Czech National Council
of 8 January 1969
concerning the Rules of Procedure of the Czech National Council
The Czech National Council decided on this law:

Část I

§ 1
Preliminary provisions
(1) The Rules of Procedure of the Czech National Council govern the principles of activity and organisation of the Czech National Council, its external contacts, in particular with the Government.
(2) Within the framework of this Rules of Procedure Act, the Czech National Council regulates its internal circumstances and other rules of conduct by its own resolution.

Část II

Establishment of the Czech National Council
§ 2
The opening meeting of the newly elected Czech National Council is convened by the Bureau of the Czech National Council within 4 weeks of the election date.
§ 3
The founding meeting of the newly elected Czech National Council shall be chaired by the President or one of the members of the current Czech National Council Bureau until the election of the new Bureau of the Czech National Council.
§ 4
(1) The President accepts the pledge of Members (Article 114 (2) of the Act No. 143 / 1968 Coll.) and makes the election of the President, Vice-Presidents and other members of the Bureau possible (§ 50).
(2) The President shall instruct four Members of the Czech National Council to count the votes.
§ 5
After the election of the new Bureau, the new elected President of the Czech National Council will take over the management of the meeting and accept the parliamentary promise of the current President, if he is a member of the Czech National Council.
§ 6
The Czech National Council will elect its Mandate and Immunity Committee and CSP in the constituent meeting. It may also elect other committees and their chairmen at this meeting.
§ 7
Proposals for elections held by the constituent meetings may be made by the Bureau of the Czech National Council and by a group of at least 20 Members. If this is not the case, the written proposals of individual Members may also be discussed.
§ 8
The President or one of the Vice-Presidents of the current Czech National Council will report on the activities of the Bureau of the Czech National Council during the time when the Czech National Council did not sit (Article 121 (4) of Act No. 143 / 1968 Coll.).

§ 9
Czech National Council Meeting
(1) The Bureau of the Czech National Council shall convene the Czech National Council for at least two meetings of the year; for spring and autumn. If necessary, the Bureau of the Czech National Council may convene another meeting.
(2) The Bureau of the Czech National Council must convene a meeting of the Czech National Council if at least one third of Members so request in writing. The Bureau of the Czech National Council shall convene meetings within 14 days or until the next deadline specified in the application. Otherwise, the Czech National Council shall meet on the 30th day following the date of application.
(3) The Bureau of the Czech National Council declares the meeting of the Czech National Council closed.

