amending Decree No 7 / 1959 of the Ú. l issue basic conditions for the supply of electricity
The Ministry of Fuel and Energy, in agreement with the customer ministries (central offices and authorities) and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Decree No 7 / 1959 of the Ú. l issuing basic conditions for the supply of electricity is amended and supplemented as follows:
1.
"(1) The contract shall be concluded separately for each sampling point; However, if it is a single customer (organisation), the parties may conclude a single contract with data broken down by sampling point. In the case of wholesale customers, the planned quantity of electricity (kWh) is determined gradually for the relevant periods of the year and the sampling diagrams for each sampling point.
(2) No later than 10 days before the beginning of each period, the wholesale customer shall, according to the supplier's closer time-limits, be obliged to notify the supplier of the specified electricity needs for the relevant period (allocation kWh) and to arrange with it a monthly sampling and consumption chart that is part of the contract. In so doing, wholesale electricity distribution facilities shall be connected to the relevant monthly diagrams:
(a) monthly if their planned annual electricity consumption is more than 240 000 kWh and the maximum hourly electric input is more than 1000 kW;
(b) on a quarterly basis, where their planned annual electricity consumption is more than 240 000 kWh, but the hourly electric input is not more than 1000 kW,
(c) annually if their planned annual electricity consumption is not more than 240 000 kWh.
(3) If, in addition to an unforeseen change in the special-purpose production after the negotiation of the diagram for the relevant period, the customer may request an additional adjustment of the sampling and consumption chart by the supplier no later than the 15th day of the current month, which the parties shall make no later than 5 days after the supplier has been notified of such change. ';

"(1) Where suppliers have a plan for the supply of electricity from plant power plants to public distribution facilities, they shall notify the customer no later than 10 days before the start of each delivery period of the exact extent of the supply of electricity in kWh for the relevant period and arrange with it a production and supply diagram in which, while respecting the special-purpose technology and the type of plant power plant, the need for a national energy system will be taken into account. In so doing, the specified supply of electricity shall be distributed by the supplier, according to the customer's closer disposition, for a period of lower and higher load on the energy system and shall at the same time agree on the supply of reactive electricity.
(2) The production and supply diagrams shall be agreed, if necessary, for a shorter period and, where appropriate, for supplies outside the State plan. ';
3. Article 12 (4) reads as follows:
"(4) The quantity of electricity is supplied or withdrawn with a tolerance of + 3% and -7%; for the supply of electricity from public distribution facilities for the electric traction of the Czechoslovak State Railways and public urban transport, for the special installations of the Ministry of National Defence and the Ministry of Interior, as well as for the supply of electricity from the plant power stations to public distribution facilities, tolerance of ± 7% shall apply. '

"(1) For failure to deliver, withdraw or exceed the agreed quantity kWh, property penalties shall be determined for all wholesale customers with planned annual electricity consumption above 240 000 kWh per calendar quarter period and for all other wholesale customers over the calendar year as follows:
(a) if the supplier does not deliver to the customer, for the relevant penalty period, the quantity of kWh agreed for each demand point or delivery point, he is obliged to pay the customer a one-off penalty of 10% of the average electricity price, i.e. Kčs 0,02 for each undelivered kWh,
(b) if the customer does not collect kWh for each sampling point or delivery point for the relevant penalty period, he is obliged to pay the supplier a one-off penalty of 10% of the average electricity price, i.e. Kčs 0,02 for each kWh not taken,
(c) if the customer from the public electricity distribution facility exceeds kWh for each point of demand for the relevant penalty period, he shall pay the supplier a lump-sum penalty of Kčs 0,24 for each kWh exceeded;
(d) the provision on increased periodic penalty payments referred to in (c) shall not apply to the supply of electricity from public distribution facilities for the electrical traction of the Czechoslovak State Railways and public urban transport, for the special installations of the Ministry of National Defence and the Ministry of Interior, as well as to the supply of electricity from plant power stations to public electricity facilities; These electricity supplies are subject to a penalty of 10% of the average electricity price, i.e. Kčs 0,02 for each kWh exceeded or not taken.
