on protection against introduction and spread of plant pests on import, transit and export
The Government of the Czechoslovak Republic orders pursuant to § 26 paragraph 2 of Act No. 188 / 1950 Coll., on the Improvement of Plant Production:
Basic provisions
(1) Measures to prevent the introduction and spread of plant pests ("pests") under other provisions of this Regulation shall apply:
1. to vegetable goods in the fresh or dried state, including goods ground, crushed, crushed, peeled, pressed or similarly prepared;
2. on live pests.
(2) Vegetable goods mean:
(a) plants and their underground and above-ground parts, fruits and seeds;
(b) non-corrugated wood, unprocessed bark, unprocessed cork and unprocessed peat.
List of pests
(1) The following shall be considered pests (quarantine pests) within the meaning of this Regulation:

(2) The Ministry of Agriculture and Forestry may amend or supplement the list of pests (paragraph 1) by decree in the Collection of Laws.
Imports of plant goods
(1) Imported plant goods, with the exception of those referred to in paragraph 2, must be accompanied by an official health certificate (phytopathology) of the country of origin in which the competent public authority of the exporting State confirms that the plant goods are pests (Section 2 (1)).
(2) The official health certificate (phytopathology) of the country of origin need not be accompanied by:
1. packages of fruit or vegetables and leaflets;
2. plant goods for the own use of passengers;
3. plant goods intended for the personal use of persons enjoying privileges and immunities.
(3) Imported plant goods must not contain more than 1% clay, except ornamental and medicinal plants.
(4) Imported plant goods including packaging must be subjected to a plant health inspection to be carried out
(a) in the case of wagons, at the place of the border station customs office;
(b) in the case of ships, at the border port customs office,
(c) for air mail - at a customs or other airport,
(d) for consignments carried by road - to the border road customs office;
(e) in the case of postal consignments - at the post office,
(f) in the case of goods imported from abroad by travellers - to a customs office carrying out customs procedures.
(5) Imported consignments of plant goods are immediately reported to the Department of Agriculture and Forestry of the Council of the District National Committee
(a) the transport undertaking, where the consignments referred to in paragraph 4 (a) to (c) are concerned,
(b) the customs office where the consignments referred to in paragraph 4 (d) are concerned.
Transit of consignments of plant goods
(1) Intermediate consignments of plant goods must, with the exception of those referred to in Article 1 (2) (b), be transported in sealed or according to the nature of the goods sealed and not damaged by wagons or in undamaged packaging.
(2) If the conditions referred to in paragraph 1 are not met for the accompanying consignment of plant goods, the transport undertaking shall report this defect without delay to the Department of Agriculture and Forestry of the Council of the District National Committee for the purpose of carrying out a plant health inspection.
Exports of plant goods
(1) The exported consignment of plant goods shall be declared by the exporter of the Department of Agriculture and Forestry to the Council of the District National Committee of the Circuit of which the goods are exported.
(2) The exported vegetable goods shall bear an official health certificate (phytopathology) corresponding to the provisions of the importing State, provided that such certificate is prescribed or applied for.
(3) The health (phytopathological) certificate will be issued by the Department of Agriculture and Forestry of the District National Committee, from whose perimeter the plant goods are exported, after carrying out plant health inspections of the plant goods, including packaging.
Competent authorities for carrying out plant health inspections
The plant health inspection shall be carried out by the inspection bodies:
1. the departments of agriculture and forestry of the Councils of the District National Committees,
2. the customs authorities as regards the plant health inspection carried out pursuant to Article 3 (4) (e) and (f).
Result of phytosanitary inspection
(1) The inspection authority shall register the result of the plant health inspection. According to the result of the inspection, the inspection authority shall indicate on the transport document that:
(a) plant goods may be released for free circulation in the country;
(b) the plant goods may be released for free circulation in the country under the conditions of rendering (treatment) or, where appropriate, the preferential processing of the plant goods; or
(c) plant goods may not be released for free circulation in the country at all.
The Authority shall briefly justify its decision.
(2) Plant goods in which pests listed in Article 2 (1) (a) are present A, may not be released for free circulation in the country. Vegetable goods in which pests referred to in Article 2 (1) (B) are present shall be subject to rendering and, where appropriate, to appropriate processing; the rendering and processing of plant goods shall be arranged by the importer.
(3) If the inspection authority decides that plant goods may not be released for free circulation in the country, the importer shall arrange for its return or destruction.
Import and transit of live pests
Live pests may be imported or accompanied only with the approval of the Ministry of Agriculture and Forestry.
Border traffic
Border traffic shall be treated in accordance with the conventions with neighbouring States on border traffic arrangements. If such conventions or conventions do not contain provisions on the protection against introduction or spread of pests, they shall be applied in accordance with the measures to be taken by the Ministry of Agriculture and Forestry and, where appropriate, by the executive bodies of the national committees.
Prohibition of the import and transit of plant goods
The Ministry of Agriculture and Forestry may prohibit the import or transit of plant goods from countries where harmful pests are present by means of an order issued in agreement with the central authorities involved.
Exceptions
The Ministry of Agriculture and Forestry may, on a case-by-case basis, allow exemptions from the provisions of this Regulation.
Implementing rules
The Ministry of Agriculture and Forestry shall issue more detailed provisions for the implementation of this Regulation in agreement with the central authorities involved.
Repeal
Government Decree No. 8 / 1951 Coll., on the Protection against the Expansion or introduction of Plant Pest on Import, Transit and Export, is hereby repealed.
Efficacy
This Regulation shall take effect from 1 February 1959; they shall be carried out by the Minister for Agriculture and Forestry in agreement with participating members of the Government.
