Regulation of the Minister for Culture
of 10 April 1956
laying down provisions on the professional competence to teach individual fields of art and on the granting and withdrawal of authorisations for private teaching in the field of art.
The Minister of Culture orders pursuant to § 4 of Act No. 196 / 1949 Coll., on Private Teaching in Art:
§ 1.
(1) The Education and Culture Department of the District National Committee gives the right to teach privately to individual subjects of art, taking into account the possibility for professional individuals to apply to the artistic education of young people, particularly where this education is not adequately provided by public institutions.
(2) Authorisations may not be granted to tenderers who:
(a) have been definitively sentenced to the loss of civil rights where such loss persists;
(b) are not physically and mentally competent for the personal exercise; or
(c) have no professional competence for the relevant field of art.
§ 2.
(1) The professional competence for the relevant field of art has been acquired by those who have acquired the teaching capacity for teaching this field of art at the arts schools by performing in the relevant field of art a vocational examination of competence for teachers of music and movement arts or successfully passed the final examinations set out in the examination regulations at higher professional music schools or successfully completed the basic studies at the university of the relevant artistic direction and, if the studies are carried out at the university of art, accompanied by a study at the university of teaching.
(2) The Department of Education and Culture of the Council of the District National Committee may also consider other applicants to be competent in the light of their generally recognised artistic activities.
§ 3.
The Education and Culture Department of the Council of the District National Committee may temporarily waive the lack of competence for a period of time which is strictly necessary, but only in exceptional cases, in particular if, without authorisation, teaching in a particular field of art would be prohibited.
§ 4.
The persons referred to in Article 6 of Act No. 196 / 1949 Coll., on private teaching in the field of art, or applicants who have already been engaged in domestic teaching in the field of art before the entry into force of this Act, shall allow the Department of Education and Culture of the Council of the District National Committee, at the request of the Council of the District Committee, submitted within three months of the date of entry into force of this Regulation, to continue to teach privately,
(a) if the facts referred to in Article 1 (2) (a) and (b) are not present,
(b) where their teaching activities do not show gross deficiencies; and
c) if the teaching did not interrupt after the entry into force of Act No. 196 / 1949 Coll. for a longer period of one year, but would be a case worthy of special consideration.
§ 5.
The Department of Education and Culture of the Council of the District National Committee shall withdraw the right to private education in the field of art to:
(a) in respect of whom the conditions referred to in Article 1 (2) (a) and (b) fall,
(b) for whom the teaching activity shows gross deficiencies;
(c) who do not start teaching within one year of the authorisation;
(d) who does not teach for more than one year, unless there is a case of particular concern.
§ 6.
This Regulation shall enter into force on the day of its publication.
