Communication from the Ministry of Foreign Affairs on the negotiation of the Security Agreement between the Government of the Czech Republic and the Western European Union

The Ministry of Foreign Affairs announces that the Security Agreement between the Czech Republic and the Western European Union was signed in Brussels on 13 November 1998.
The Agreement entered into force on 13 December 1998 on the basis of Article 7 (2) thereof.
The Czech translation of the Agreement is announced simultaneously.
SECURITY AGREEMENT
between the Czech Republic and the Western European Union
The Czech Republic and the Western European Union (WEU), hereinafter referred to as "the Parties',
- having regard to the Declaration adopted after the special meeting of the WEU Council of Ministers with the countries of Central Europe in Bonn on 19 June 1992,
- having regard to the Kirchberg Declaration of the WEU Council of Ministers of 9 May 1994,
- having regard to the decisions taken by the WEU Council of Ministers in Noordwijk on 14 November 1994,
- having regard to the fact that effective cooperation entails the exchange of classified information and material between the Parties,
- in accordance with the agreement on consultations in the framework of relations and cooperation established by the Petersberg Declaration of the WEU Council of Ministers of 19 June 1992 for humanitarian-type missions, peace-keeping and crisis-management operations,
agree as follows:
The Parties shall:
1. protect and safeguard classified information and material which has been transmitted by one of the Parties or which will be transmitted or will be generated under this Agreement;
2. comply with the classification levels established by the other Party in relation to the facts and materials transmitted by that Party and ensure that those facts and materials are adequately secured;
3. not to use such facts and materials for purposes other than those specified by the originator and those for which those facts are transmitted;
4. not to provide such facts and materials to third parties without the consent of the transmitting authority.
On the basis of Article 1 of this Agreement, the Czech Republic shall designate the National Security Authority and the Security Organisation and establish programmes based on the basic principles and minimum standards of security defined by the WEU security regulations to be used in the security systems of the Parties in order to ensure the application of common standards of protection. In addition, the Czech Republic is ready to apply the WEU security regulations to the protection of EUCI classified information.
1. The Parties shall ensure that persons under their jurisdiction who, in the exercise of their profession, need access to, or might have access to, classified information or material transmitted under this Agreement shall be investigated, subject to security clearance and thoroughly informed of their security-related obligations before they are intended to come into contact with such information and material.
2. The security clearance procedure shall be established in such a way that it is possible to assess whether, due to its loyalty and reliability, a person can be brought into contact with classified information without creating a security risk under the WEU security regulations.
The Parties shall assist each other in relation to security issues of common interest.
1. The Government of the Czech Republic and the WEU Council shall ensure the implementation of the relevant provisions of this Agreement on the part of the Czech Republic and the WEU.
2. The Secretary-General, acting on the basis of instructions and on behalf of the WEU Council, shall be responsible for security measures to protect classified information and material transmitted under this Agreement.
3. The National Security Office of the Czech Republic acting on behalf of the Government of the Czech Republic shall be responsible for security measures to protect classified information and material transmitted under this Agreement.
4. The Czech Republic and the WEU shall develop reciprocal mechanisms for determining:
security standards applied by both Parties to protect classified information in accordance with the WEU classification to be exchanged;
and liaison between the Czech Republic and the WEU.
5. The WEU Security Authority is responsible for carrying out periodic evaluation of the effectiveness of measures to protect classified WEU information transmitted to the Czech Republic.
This Agreement shall in no way prevent the Parties from concluding bilateral agreements with other States or organisations for the same purpose. Bilateral agreements already concluded will not be affected by this agreement.
1. The Parties shall agree to be bound by this Agreement by signature of the body duly authorised by the Government of the Czech Republic and the WEU Council.
This Agreement shall enter into force 30 days after the date of signature.
Each Party may denounce this Agreement by written notification to the other Party. The denunciation shall take effect six months after receipt by the other Party, but shall not be affected by commitments already made under the provisions of this Agreement.
In order to prove the signature below, duly authorised by the Government of the Czech Republic and the WEU Council, they have signed this Agreement.
Done at Brussels, 13 November 1998, in duplicate in the English and French languages, both texts being equally authentic and deposited with both parties.
