The Ministry of Foreign Affairs announces that on 20 April 2012 the Scientific and Technological Cooperation Programme between the Ministry of Education, Youth and Sports of the Czech Republic and the Ministry of Science and Technology of the Ministry of Science and Technology of the Republic of India was signed in Prague.
Scientific and technological cooperation programme
between

Republic of India
Ministry of Education, Youth and Sports of the Czech Republic and the Ministry of Science and Technology of the Ministry of Science and Technology of the Republic of India ("the Parties'),
expressing the wish and common interest in deepening scientific and technological cooperation between the States of the Contracting Parties,
convinced that supporting the implementation of joint projects will help strengthen friendly relations between the States of the Contracting Parties,
intending to consolidate contacts established in the framework of cooperation under the Agreement for Scientific and Technological Cooperation and Industrial Cooperation between Czechoslovakia and India, signed in Prague on 30 May 1973,
agree as follows:
Forms of cooperation
1. In order to develop mutual cooperation, the Parties shall exchange:
(a) a publication of the scientific focus;
(b) information concerning the organisation of scientific workshops, seminars, symposia, conferences, congresses and other meetings held on the territory of the States of the Contracting Parties;
(c) information on national policies and strategies for promoting research, development and innovation in force in the States of the Contracting Parties.
2. In order to develop mutual cooperation, the Parties shall promote:
(a) establishing contacts and developing cooperation between institutions active in the fields of science, technology, research, development and innovation in the States of the Contracting Parties;
(b) the implementation of joint basic research and applied research projects in areas of common interest;
(c) other forms of cooperation agreed in writing.
Areas of cooperation
The Parties shall promote the implementation of joint projects in the following areas of common interest:
(a) information and communication technologies;
(b) natural sciences, including biotechnology;
(c) technical and material sciences;
(d) medical and medical sciences (including pharmaceutical sciences) and food health;
(e) research into climate change, the environment and energy;
(f) in other areas to be agreed in writing.
Joint projects
1. Each joint project will be attended by at least one (1) research team from the Czech Republic and the Republic of India.
2. The purpose of the joint project is to achieve its objectives within the agreed timetable.
3. The duration of the joint project is two (2) to three (3) years, without possibility of extension.
Czech-India Committee for Scientific and Technical Cooperation
1. In order to evaluate and coordinate the achievement of the objectives of this Cooperation Programme, the Parties shall establish a Czech-India Scientific and Technical Cooperation Committee (hereinafter referred to as the Committee), which shall:
(a) evaluate the conditions for the scientific and technical cooperation of the Parties, develop recommendations to improve its effectiveness and identify its priority areas;
(b) declare calls for proposals for joint projects in the States of the Contracting Parties and determine their conditions;
(c) on the basis of the results of the evaluation of joint projects' proposals, identify joint projects which receive public support in the States of the Contracting Parties.
2. Each Party shall be represented in the Committee, consisting of the Czech and Indian parts, by the same number of representatives as the other Party.
3. Each of the Contracting Parties shall appoint a chairman and secretary of its part of the Committee from among its representatives who shall exchange information between its meetings and organise the work of its part of the Committee.
4. Each Contracting Party shall communicate information on the composition of its part of the Committee in writing to the other Contracting Party.
5. Representatives of institutions active in the fields of science, technology, research, development and innovation in the States of the Contracting Parties may also be members of the Committee.
6. The Committee's meetings will normally take place once every two (2) years, alternately in the Czech Republic and the Republic of India, at the dates agreed by the Parties in writing.
7. Where appropriate, the Contracting Parties may organise meetings of the Committee also during the period between the scheduled meetings, at the dates agreed in writing.
8. The conclusions of the Committee meetings shall be adopted by means of a record of the Committee's meetings, drawn up in Czech and English and signed by the Presidents of both parts of the Committee.
9. If, for any reason, it is not possible to organise a meeting of the Committee within the set time limit, its deliberations may be conducted in the form of an exchange of correspondence between the Presidents of both parts of the Committee.
Evaluation of joint projects' proposals
1. The Committee shall issue a call for proposals for joint projects in the States of the Contracting Parties no later than six (6) months before the meeting of the Committee, in accordance with the terms agreed by the Committee.
2. The duration of the call for proposals for joint projects shall be at least two (2) months from the date of its publication, the date of publication being agreed by the Committee.
3. The proposal for a joint project must be submitted simultaneously by the Czech part of the team of its proposed solvers in the Czech Republic and by the Indian part of the team of its proposed solvers in the Republic of India, in accordance with the terms of the call for proposals for joint projects. Otherwise, the draft joint project will not be assessed.
4. The draft joint project shall be evaluated separately in each of the States of the Contracting Parties, in accordance with the legislation in force in the States of the Contracting Parties.
5. A joint project may receive public support only if it is granted simultaneously in each of the States of the Contracting Parties.
6. The Committee shall, on the basis of the results of the evaluation of the draft joint projects, select joint projects which receive public support in the States of the Contracting Parties.
Financial provisions
1. The objectives of the Cooperation Programme will be met taking into account the financial possibilities of the Contracting Parties and in accordance with the legislation in force in their respective territories.
2. The sending Contracting Party shall ensure that persons seconded under this Cooperation Programme cover all costs of international travel to and from the State of the receiving Contracting Party, including travel and subsistence costs (hotel accommodation, subsistence, etc.) in the State of the receiving Contracting Party.
3. The sending Contracting Party shall ensure that persons seconded under this Cooperation Programme are reimbursed for the costs of arranging health insurance for the duration of their stay in the State of the receiving Contracting Party, including the reimbursement of the costs associated with the repatriation of the patient, and that health care is provided to the posted persons in accordance with the legislation in force in the State of the receiving Contracting Party.
Protection of intellectual property rights
Protection of intellectual property rights will be governed by the laws in force in the States of the Contracting Parties and by the international treaties by which the States of the Contracting Parties are bound.
The Programme has entered into force on the date of signature of the Programme pursuant to Article 8 (3) thereof.
The Czech version of the Programme is published simultaneously.
Final provisions
1. This Cooperation Programme may be amended and supplemented only by mutual agreement of the Contracting Parties. Amendments and additions shall be made in writing.
The disputes which may arise in the implementation of this Cooperation Programme shall be settled by negotiations between the two Parties.
3. This Cooperation Programme shall enter into force on the date of signature, shall be negotiated for four (4) years and shall continue to be automatically extended for a further two (2) years, unless one of the Contracting Parties denies it in writing by diplomatic means at the latest six (6) months before its expiry.
4. Activities initiated under this Cooperation Programme during its duration shall be completed regardless of its expiry unless otherwise agreed by the Parties in writing by diplomatic means.
