The Ministry of Foreign Affairs states that on 18 November 2002, the Agreement between the Government of the Czech Republic and the Government of the United States of America on the support provided by the Ministry of Defence of the United States of America to the armed forces of the Czech Republic was signed in Prague during the NATO summit.

Preamble
The Government of the Czech Republic and the Government of the United States of America, hereinafter referred to as "the Contracting Parties',
Desiring to deepen bilateral defence cooperation and mutual NATO cooperation,
Recognising that the support provided by the United States armed forces to the armed forces of the Czech Republic during the NATO Summit in Prague will significantly enhance its security,
recognising the application of the North Atlantic Treaty of 4 April 1949 and the Agreement between the Contracting Parties to the North Atlantic Treaty on the Statute of their Armed Forces of 19 June 1951,
agree as follows:
Definition of terms
For the purposes of this Agreement:
(a) "NATO" shall mean the North Atlantic Treaty Organisation;
(b) "MO USA" means the Ministry of Defence of the United States of America;
c) "OS of the Czech Republic" means the armed forces of the Czech Republic,
(d) "MO US means" means combat aircraft, weapon systems and other equipment used by the US MO to provide support to the OS of the Czech Republic;
(e) "members of the MO of the USA" means members of the United States Armed Forces and the civilian component of temporary deployment in the Czech Republic in connection with this Agreement.
Purpose
The purpose of this Agreement is to define the basic conditions for providing support to US MO to the armed forces of the Czech Republic during the NATO summit.
Scope of support MO USA
1. The support that MO USA will provide during the NATO summit will consist of strengthening the capacity of OS CR to intervene against air threats throughout the Czech Republic through the funds of MO USA earmarked and dislocated for this purpose in and outside the Czech Republic.
2. The resources of the MO USA to support the OS of the Czech Republic will be under the constant command of the American authorities. Details of the coordination of management and command as well as the duration of the support will be agreed between the competent authorities of the OS CR and the members of the MO USA.
3. The aid provided for in paragraph 1 shall be granted by the American Party without any claim for reimbursement from the Czech Republic.
4. The number of members of the US MO residing in the Czech Republic shall not exceed 250 persons and the duration of their stay shall not exceed 30 November 2002.
Use of force
Members of the MO USA can use force in the territory of the Czech Republic only on request or with the consent of the responsible representative of the Czech Republic. The right to individual and collective self-defence shall not be affected by this provision.
Legal status of members of the MO USA
1. The Parties confirm that the status of members of the MO of the USA will be governed by the provisions of the Agreement between the Parties to the North Atlantic Treaty on the Statute of their Armed Forces, negotiated in London on 19 June 1951, unless otherwise provided by this Agreement.
2. The Czech Republic waives the right to exercise criminal jurisdiction over all members of the MO US in connection with the use of force under Article 4.
3. The Czech Republic waives all claims for damages against the US Party and all members of the MO in connection with the use of force under Article 4.
Protection of classified information
The classified facts which the Contracting Parties will communicate in connection with this Agreement will be protected in accordance with the provisions of the Agreement between the Government of the Czech Republic and the Government of the United States of America on measures to protect classified military information signed in Prague on 19 September 1995.
Support provided by the Czech Party
1. The Czech Republic will provide the members of the MO USA with free accommodation and catering as well as fuel for the MO USA.
2. Further support provided by the Czech Republic to members and funds of the MO of the USA will be governed by the provisions of the Agreement between the Ministry of Defence of the Czech Republic and the Ministry of Defence of the United States of America on the acquisition and reciprocal provision of services signed in Prague on 19 November 1996.
Implementation documents
Details of the implementation of this Agreement may be set out in the implementing documents negotiated between the competent authorities of the OS CR and the members of the MO USA.
Dispute settlement
Disputes between the Contracting Parties concerning the interpretation and implementation of this Agreement shall be dealt with by representatives of the Contracting Parties at the lowest possible level. If this dispute is not resolved at this level, it will be referred to the representatives of the Parties at a higher level.
Final provisions
This Agreement shall enter into force on the date of signature and shall remain in force until 1 December 2002.
This Agreement may be amended by written agreement of the Contracting Parties.
The Agreement entered into force on the date of signature of Article 10 thereof and will remain in force until 1 December 2002.
The Czech version of the Agreement is hereby published at the same time.
Dane in Prague on 18 November 2002 in two original copies, each in Czech and English, both texts being equally authentic.
