GOVERNMENT REGULATION
of 5 March 1997
on the amount and conditions for the remuneration of sentenced persons employed in the execution of prison sentences
The Government hereby orders pursuant to Paragraph 29 (1) of Act No. 59 / 1965 Coll., on the execution of the prison sentence, as amended by Act No. 294 / 1993 Coll.:
Remuneration of the sentenced
(1) The remuneration of a sentenced person entered into employment in the execution of a custodial sentence (hereinafter referred to as "remuneration") is the sum of the basic component of remuneration, overtime remuneration, allowances and evaluation of the performance of the service under this Regulation.
(2) Reward to the sentenced is granted by the prison.
(3) The remuneration shall be due in advance of the monthly period, not later than the following calendar month. The reward plate is a prison.
Basic component of remuneration
(1) According to the type of work done, the prison admits to the condemned the basic component of the reward
(a) in the first group, in the case of work whose professional qualifications are not necessary for the performance of which there is no need;
(b) in the II. group, in the case of work for which training is required in the field or other professional qualifications;
(c) in the III group, in the case of the independent performance of particularly demanding and specialised work which generally require higher than full secondary education or higher than full secondary vocational education.
(2) The amount of the basic remuneration component is:
(a) in Group I, an amount equal to the monthly rate of the 1st tariff rate level of minimum wage charges laid down in the special regulation, 1)
(b) in Group II, an amount half as high as in Group I;
(c) in group III, an amount equal to twice the basic component of the remuneration in group I.
(3) For a fixed weekly working period other than 42,5 hours, the basic remuneration component referred to in paragraph 2 shall be adjusted proportionally.
(4) The principal component of the remuneration corresponding to the period worked is for the sentenced person who does not work all the working shifts in the month.
(5) If the convicted person does the faulty work or the faulty work of the bastards (defective product), he shall not be remunerated for that work. If the defective work is to be corrected or the defective product is to be corrected and the convicted product itself is to be paid for the work or reward for the work on the product, but not for the repair. If the sentenced person has not caused the defective work or the defective product, the reward shall be impeccable.
Remuneration for overtime
For each overtime worked hour (2), the sentenced part of the basic remuneration awarded and the awarded remuneration for one hour of overtime work in the calendar month in which the sentenced overtime worked and a supplement of 25% of the amount of the basic remuneration awarded, amounting to one hour of overtime work, shall be payable and 50% of that amount shall be paid for overtime work on the days of the continuous rest of the sentenced in the week.
Extra charge for work on a holiday
For each hour worked on a public holiday, the sentenced shall be subject to a premium of 100% of the amount of the basic remuneration awarded for one hour of work without overtime in the calendar month in which the sentenced work on the public holiday took place.
Extra charge for work at night
A supplement for working at night shall be granted to the defendant under the conditions and at the rate of the amount fixed as a minimum wage advantage for working at night by special regulation.3)
Extra charge for work in a difficult and healthy working environment
A supplement for work in a difficult and healthy working environment shall be granted to the sentenced under the conditions and at an amount set as a minimum wage advantage for work in such an environment by a special regulation.4)
Evaluation of performance
(1) For higher work performance in the required quality or for the management of a particular entrusted section of work or of persons, up to 20% of the basic part of the remuneration in the III group and up to 50% of the basic component of the remuneration may be awarded monthly to the sentenced person who was awarded the basic component of the remuneration in the III group.
(2) An evaluation of the performance of the work may be granted for the first time within two months of the date on which the sentenced person was assigned to work. In justified cases, the prison may grant the convicted person an evaluation of the performance before the expiry of that period.
The rules for the classification of work into individual groups, the determination of the basic component of remuneration according to § 2 (1) and the rules for the evaluation of work performance according to § 7 (1) are laid down by the Czech Prison Service by internal regulation.
Remuneration under this Regulation shall be granted for the first time for the calendar month following the date of its publication.
This Regulation shall enter into force on the day of its publication.
