of 28 March 1996
laying down the details of the application for a forest licence and the details of the granting of licences in forestry
The Ministry of Agriculture provides pursuant to § 44 (5) of Act No. 289 / 1995 Coll., on Forests and on the amendment and addition of certain laws (Forest Act):
Forms of licence application
(1) Where the applicant is a natural person, the application for a licence shall include:
(a) the name and surname, permanent residence, birth and ID number;
(b) a trade name if it carries on under that name,
(c) an identification number, if allocated;
(d) the description of the subject-matter of the licence, (1) the award of which is sought or the period for which the licence is applied for;
(e) officially verified2) a copy of the proof of professional forestry education;
(f) a description of the applicant's professional forestry practice, indicating the number of years of experience.
(2) Where the applicant is a legal person, the licence application shall contain:
(a) the trade name, registered office and legal form of the applicant;
(b) the name and surname and permanent residence of the person or persons who are the statutory authority of the applicant;
(c) identification number,
(d) an extract from a commercial register which may not be more than three months old;
(e) the indication of the subject of the licence for which the licence is sought or the period for which the licence is applied for;
(f) the name and surname, permanent residence, birth and identity card number of the responsible representative,
(g) officially verified2) a copy of the proof of professional forestry education by the responsible representative;
(h) a description of the current professional forestry practice of the responsible representative, indicating the number of years of experience.
Professional forestry education
When assessing the conditions for granting a licence, professional forestry education shall be documented:
(a) a university diploma on graduating from the field of forestry and timber education in the master's programme of forest engineering;
(b) a university diploma on the completion of studies in forestry and timber education in the Bachelor's Forestry Programme;
(c) a certificate of completion and diploma of a graduate of higher vocational education obtained in the field of forestry, higher professional forestry or in an accredited training programme of the field of forestry education; or
(d) a certificate of graduation in high school, a field of forestry education.
Legal and natural persons licensed shall keep records of professional activities and activities carried out under the licence. Documents relating to such activities shall be kept for a period of at least three years after the end of the calendar year in which the activity was carried out or terminated, unless otherwise specified in the specific regulation.3)
This decree shall take effect on the day of its publication.
