THE LAW
of 15 December 1994
amending and supplementing the Act of the Czech National Council No. 300 / 1992 Coll., on State Support for Scientific Activities and Technology Development
Parliament has decided on this law of the Czech Republic:
The Act of the Czech National Council No. 300 / 1992 Coll., on State aid for scientific activities and technological development, is amended as follows:
1. In the title of the law, the words "scientific activities and technological developments' are replaced by the words" research and development '.
2. In Section 1, the words "scientific activities and technological developments' are replaced by the words" research and development 'and the words "scientific activity and technological development'.

(1) Research for the purposes of this law means systematic and creative work extending the knowledge of nature, man, society, thinking, culture and technology. For the purposes of this Act:
(a) research into creative work developing the boundaries of knowledge, including the acquisition and verification of new knowledge and the creation of new hypotheses and theories;
(b) targeted research, which is creative work aimed at obtaining knowledge in a particular field, formulated according to current or anticipated scientific, social and economic interests, which creates the necessary basis for further research or for the subsequent development of products and technologies, including management systems and medical procedures.
(2) Development means the use of research knowledge or the implementation of new ideas and technologies, including their transfer to the level of semi-operational or verification equipment to obtain new or significantly improved products and technologies. ';
4. In the title of Part Two, the words "scientific activities and technological developments' are replaced by the words" research and development '.

(1) The financing of research and development from the budget of the Czech Republic is carried out in the form of:
(a) special-purpose subsidies and repayable financial assistance for the management of research and development projects to natural and legal persons, with the exception of contribution and budgetary organisations, and the financing of the activity of contribution and budgetary organisations in the management of research and development projects (hereinafter referred to as "special-purpose financing");
(b) financing of activities other than those referred to in (a) (hereinafter referred to as "institutional financing") of research and development contribution and budgetary organisations.
(2) Natural and legal persons who have received State budget funds in the field of research and development shall:
(a) to provide the public with information on the research and development carried out, to ensure public access to the results of this activity and to enable the results obtained to be used in accordance with the conditions laid down in the grant of the appropriations, unless otherwise provided by specific provisions; 1)
(b) ensure the efficient use of budgetary resources.

(6) Notes 1) and 2) shall be deleted.
7. In Article 4, the words "scientific activity and technological development 'are replaced by the words" research and development' and, at the end, the following words are added: "on the basis of an evaluation of the results of their research and development activities carried out by the founder and the Council of the Government for Research and Development '.
8. In Paragraph 5 (1), the words "scientific activities and technological developments' are replaced by the words" research and development '.
9. in Article 5 (1) (a), the word "priority" shall be deleted and the words "policy of the Government of the Czech Republic for the relevant period" shall be replaced by "government R & D principles."
10. in Article 5 (1) (b), the words "involved in the implementation of a policy in the field of scientific activity and technological development" shall be replaced by the words "in accordance with the Government's R & D principles."
11. in Article 5 (2), the words "technology" shall be deleted and the word "enterprise" shall be replaced by "own."

(1) The purpose of funding R & D is to be carried out by the central government on the basis of the results of the tender procedure under the conditions laid down in the grant of budget appropriations, unless otherwise provided for in the specific legislation.2) The condition for the provision of funds is to transfer data to the central register of projects financed by the State budget. There is no legal right to grant funds.
(2) The specific conditions for the special purpose financing of research and development and the transmission of data to the central register of projects financed from the state budget are laid down by the Government by regulation.

