GOVERNMENT REGULATION
of 16 December 1998
laying down rules for granting aid in agriculture for the partial compensation of adverse economic effects
The Government orders pursuant to § 15 paragraph 6 of Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended by Act No. 269 / 1998 Coll.:
The State's financial support ("the aid ') for the partial compensation of adverse economic effects is granted to mitigate the damage caused by:
(a) lack of water precipitation;
(b) hail; or
(c) the calamity of the field vole.
(1) Aid shall be granted to persons managing arable land, hops, vineyards, gardens, fruit plantations, meadows, pastures or other plantations (hereinafter referred to as "agricultural parcels") for whom they have a legal relationship on the basis of ownership, lease or other legal title, (2) if:
(a) meet the conditions laid down in this Regulation;
(b) the area of agricultural parcels shall be at least 2 ha;
(c) agricultural parcels are situated in the districts and cadastral areas listed in Annexes 1 to 3 to this Regulation.
(2) The aid is not granted to state undertakings, budgetary and contribution organisations.
(1) The aid provided for in Article 1 (a) concerns agricultural parcels in the cadastral areas listed in Annex 1 to this Regulation which have been grown between 1 January 1998 and 31 May 1998
(a) hops, crops of intensive orvines;
(b) arable crops for one year; or
(c) multiannual forage or permanent grassland;
if these crops have been damaged by a lack of water precipitation during that period.
(2) The aid provided for in Article 1 (b) concerns agricultural parcels in the cadastral areas listed in Annex 2 to this Regulation on which cereals and oilseeds have been grown which have been severely damaged by hail between 1 July 1998 and 31 July 1998.
(3) The aid provided for in Article 1 (c) concerns agricultural parcels in the cadastral areas listed in Annex 3 to this Regulation which have grown cereals and oilseeds which have been affected by the calamity of the field vole.
(1) In the cases referred to in Article 3 (1) (a), 1,5 points per hectare of agricultural parcels shall be evaluated.
(2) In the cases referred to in Article 3 (1) (b) and Article 3 (2) and (3), the whole hectare of arable land shall be evaluated by 1 point.
(3) In the cases referred to in Article 3 (1) (c), 0,5 points shall be assessed by each whole hectare of agricultural parcels.
(1) The amount corresponding to 1 point is calculated by dividing the amount of CZK 200 million by the total number of points determined on the basis of all the eligible and within the time limit of the aid applications submitted (hereinafter referred to as "the application").
(2) After verification of the application, the aid amount is determined by multiplying the number of points and the amount per point.
(1) The application shall be submitted to the Ministry of Agriculture, hereinafter referred to as "the Ministry," within whose jurisdiction the agricultural parcel is situated, no later than 30 days after the date of entry into force of this Regulation. If no application is submitted within the time limit set, no aid may be granted.
(2) The application shall contain information in accordance with the relevant application model set out in Annexes 4, 5 and 6 to this Regulation and shall be supported by an inventory of damage to the field areas, the model of which appears in Annex 7 to this Regulation.
(3) Where the application is incomplete or contains manifestly incorrect information, the Ministry shall return it to the applicant within 10 days of the date of its notification, indicating the defects in the submission and requesting its removal within 7 calendar days of the date of receipt of the request. If the defects are not remedied within the time limit set, the application shall be deemed to have been lodged after the time limit.
(4) If the Ministry concludes that the conditions for granting the aid are not met, it shall immediately inform the applicant in writing, stating the reasons for which the aid cannot be granted.
(5) If the applicant achieves an unjustified grant of aid on the basis of the false information provided in the application, it shall be treated in accordance with a special legislature.3)
This Regulation shall enter into force on the day of its publication.