Část IV

Scope of the Czech National Council
§ 10
The Czech National Council, resulting from the Constitution of the Czechoslovak Socialist Republic, the constitutional laws and laws of the Federal Assembly, as well as the Constitution of the Czech Socialist Republic, the constitutional laws and laws of the Czech National Council include in particular:
a) Resolve on constitutional and other laws of the Czech National Council and monitor how the authorities of the Republic implement them;
(b) to act on draft laws submitted to the Federal Assembly (Article 45 (1) of Act No. 143 / 1968 Coll.);
c) to give consent to international treaties for the implementation of which the Czech National Council Act is required,
(d) discuss fundamental internal policy issues;
e) approve by the Act of the Czech National Council the State Plan for the Development of the National Economy of the Czech Socialist Republic and the State Budget of the Czech Socialist Republic, verify their implementation and approve the State Final Account of the Republic,
f) determine the number of members of the Bureau of the Czech National Council, vote and dismiss the President, Vice-Presidents and other members of the Bureau of the Czech National Council,
g) to establish the Czech National Council Committees as their own initiative and control bodies, to determine the number of its members, to elect and recall the chairmen and other members of the Committees;
h) discuss the programme statement of the Government of the Czech Socialist Republic and monitor its activities and the activities of its members, as well as discuss the trust of the government and, where appropriate, its individual members;
ch) establish and abolish by law ministries and other central government bodies of the Czech Socialist Republic,
i) elect and dismiss members of the Constitutional Court of the Czech Socialist Republic,
j) abolish the regulation or resolution of the Government of the Czech Socialist Republic and generally binding regulations of ministries or other central government bodies of the Republic, contrary to the Constitution or other law of the Czech National Council;
(k) to examine the initiatives of the national committees, to discuss their activities and to decide on measures relating to their construction;
(l) decide on its internal circumstances and on the rules of its conduct.
§ 11
The Czech National Council exercises its competence by discussing in particular:
(a) proposals, initiatives, reports and statements by the Bureau of the Czech National Council;
(b) drafts and declarations of the Government of the Czech Socialist Republic, as well as statements of individual members of the Government;
(c) Committee proposals and reports;
(d) proposals and initiatives by Members of the Czech National Council;
e) Interpelling and queries of Members of the Czech National Council,
and by performing
(f) other proposals, if the law so provides.
Preparation of negotiations
§ 12
(1) Proposals of the laws of the Czech National Council may be submitted by Members, by the committees of the Czech National Council and by the Government of the Czech Socialist Republic.
(2) The President of the Czech National Council will send a draft bill to the Government of the Czech Socialist Republic if the Government is not the draftsman of the law.
(3) The draft law of the Czech National Council must be submitted in writing. It must contain a precise wording of what the Czech National Council is to decide on and it must be accompanied by a budget on the financial scope of the curriculum as well as a proposal for the reimbursement of the required cargo.
(4) The laws of the Czech National Council are set out in the following sentence: "The Czech National Council has decided on this law:."
§ 13
(1) The proposals and reports to be the subject of the negotiations of the Czech National Council, its Bureau and committees will be printed and delivered within a reasonable time - but at least a week for the plenary of the Czech National Council - before the meeting of all Members. If the Member objects that this did not happen, Members shall decide by simple majority without debate whether they will still discuss the matter.
(2) The Bureau of the Czech National Council may, if not on the draft laws or legal measures of the Bureau of the Czech National Council, waive the complete printing of the proposals and replace them with a brief indication of the content, indicating that the full proposals can be consulted in the Office of the Czech National Council.
§ 14
(1) Government proposals and, depending on the nature of the case, other drafts and initiatives of the Bureau, committees or Members, the Bureau shall order the competent committee or committees of the Czech National Council to discuss and report.
(2) On a proposal from the Bureau or the Committee, the Czech National Council may discuss the draft law at the first reading of the draft law and the second reading of the draft law.
§ 15
(1) The Bureau may, if it finds that it is not suitable for substantive discussion, reject the draft laws submitted by Members or committees within 30 days. Otherwise, the Bureau must discuss these proposals and report on them to the Czech National Council or order them to the committee responsible to discuss and report on them.
(2) The Bureau shall inform the appellant of the refusal. The applicants may request in writing the President of the Czech National Council within 8 days that the Czech National Council annul the Bureau's rejection resolution. The President is obliged to refer the matter to the Czech National Council for a decision at the next meeting.
(3) If the Czech National Council decides that the proposal is to be the subject of negotiations, the Bureau shall proceed in accordance with the second sentence of paragraph 1.
§ 16
The applicants may withdraw their proposals until the Czech National Council has taken a vote on them.

