THE LAW
of 19 September 1961
adapting certain rights and obligations between Czechoslovak and Romanian persons
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
§ 1
(1) Entitlements of the Czechoslovak State and of the Czechoslovak legal and natural persons against Romanian debtors, if they are considered to be settled under Article 1 and Article 2 of the Agreement on the treatment of certain open financial and property issues between the Czechoslovak Socialist Republic and the Romanian People's Republic, as published in Decree No 51 / 1961 Coll. They shall expire on 24 March 1961.
(2) The Government is hereby authorised to lay down the principles in which, in particular, the types of claims lost (paragraph 1) and the amount to which compensation shall be granted to persons who lose their rights or, where applicable, to their successors in title. However, heirs under the law who are not part of the group of persons referred to in § § 526 to 532 of the Act. No compensation shall be granted; it is indecisive when the deceased died and what nationality he had.
§ 2
(1) The claims of the Romanian State and of Romanian legal and natural persons against Czechoslovak debtors, if they are deemed to have been settled under Article 1 and Article 2 of the Agreement, shall be transferred to the Czechoslovak State on 24 March 1961.
(2) The debtors shall be exempt from the obligation to fulfil their obligations to existing creditors by the transfer of rights under paragraph 1 and shall be obliged to comply with them to the Czechoslovak State. The Government may determine which of the claims that are transferred to the Czechoslovak State are not to be enforced.
§ 3
The Ministry of Finance shall, within the framework of the principles laid down by the Government, adjust the conditions under which the Czechoslovak State shall take over the Romanian securities referred to in Article 6 of the Agreement from the Czechoslovak persons.
§ 4
It is for the Ministry of Finance or the authority entrusted by it to decide on the matters covered by Articles 1, 2 (1) and 3; on the procedure in these matters is governed by Decree No. 91 / 1960 Coll., on administrative proceedings.
§ 5
The Ministry of Finance shall lay down the details of the implementation of the Act and the Agreement, in particular under which conditions compensation shall be granted (Paragraph 1 (2)) and the termination of entitlement to compensation.
§ 6
This Act shall take effect on the day of its publication.