(13) Notes 3 and 4 shall be deleted.
14. In Part Three, the words "scientific activity and technological development 'are replaced by the words" research and development'.
15. In Paragraph 7 (1), the words "the Czech Republic" are deleted and the words "scientific activity and technological development" are replaced by the words "research and development."
16. in Article 7 (2), the words "the Czech Republic" are deleted and the words "in the field of scientific activity and technological development" are replaced by the words "for research and development."
17. in Article 7 (3) (a), the words "scientific activities and technological developments" are replaced by the words "research and development" and the words "Czech Republic" are deleted.
18. in Article 7 (3) (b), the words "the Czech Republic" and the words "principles" are deleted and the words "scientific activities and technological developments and their division into the part to promote scientific activity and to the part to orient technological development" are replaced by the words "research and development."
19. in Paragraph 7 (3) (c), the words "scientific activities and technological developments" are replaced by the words "research and development" and the words "Czech Republic" are deleted.
20. In Paragraph 7 (3) (d), the words "priority" and "government of the Czech Republic" are deleted, the words "scientific activities and technological developments" are replaced by the words "research and development," and the words "and declare" are inserted after the words "propose."
21. Paragraph 7 (3) (e) reads as follows:
"(e) propose the level of institutional resources spent by central authorities on the R & D activities of their established organisations and communicate its views to those authorities and to the government; the organisations set up by the Ministry of Defence shall take account of their different nature of the activity, ';
22. Paragraph 7 (3) (f) reads as follows:
"(f) be responsible for the central record of all R & D projects financed by the State budget,"
23. In § 8 (1), the words "Czech Republic" are deleted.
24. in Article 8 (4), the word "scientific" shall be deleted and the words "scientific activity or technological development" shall be replaced by "research or development."
25. In Paragraph 8 (5), the word "determined" is replaced by "determined by its resolution" and the words "Czech Republic" are deleted.
26. In Article 8, the following paragraph 7 is inserted after paragraph 6:
"(7) The President of the Council shall be appointed and removed by the Government. The President of the Council shall be a member of the Government. '.
Paragraph 7 shall become paragraph 8.
27. In paragraph 7, the words "the Czech Republic 'are deleted.
28. in Paragraph 9 (2), the words "established by the Government of the Czech Republic" shall be replaced by "and by a legal person."
29. the words "the Czech Republic" shall be deleted in Paragraph 9 (4).
30. In Paragraph 10 (2), the words "in a separate account 'are replaced by the words" in its reserve fund'.
31. in Article 11 (a), the words "specific scientific activities and technology development projects" are replaced by the words "R & D projects from their budget chapter."
32. in Article 11 (b), the words "specific scientific activities including in the field of scientific culture" are replaced by the words "research and development projects."
33. In Article 11 (c), the words "technology development which meets priority programmes based on the policy of the Government of the Czech Republic in the field of scientific activity and technological development" are replaced by the words "research and development which meet the programmes of the Grant Agency."
34. in Article 11 (d), the words "specific scientific activities and technological development projects" are replaced by the words "research and development projects."
35. in Article 11 (e), the words "scientific activities and technology development projects" are replaced by the words "research and development projects."
36. in Article 11 (f) and (g), the words "specific scientific activities and technological development projects" shall be replaced by "R & D projects."
37. In § 11 (h), the words "Czech Republic" are deleted.
38. In Paragraph 13 (2), the words "the Czech Republic 'are deleted.
39. the words "the Czech Republic" shall be deleted in Sections 14 (2) and 3 (b) and (c).
40. in Article 14 (3) (a), the words "specific scientific activities and for selected technology development projects" are replaced by the words "R & D projects."
(41) Paragraph 14 (3) shall be added as follows:
"(d) submit to the Council a proposal for programmes of the Grant Agency based on the principles of the Government for Research and Development;
(e) establish expert groups as temporary advisory bodies in accordance with the Statute of the Grant Agency. "
42. In Paragraph 15 (2), the words "Czech National Council" are replaced by the words "Chamber of Deputies."
43. In Article 15 (3) (a), the word "exploitation" is replaced by "distribution."
44. in Paragraph 15 (3) (d), the words "the Czech National Council" are replaced by the words "the Chamber of Deputies."
45. the following Section 15a is inserted after Section 15:
Trade Commission
(1) Standing advisory groups The Bureau shall be the trade committees which shall ensure the evaluation and evaluation of project proposals.
(2) The members and alternates of the trade committees are elected and dismissed by joint meetings of the Council and the Bureau on the basis of proposals from legal persons involved in research and development. The term of office of the member and alternate of the trade committee shall be three years, and may be renewed after three years from the end of the term of office.
(3) Further details will be laid down in the Statute of the Grant Agency. "
46. In Article 17 (1), the words "by their resolution" shall be inserted after the word "Council" and the words "Czech Republic" shall be deleted.
47. In Article 17 (2), the words "trade commissions" shall be inserted after the words "members."
(1) Within one month of the entry into force of this Act, the Council will submit to the Government a draft amendment to its Statute.
(2) Within one month of the entry into force of this Act, the Bureau shall submit to the Government a draft amendment to the Statute of the Grant Agency.
The President of the Chamber of Deputies is hereby authorised to declare in the Collection of Laws the full text of the Act of the Czech National Council No. 300 / 1992 Coll., on State aid for scientific activity and technological development, as is apparent from the amendments and additions made by this Act.
This Act shall take effect on the day of its publication.
