supplementing Decree No. 576 / 1991 of the Ministry of Justice of the Czech Republic Coll., on the establishment of branches of certain regional and regional courts, as amended by Decree No. 71 / 1993 Coll. and No. 178 / 1993 Coll.
The Ministry of Justice pursuant to Article 33 (5) of Act No. 335 / 1991 Coll., on Courts and Judges, as amended by Act No. 264 / 1992 Coll. and the Act of the Czech National Council No. 17 / 1993 Coll., provides:
The Decree of the Ministry of Justice of the Czech Republic No. 576 / 1991 Coll., on the establishment of branches of certain Regional and District Courts, as amended by Decree No. 71 / 1993 Coll. and No. 178 / 1993 Coll., is added as follows:
1. The following Sections 4c, 4d, 4e and 4f are inserted after Section 4b:
"Regional Court in České Budějovice - Branch Office in Tábor
In the district of the Regional Court in České Budějovice, his branch is established in Tábor.
Regional Court in České Budějovice - Branch Office in Tábor
(a) decide in criminal proceedings on appeals against decisions of the Pelhromov and Tábor district courts;
(b) decide in criminal proceedings on appeals against decisions of the District Court in České Budějovice in cases where the jurisdiction of the District Court in České Budějovice is laid down in a special regulation, 3)
(c) decide in criminal proceedings on the withdrawal of the case to a district court in Pelhřimov or to a district court in Tábor and, in the cases referred to in (b), also to a district court in České Budějovice and to another court in its district;
(d) in criminal proceedings, disputes concerning jurisdiction between district courts in the district of the county court, if the court of the district of Pelhřimov or the district court of Tábor so decides, and in the cases referred to in point (b) of the district court of České Budějovice,
(e) conduct criminal proceedings at first instance in matters which would fall within the competence of military courts, where specific rules are given by m2) the jurisdiction of the Regional Court,
(f) conduct proceedings in the first instance on criminal offences committed in the districts of the counties of Pelhrimov and Tábor, where specific rules are given by m2) the substantive jurisdiction of the Regional Court.
Regional Court in Ostrava - Prerov branch
His branch in Přerov is established in the District of the Regional Court in Ostrava.
Regional Court in Ostrava - Branch Office in Přerov
(a) decide, in the cases in which the action has been brought, on appeals against decisions of the District Court in Olomouc in cases in which the jurisdiction of the District Court in Olomouc is laid down in a special regulation, 3)
(b) conduct criminal proceedings at first instance in matters which would fall within the competence of the military courts, where specific rules are given by m2) the substantive jurisdiction of the Regional Court;
(c) conduct proceedings in the first instance on criminal offences committed in the districts of the District Courts of Přerov and Nové Jičín, if a special regulation is given by m2) the substantive jurisdiction of the Regional Court. "
2. footnote 3 shall read:
"3) § 5c of the ČNR Act No. 436 / 1991 Coll., on certain measures in the judiciary, on the election of the sitting, their dismissal and withdrawal from office and on the administration of the courts of the Czech Republic, as amended."
This decree shall take effect on the day of its publication.
