DECLARATION
of 20 March 2019
amending Decree No 189 / 2013 Coll., on the protection and authorisation of timber felling, as amended by Decree No 222 / 2014 Coll.
According to § 79 (5) (d) and for the implementation of § 8 (3) and (5) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 349 / 2009 Coll. and Act No. 225 / 2017 Coll., ("the Act '):
Decree No 189 / 2013 Coll., on the protection and authorisation of timber felling, as amended by Decree No 222 / 2014 Coll., is amended as follows:
1. In Section 1 (a), the words "a set of trees in which the above-ground parts of trees of one floor touch each other, grow or overlap, with the exception of trees forming a tree line, if 'are replaced by the words" a crop of trees in which their above-ground parts touch each other, grow or overlap, and' and the word "a set 'is replaced by the word" a crop'.
2. in Article 1 (c), the words "plantations of timber (3)" shall be replaced by the words "crops of energy trees or Christmas trees."
footnote 3 is deleted.
3. In Article 2 (1), the words "contrary to the requirements for their protection 'shall be deleted and the words" actions causing damage or destruction to timber' shall be replaced by the words "such damage or destruction to timber ';
4. In Article 2 (2), the words "or, where it is carried out in accordance with a plan for the care of a specially protected area 'shall be replaced by the words", in the context of the care of a specially protected area carried out in accordance with a care plan or the principles of care, or in the context of the care of a European significant site or bird area carried out in accordance with a summary of the recommended measures'.
5. In Section 3 of the introductory part of the provision, the words "replacement plantings (Section 9 (1) of the Act) 'are inserted after" [Paragraph 3 (1) (b) of the Act]'.
6. in Article 3 (c) and (d), including footnote 6:
"(c) for the cultivation of energy trees or Christmas trees, normally of one species, grown to achieve rapid and high production of trees or wood material and with a production cycle between harvests of up to 10 years of age;
(d) for fruit trees growing on land in a built-up area (6) registered in the property register as a type of land garden or a built-up area and courtyard.
6) Paragraph 2 (1) (d) of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended. '
7. In the title under the title of Section 4, the words "and a binding opinion on wood felling 'shall be inserted after the words" permit felling'.
8. In Section 4 (1) of the Introductory Part of the provision, the words "and the application for a binding opinion on wood felling (Section 8 (6) of the Act) 'are inserted after the words" (Section 8 (1) of the Act)'.
9. Paragraph 4 (1) shall be added at the end of the text in point (b) "; this shall not apply to an application for authorisation for felling of timber or a binding opinion on felling of timber in connection with an intention for which the purpose of expropriation is specified by a specific legislation '.
10. in Article 4 (2) (b), the word "applicant" shall be replaced by the word "notifier," after the words "water flows4)," the word "a" shall be replaced by a comma and, at the end of the text in point (b), the words "in the protection zone of the thermal energy distribution facility carried out in the operation of these facilities and in the cutting down of timber at the construction site" shall be added.
Efficacy
This Decision shall enter into force on 1 April 2019.