Czech National Council Meeting
§ 17
The meeting of the Czech National Council is convened by the President of the Czech National Council, as decided by its Bureau.
Participation of government and other persons in meetings
§ 18
(1) The Czech National Council meetings may be attended by members of the Government of the Czech Socialist Republic and by the General Controller.
(2) The Presidency of the Czech National Council may invite other representatives of the Czech National Council, both the Czechoslovak Socialist Republic and the Czech and Slovak Socialist Republic, as well as other political, economic and cultural life figures.
§ 19
(1) A member of the Government of the Czech Socialist Republic and the General Controller are obliged to attend the meeting of the Czech National Council in person if the Czech National Council decides by simple vote without debate or if the Bureau of the Czech National Council so requests.
(2) Otherwise another member of the Government of the Czech Socialist Republic may be represented.
§ 20
The members of the Government and the General Controllers shall be given the floor whenever they so request, including after the debate.
§ 21
The President and the members of the Government shall also be given the floor to statements which are not related to the agenda of the meeting. On a proposal from the Bureau or from any of the Members, the Czech National Council may, by simple vote without debate, decide that a debate on the declaration shall be opened. The debate ends with a vote on whether or not the Czech National Council approves the declaration.
§ 22
(1) The meetings of the Czech National Council are generally public.
(2) A non-public meeting takes place exceptionally, if the Czech National Council, acting on a proposal from its President or Government of the Czech Socialist Republic or a member of the Government, decides without debate by simple voting.
(3) If the Czech National Council decides that the meeting will not be public, only members of the Government, the General Controller and those with whom the Czech National Council will vote without debate may be present at the meeting. The Head of the Office of the Czech National Council and the authorised staff of the Office of the Czech National Council may also be present at the meeting.
(4) The minutes of the deliberations and the short-text report on the non-public meeting are not published unless the Czech National Council has decided otherwise by simple voting without debate.
Meetings
§ 23
The agenda of the meeting of the Czech National Council is proposed by the Bureau of the Czech National Council. The President shall communicate the draft agenda at the beginning of the meeting. Both the programme and the objections against it are decided by the Czech National Council by simple voting without debate.
§ 24
(1) Any Member may submit proposals relating only to the way in which the debate is to be held and proposals for the end of the debate. The Czech National Council shall act on them by simple voting without debate.
(2) The Czech National Council may, in the course of the meeting, move or merge items of the agenda to two or more items of the agenda by simple voting without debate.
(3) The Czech National Council may suspend negotiations on this item of the agenda and proceed to negotiations on another item of the agenda. In so doing, it may refer the matter back to the Bureau or to the Committee with a specific order and fix the period within which the matter is to be referred to it; the rejection of the application for suspension cannot be repeated during the negotiations on the same case and at the same meeting.
§ 25
Substantial proposals and amendments must be made no later than after the debate has been decided to end or the President declares that no one is involved. The President may request their written wording.
§ 26
(1) Speakers may vote before a meeting with the President or during a meeting with the President until the end of the debate is decided and the President gives the rapporteur the final word. Any speaker may speak in his mother tongue.
(2) At the start of the debate, the President shall announce those speakers who have signed up for the floor and shall, as a general rule, give them the order in which they have applied.
(3) Only those to whom the President grants them may take the floor; You speak from the speakers.
(4) Whoever is not present in the conference room at the moment of his word, loses his order.
(5) The Czech National Council may, on a proposal from a Member, set a speaking time without debate, not less than 15 minutes.
(6) Comments on the manner of action, notes personal and material shall not take more than 5 minutes.
(7) If you wish to take part in the debate, it will turn over the proceedings of the meeting.
§ 27
Unless the law provides otherwise, all proposals may also be made by individual Members.
§ 28
Negotiations on draft law
(1) The draftsman will justify the bill or other proposal that was discussed in the committees at the meeting of the Czech National Council. If the Government of the Czech Socialist Republic is the appellant, the proposal will be justified by the member to whom the Government will entrust it. If the draftsman is a group of Members of the Czech National Council, the Member shall state the reasons for the proposal. The rapporteur shall speak to the appellant.
(2) At the end of the debate and before the vote, the President shall give the final word to the rapporteur and, if it is on the initiative of Members or committees, to the appellants whom the others shall appoint.
(3) If the words are taken after the debate by a member of the Government or by a general inspector, the debate shall be resumed.
§ 29
Written communications
A communication from the Bureau of the Czech National Council, the Government and the committees of the Czech National Council concerning, in particular, what proposals and reports have been received and to whom they have been allocated may be distributed at a meeting or circulated in writing, not on matters on which the Rules of Procedure require a vote.
Maintaining order at meetings
§ 30
A Member who has been given the floor is to speak on this matter. If it deviates from the present case or if it exceeds the speaking time, the President may draw the attention of the Member.
§ 31
