Legislative measure on public administration in matters of navigation

Legal measures of the Bureau of the National Assembly
of 28 December 1954
on State administration in matters of navigation.
The Bureau of the National Assembly of the Czechoslovak Republic has decided on the following legal measure under Article 66 of the Constitution:
§ 1.
It is for the Ministry of Transport and its subordinate navigation administrations to provide the tasks of the State Administration in matters of navigation.
§ 2.
(1) A navigation administration in Prague and a navigation administration in Bratislava are established.
(2) Vessels' administrations shall exercise their powers directly or by their authorities; These authorities are branches of shipping administrations and capitans with turnovers and stations. The branch of navigation administrations, capitanates and their turnovers shall be established and repealed by the Minister for Transport; the station establishes and abolishes the relevant navigation service.
§ 3.
The Ministry of Transport shall in particular:
(a) identify the needs and represent the interests of the voyage in the construction and adaptation of waterways, public ports and transports, as well as defend the interests of the voyage with a national perspective;
(b) to decide on essential matters relating to the eligibility of vessels and their crews, as well as the safety and adaptation of navigation and port operations;
(c) lay down the conditions for the transport of persons and goods, as well as for the use of facilities in public ports and transports and issue, where appropriate, the relevant regulations;
(d) to procure seagoing goods.
§ 4.
(1) In their respective districts, sailing administrations take care of the development, improvement and economy of inland navigation and its safety.
(2) The current competence of the executive bodies of the national committees in matters of navigation is transferred to navigation administrations.
(3) In the details, the Minister of Transport shall, in agreement with the participating members of the Government, lay down a decree in the official list; the responsibilities of the stations are determined by the navigation service.
§ 5.
The Minister of Transport may entrust navigation authorities with the provision of certain tasks in matters of navigation falling within the competence of the Ministry of Transport, including technical and economic tasks relating to public ports, transports and Czechoslovak port zones abroad.
§ 6.
The Ministry of Transport is the personal office of the staff assigned to the navigation administrations. Paragraph 6 (1) of Decree-Law No 44 / 1954 Coll., on the organisation of public transport in the field of the Ministry of Transport, applies also to these employees.
§ 7.
All provisions shall be repealed if they are contrary to this legal measure; in particular the Government Decree No. 36 / 1950 Coll., on the performance of public administration in matters of navigation, is repealed.
§ 8.
This legal measure shall take effect on the day of its publication; they shall be carried out by the Minister for Transport in agreement with the participating members of the Government.