(2) For failure to deliver or exceed the agreed electricity output, the property penalties for all wholesale electricity customers shall be as follows for the calendar month:
(a) if the supplier does not deliver the electricity in kW, agreed by the sampling or delivery diagram for each sampling point or delivery point, or if it interrupts the supply of electricity for more than 15 minutes, at the same time as the customer was entitled to withdraw the electricity according to the diagram, the supplier shall pay a one-off penalty of 10% of the average price for each kilowatt and hour not delivered, but at least Kčs 20, -
(b) where a customer whose electricity output is measured by a quarter-hour peak indicator exceeds the quarter-hour power in kW from a public electricity distribution facility at peak times by more than 10% of the hourly value agreed by the demand diagram for production wholesale customers and by more than 5% for non-production wholesale customers, he shall be obliged to pay the supplier for each case of exceeding the quarter-hour electric output of a one-off penalty of Kčs 50, - but not more than Kčs 3000, - per calendar month,
(c) where the customer whose electricity consumption is measured by a graphical recording device (maxima, printomavitraf or maximavit) or the process of electricity consumption is determined by regular deduction of the relevant electrometer, exceeds the agreed demand chart from the power supply facility at peak times, or even during an extra-peak period for which a degree of a single regulatory plan has been declared to reduce the consumption of electricity against the diagram, he shall pay a penalty payment to the supplier of:
Cčs 1, - for each kW and hour exceeding 5% of the value. diagram,
Cčs 3, - for each kW and hour of overshoot up to 10% of the value. diagram,
Cčs 10, - for each kW and hour of excess over 10% of the value of the take. diagram,
(d) the provisions of (c) shall apply to customers operating a plant or a heat plant, but shall be based on the consumption chart values for their total electricity consumption.
(3) For non-compliance with frequency and voltage, property penalties shall be determined where periodic penalty payments per calendar month are charged as follows:
(a) where the supplier supplies electricity continuously for more than 15 minutes at a voltage or frequency lower than or above the contract, he shall be obliged to pay a one-off penalty payment of 10% of the average electricity price for each kWh delivered at a lower or higher voltage or frequency;
(b) where the supplier supplies electricity simultaneously at a lower or higher voltage and frequency, continuously for more than 15 minutes, only a one-off penalty payment of 10% of the average electricity price for each kWh, delivered at a lower or higher voltage and frequency;
(c) periodic penalty payments for non-compliance with voltage and frequency shall be made only where compliance with voltage and frequency can be detected by officially evaluated graphical recording devices, the supplier may, in case of doubt of the correct registration, request official reassessment. The costs of remeasurement shall be borne by the party in whose favour the result of the examination shall be shown,
(d) the stress relevant to the penalisation shall be measured at the terminals of the transfer electrometer;
(e) the frequency relevant for penalisation shall be measured at any point in the same customer distribution system.
(4) For the calculation of the periodic penalty payment, the average price of electricity at Kčs shall be 0,20 per kWh; likewise, the average price of electricity per kilowatt per hour shall be determined. Penalties shall be charged within 20 days of the end of the relevant period. The minimum amount of the periodic penalty payment is Cčs 20, -.
(5) For non-compliance with the time limits laid down in Articles 3 (2), 8 (1), 15 (2) and 19 (1) for wholesale customers, as well as for non-compliance with the three-day time limits laid down in the relevant rules for the transmission of the electricity consumption reports, the penalty period Kčs 100, - for each day of delay, but not more than 1000, - is payable.
(6) Property sanctions are not applicable if, for the reasons set out in paragraphs 1 to 4 of Paragraph 18 and paragraphs 6 to 14, the contract was not complied with. "
1. The Decree of the Ministry of Fuel and Energy No 88 / 1961 Coll., amended and supplemented by Decree No 7 / 1959 Ú. l., which issues the basic conditions for the supply of electricity, is hereby repealed.
2. This Decree shall take effect on 1 November 1962.
