needs of the armed forces. The specified period of validity of the technical competence shall be entered in the certificate of technical competence of the military vehicle, its superstructure or the military working machine.
(4) The specified period of technical competence of a type of military vehicle, its superstructure or military work machine for the use of the armed forces may be extended at the request of the supplier or user of the military vehicle submitted to the Military Police no later than 2 months before its expiry.
(5) When type-approval of a type of military vehicle is granted, the military police will determine whether the military vehicle will be equipped with a table with a military registration plate or a military registration plate will be marked otherwise; If the Military Police provide that a military vehicle shall not be equipped with a plate bearing a military registration plate, they shall at the same time determine the method of its other marking. The table with the military registration plate shall be placed on the military vehicle in a similar manner to the registration plate on the road vehicle (9). If the design of a military vehicle does not permit such a location of a military registration plate, the Military Police shall, when approved by the type of military vehicle, determine its other location on a military vehicle. The other location of the military registration plate shall be entered in the technical licence of the military vehicle.
Evidence of technical competence of a military vehicle
(1) The military vehicle is always equipped
(a) a military vehicle technical pass; and
(b) a certificate of technical licence for a vehicle of the armed forces.
(2) The technical approval of a military vehicle is intended for the execution of:
(a) registration of the holder of a military vehicle in the vehicle register under the law on the armed forces of the Czech Republic (1);
(b) the recording of changes in the technical parameters of a military vehicle; and
(c) records of the technical inspection and validity of the technical competence of a military vehicle.
(3) The Technical Card is issued by the Military Police to the supplier of the military vehicle at its request; a supplier of a military vehicle on a technical licence confirms the conformity of the technical parameters of a military vehicle with an approved type of military vehicle.
(4) The model of the military vehicle technical pass is set out in Annex 2 to this Regulation.
(5) The certificate on the technical licence of a vehicle of the armed forces is issued by the Military Police when registering a military vehicle in the vehicle register under the law on the armed forces of the Czech Republic (1).
(6) The technical certificate shall include:
(a) to the face side of the data on:
1. military plates,
2. the holder of the certificate,
3. type and category of military vehicle,
(b) to the reverse side, data on the technical parameters of the military vehicle.
(7) The model of the certificate of technical licence of a vehicle of the armed forces is set out in Annex 3 to this Regulation.
APPROVAL OF TECHNICAL ELIGIBILITY IN SPECIFIC CASES
Approval of technical competence of a type of military vehicle conversion
(1) In the case of a military vehicle for which conversion has been carried out, the technical capability of the converted part must be approved before it is put into service. For the approval of the technical capability of a type of conversion, the arrangements for the approval of a type of military vehicle shall apply mutatis mutandis.
(2) The conversion of a military vehicle may change its category if the new category to which a military vehicle is included after the conversion complies with more stringent technical requirements for brakes and reflections of a military vehicle than the original category.
Approval of technical capability of a type of superstructure of a military vehicle or of a type of military work machine
(1) For the approval of a type of superstructure of a military vehicle or a type of military working machine, the arrangements for the approval of a type of military vehicle, as set out in Sections 9 to 11 and 13, shall apply mutatis mutandis.
(2) In the case of the installation of an approved type of military superstructure on a military vehicle, the manufacturer shall add the required data on the superstructure to the technical licence of the military vehicle issued by the manufacturer of the machine chassis of the military vehicle. This provision shall not apply when the military superstructure is installed.
(3) The type of military superstructure or type of military work machine, the technical competence of which has been independently approved in accordance with paragraph 1, may be used only on a military vehicle modified and approved for their connection; a military vehicle with an attached military superstructure or military work machine as a whole shall comply with the technical conditions laid down in this Decree.
Approval of additional equipment and equipment of military vehicle types
(1) Additional equipment and equipment of military vehicles are approved within the scope of approval of the technical competence of a military vehicle type or separately, but always in direct connection to the approved or approved technical competence of a military vehicle type for which they are intended.
(2) Military police approve additional equipment and equipment of a type of military vehicle, taking into account its function, shape or incorporation and the manner of installation, on the basis of a request made by a military vehicle supplier using samples and documentation submitted by it.
(3) The application referred to in paragraph 2 shall also include its own additional equipment and equipment of a military vehicle, the approval of which is to be decided upon and the documentation thereof.
(4) When approving the technical competence of additional equipment and equipment of a type of military vehicle, military police may require the submission of additional technical documentation from the supplier of the military vehicle, in particular detailed drawings and calculations, or the opinion of the Ministry as a public health authority, by the organisation of state professional safety oversight or by the administration of the fire protection department.
(5) The military police, on the basis of the approval of the additional equipment and equipment referred to in paragraph 1, shall issue to their suppliers a certificate of their technical competence within the type of military vehicle for which they are intended, even if they have been approved together with an assessment of the technical competence of that type of military vehicle.
Specific procedure for the approval of additional equipment and equipment for military vehicles
In the case of additional equipment and equipment of a type of military vehicle which are independently approved under the Agreement on the Adoption of Uniform Conditions for Homologation and the Reciprocal Recognition of Approval of Equipment and Parts of Motor Vehicles, the Military Police shall approve their use, location or incorporation in a military vehicle.
CONDITIONS FOR RECOGNITION OF APPROVAL OF A MILITARY VEHICLE TYPE ISSUED BY ANOTHER STATE
Recognition of a type-approval certificate for a military vehicle issued by another State
(1) Military police may also issue a certificate of technical competence of a type of military vehicle without carrying out the approval test referred to in Article 11 (1), after examination of the submitted documentation of the military vehicle by testing the recognition of a valid certificate of approval of a type of military vehicle issued by:
(a) by the State of the European Union in accordance with the provisions issued by the European Union;
(b) a State which is a member of the North Atlantic Treaty Organisation; or
(c) by another State under an international treaty which the Czech Republic is bound by.
(2) An application for recognition of a valid type-approval certificate for a military vehicle issued by the State referred to in paragraph 1 shall be submitted to the Military Police by a supplier of a military vehicle.
(3) Military police shall recognise a valid certificate of approval of a type of military vehicle issued by the State referred to in paragraph 1, provided that the technical conditions laid down for the approval of a type of military vehicle by this Regulation are met; the procedure of the Military Police provided for the approval of a type of military vehicle in Section 11 shall apply mutatis mutandis to such cases.
EXEMPTIONS FROM THE TECHNICAL ELIGIBILITY OF MILITARY SECURITY TECHNICAL
Military security vehicles
(1) When approving the technical competence of military security vehicles, the legislation governing the approval of technical competence and the technical conditions of use of vehicles on the road (2) shall apply mutatis mutandis. Military police shall, on a proposal from the testing centre, approve the technical competence of a military safety vehicle if the design and execution of a military safety vehicle is not capable of endangering road safety and the quality of the environment.
(2) When approving the technical competence of military safety vehicles, the technical conditions for brakes and interference shall be complied with under the legislation governing the approval of technical competence and the technical conditions for the operation of vehicles on the road (2).
ADDITIONAL INSTRUMENTS AND EQUIPMENT OF MILITARY VEHICLES