(1) A Member derogating from the present case may, upon renotification, withdraw the floor.
(2) If the Member exceeds the time limit for making a point of order (Paragraph 26 (6)) or, if necessary, to reply to a point of order, the President may withdraw his speech.
(3) The Czech National Council will decide on the objections of a Member to whom the word has been withdrawn by simple voting without debate.
Voting time
§ 32
(1) The Czech National Council is able to make a resolution if an absolute majority of its Members are present. The agreement of the majority present shall be required for the validity of the resolution.
(2) The resolution amending the Constitution or approving the Constitutional Law requires the consent of a three-fifths majority of all Members of the Czech National Council to be granted.
§ 33
(1) The order in which the items on the daily agenda on which the joint debate has been held will be put to the vote shall be determined by the President after the end of the debate.
(2) The vote on each item shall first be taken on the proposals for secondary and amendment.
§ 34
(1) The President shall propose the method of voting, unless it is determined by law.
(2) Voting may be done either by raising hands or by voting cards. Voting lists shall be held both by secret ballot and by name. As a rule, vote by raising your hand.
(3) The President shall ask the verifiers to add the votes if there are doubts as to the outcome of the vote. Verifiers shall also add votes when voting tickets.
(4) The President shall declare the results of the vote by communicating the number of votes cast for and against the proposal. The results of the elections shall be announced by announcing the number of votes cast and against each person.
Procedure for elections belonging to the Czech National Council
§ 35
(1) The Czech National Council elects the representatives of the State and the bodies whose election is due to it by a simple majority (Paragraph 32 (1)).
(2) Proposals for candidates for elections under paragraph 1 shall be submitted in writing and signed by at least 20 Members. If this is not the case, the written proposals of individual Members may also be discussed.
(3) Proposals must be distributed to Members in due time before the election.
§ 36
The election of the President of the Czech National Council and the President of the Constitutional Court of the Czech Socialist Republic and the General Controller shall take place by secret ballot.
§ 37
Where multiple members of the same body are chosen at the same time, they shall be chosen on the basis of the candidate documents. It is voted in accordance with the general rules on voting arrangements (§ 34).
Interpelling and questions
§ 38
(1) Both the Czech National Council and the individual Members may raise questions to the Government or its individual members of the Interpellation.
(2) Interpellations and questions must be answered by the respondents, if necessary in a non-public meeting (§ 22 (2) to (4)).
§ 39
Interpulation shall be given in writing; they may be submitted by an individual Member or a group of Members.
§ 40
(1) Interpelling can be printed by the Bureau of the Czech National Council and distributed in advance to all Members and interpellants. Replies to the interviews will be placed on the agenda of the next meeting of the Czech National Council, unless the matter can be discussed in the same meeting.
(2) The Czech National Council is holding a debate on the reply to the interview and will take a vote.
§ 41
(1) Questions may be written or oral. Oral questions may be raised at a meeting of the Czech National Council, its Bureau or committees.
(2) The written questions shall be answered in writing or orally within one month.
(3) The oral question will usually be answered orally by the person asked. It may reserve a reply in writing, unless the institution in whose meeting the question has been asked is satisfied with oral answers. Then he'll answer the question in the next meeting.
§ 42
(1) Any Member may ask the Bureau or the President of the Czech National Council about their action.
(2) The question may be raised orally or may be made in writing by the Office of the Czech National Council.
(3) The President shall answer the question either immediately or in the next meeting.
(4) If a question has been put in writing, the President shall read it at the next meeting and give an answer to it.
Negotiations on government trust
§ 43
(1) The Government of the Czech Socialist Republic may ask the Czech National Council to express its trust.
(2) At least one fifth of the members of the Czech National Council may submit a motion of censure to the government or its individual members. The proposal shall be submitted in writing to the President of the Czech National Council.
§ 44
The proposal of the Government to express confidence will be discussed by the Czech National Council without being discussed in the Bureau or in the committees of the Czech National Council.
§ 45
The proposal to express mistrust to the government or its individual members will be placed on the agenda of the next meeting of the Czech National Council.
§ 46
Paragraphs 32 (1) and 34 shall apply to the vote.
Minutes and shorthand messages
§ 47
Minutes are drawn up for each meeting of the Czech National Council. The minutes shall state in particular who was in charge of the meeting, how many Members were present, what proposals were put forward, who were speakers in the debate and what was the result of the vote.
§ 48
(1) The office of the Czech National Council will write a report on each meeting of the Czech National Council, giving an accurate course of the whole meeting.
(2) Within 24 hours of expressing his speech, any speaker can look at the Office of the Czech National Council into the transcription of the shorthand record of his speech. Within the same time limit, the Bureau of the Czech National Council may submit written objections to the part of the transcript which contains his speech, stating what errors or shortcomings it considers to contain.
(3) The Bureau of the Czech National Council decides on the objections, which may also exclude certain speeches or parts thereof from the press press release (§ 51 (2) No 8).
(4) The Office of the Czech National Council will have the shorthand report printed; House prints are attached to the shorthand report.
