GOVERNMENT REGULATION
of 21 December 2009
amending Government Regulation No 19 / 2003 Coll., laying down technical requirements for toys, as amended by Government Regulation No 340 / 2008 Coll.
The Government orders pursuant to Article 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 11 (2), 11a (2) (c), 12 (1) and (3) and 13 (2) of the Act:
Government Regulation No. 19 / 2003 Coll., laying down technical requirements for toys, as amended by Government Regulation No. 340 / 2008 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 88 / 378 / EEC of 3 May 1988 on the approximation of the laws of the Member States relating to the safety of toys. Council Directive 93 / 68 / EEC of 22 July 1993 amending Directives 87 / 404 / EEC (simple pressure vessels), 88 / 378 / EEC (safety of toys), 89 / 106 / EEC (construction products), 89 / 336 / EEC (electromagnetic compatibility), 89 / 392 / EEC (machinery), 89 / 686 / EEC (personal protective equipment), 90 / 384 / EEC (non-automatic weighing instruments), 90 / 385 / EEC (active implantable medical devices), 90 / 396 / EEC (appliances of gaseous fuels), 91 / 263 / EEC (telecommunications terminal equipment), 92 / 42 / EEC (new temperature water boilers for liquid or gaseous fuels) and 73 / 23 / EEC (electrical equipment intended for use in certain voltage limits). Directive 2008 / 112 / EC of the European Parliament and of the Council of 16 December 2008 amending Council Directives 76 / 768 / EEC, 88 / 378 / EEC, 1999 / 13 / EC and Directives 2000 / 53 / EC, 2002 / 96 / EC and 2004 / 42 / EC of the European Parliament and of the Council to adapt them to Regulation (EC) No 1272 / 2008 on classification, labelling and packaging of substances and mixtures. ';
2. In Annex No 2, Part II, point 2 (b), "preparations' is replaced by" mixtures'.
3. In Annex No 2, Part II, point (b), including footnote 8, the following text is added:
"(b) Toys shall not contain any substances or mixtures which may become flammable after the leakage of non-flammable volatile constituents if, in view of the characteristics essential to their use, such toys, in particular materials and equipment for chemical experiments, modelling, modelling of plastics or ceramics, enamelling, photographic or similar works, contain mixtures of dangerous substances within the meaning of the specific legislation governing the chemical fibre area (8) or substances which meet the criteria of one of the following classes or categories of danger set out in Annex I to Regulation (EC) No 1272 / 2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures (hereinafter" Regulation (EC):
- hazard classes 2.1 to 2.4, 2.6 and 2.7, 2.8 types A and B, 2.9, 2.10, 2.12, 2.13 categories 1 and 2, 2.14 categories 1 and 2, 2.15 types A to F,
- hazard classes 3.1 to 3.6, 3.7 "adverse effects on sexual function and fertility or development," 3.8 "non-narcotic effects, 3.9 and 3.10,
- hazard class 4.1, or
- hazard class 5.1.
8) Act No. 356 / 2003 Coll., on Chemicals and Chemicals and amending certain laws, as amended. '
4. In Annex No 2, Part II, point 2 (d), "preparations' is replaced by" mixtures'.
5. In Annex No 2, Part II, point 3 (a), the word "preparations' is replaced by" mixtures'.
6. In Annex No 2, Part II, point 3 (c), "preparations' is replaced by" mixtures', "preparations'," mixtures' and "preparations'.
7. In Annex No 2, Part II, point 3 (c), the sentences first and second are replaced by the sentences "Toys shall not contain mixtures of dangerous within the meaning of a specific legislation governing the field of chemical substances (8) or substances meeting the criteria of one of the following classes or categories of hazards set out in Annex I to Regulation (EC) No 1272 / 2008:
- hazard classes 2.1 to 2.4, 2.6 and 2.7, 2.8 types A and B, 2.9, 2.10, 2.12, 2.13 categories 1 and 2, 2.14 categories 1 and 2, 2.15 types A to F,
- hazard classes 3.1 to 3.6, 3.7 "adverse effects on sexual function and fertility or development," 3.8 "non-narcotic effects, 3.9 and 3.10,
- hazard class 4.1, or
- hazard class 5.1,
in quantities that could harm the health of children playing with them. In any case, it is prohibited to add dangerous substances or mixtures to a toy if they should be used as such when using a toy. ';
8. In Annex 3, point 4 (a), "preparations' is replaced by" mixtures' and "preparations' by" mixtures'.
9. In Annex 3 (4) (a):
"(a) Without prejudice to the relevant provisions of Regulation (EC) No 1272 / 2008, the instructions for use of toys containing mixtures which are dangerous, or substances which meet the criteria of one of the following classes or categories of hazard set out in Annex I shall be:
- hazard classes 2.1 to 2.4, 2.6 and 2.7, 2.8 types A and B, 2.9, 2.10, 2.12, 2.13 categories 1 and 2, 2.14 categories 1 and 2, 2.15 types A to F,
- hazard classes 3.1 to 3.6, 3.7 "adverse effects on sexual function and fertility or development," 3.8 "non-narcotic effects, 3.9 and 3.10,
- hazard class 4.1, or
- hazard class 5.1,
Briefly, and in the form of an adapted toy type, the warnings of the dangerous nature of the substances or mixtures and the safety rules which the user must observe in order to avoid the hazards associated with them. First aid to be granted in the event of a serious accident which may occur when using a toy must also be recommended. It must also be stated that toys must be kept out of reach of very young children. '
This Regulation shall enter into force on 1 June 2010, with the exception of the provisions of points 3, 7 and 9, which shall take effect on 1 December 2010.
