CONSTRUCTION LAW
of 18 April 1990
amending and supplementing Constitutional Act No. 100 / 1960 Coll., the Constitution of the Czechoslovak Federal Republic, and Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation
The Federal Assembly of the Czechoslovak Federal Republic decided on this constitutional law:
Constitutional Act No. 100 / 1960 Coll., the Constitution of the Czechoslovak Federal Republic, as amended by the later constitutional laws, is amended as follows:
1. The Declaration is deleted.
Articles 7 to 15 shall read as follows:
(1) The right of ownership and other property rights of citizens, legal persons and the State are protected by the Constitution and the law.
(2) The State provides equivalent protection to all owners.
(3) The inheritance is guaranteed.
Owners are committed. Owners' rights must not be used to harm the rights of other persons or society.
(1) Expropriation or other compulsory restriction of ownership or other property rights shall be possible only in the public interest, by law or by law and for compensation. An appeal may be brought against the decision in court.
(2) The Federal Assembly Act regulates the conditions for transfers of State property to the property of citizens or legal persons.
(1) Mineral wealth, basic energy sources, basic forest land fund, natural groundwater, water flows and natural medical resources are state-owned. Details shall be laid down in the Federal Assembly Act.
(2) The Federal Assembly Act provides which additional assets necessary to ensure the needs of the whole company, the development of the national economy and public welfare may only be owned by the State or by designated legal persons.
The property right to land and the inheritance right to land remain intact.
The exercise of the right of ownership or use shall not be detrimental to human health, the environment and the environment beyond what is strictly necessary.
The State creates conditions and lays down rules for the development and protection of entrepreneurship and competition.
Foreign legal persons and foreigners may acquire ownership and other property rights and do business in the territory of the Czechoslovak Federal Republic under the conditions laid down by law. The State guarantees them equal protection of their property and property rights as Czechoslovak citizens and Czechoslovak legal persons.
(1) With its economic policy, the Czechoslovak Federative Republic seeks to reproduce national wealth, a socially just society and to create the necessary conditions for the free development of personality, the development of nations and nationalities.
(2) The State shall ensure that environmental balance is created by the protection of nature and the care of creating and protecting a healthy environment as well as the use of natural resources. "
Constitutional Law No. 143 / 1968 Coll., on the Czechoslovak Federation, as amended by the later constitutional laws, is added as follows:
1. Article 8 (1) (l) shall read as follows:
"(l) the rules governing ownership, business and economic disputes.";
Article 24 shall read as follows:
The Czechoslovak Federal Republic's competence in the area of ownership, business and disputes arising from business activities includes:
(a) ownership arrangements;
(b) arrangements for the business of citizens and legal persons;
(c) arrangements for relations arising from the business and other economic activities of citizens and legal persons;
(d) the arrangements for the protection of production and trade, as well as the interests of consumers, in particular the arrangements for competition, industrial rights, standardisation, state testing and State inspection, the measure services and the pursuit of public administration at those sections in matters covered by the Federal Assembly Act;
(e) the principles of the protection and exploitation of mineral assets;
(f) the rules governing the decision-making of economic disputes, as well as the decision-making of such disputes in cases provided for in the Federal Assembly law. ';
This constitutional law shall take effect on the day of its publication.
