DECLARATION

amending and supplementing Decree No 119 / 1974 Coll., implementing Customs Act No 44 / 1974 Coll.
The Federal Ministry of Foreign Trade, in agreement with the Federal Ministry of Finance and the Federal Ministry of Foreign Affairs, provides, pursuant to Article 44 (2) of Customs Act No. 44 / 1974 Coll.:
Čl. 1
Decree No. 119 / 1974 Coll., implementing Customs Act No. 44 / 1974 Coll., is amended as follows:
1. § 40 Travel needs are:
„§ 40
Non-commercial goods in travel and mail
(1) Goods imported for the personal consumption of a passenger or a member of the crew of a means of transport (travel supplies) shall be exempt from the duty if the type and quantity of such goods correspond to the personal circumstances and length of the journey; within this framework, no more than 2 litres of wine, 1 litre of spirit drinks, 250 cigarettes or equivalent quantities of other tobacco products, 1000 shots of shot and 50 rounds of bullet.
(2) Persons returning to the country after temporary stay abroad shall be exempt from customs duties on goods for personal use, such as clothing, footwear, linen which they have acquired during their stay abroad for reasons of urgency. Goods imported for reasonable personal consumption during the journey shall also be exempt from customs duties, but not more than the quantities referred to in paragraph 1, except for hunting rounds.
(3) Goods imported in the course of travel, except in the cases referred to in paragraphs 1 and 2, by persons resident in the country shall be exempt from customs duties in respect of a price of up to 3000 CZK, provided that they have been obtained abroad by gift or foreign exchange means which they may use under the applicable rules for the purchase of goods.
(4) Goods imported in the course of travel, except in the cases referred to in paragraphs 1 and 2, by persons residing abroad shall be exempt from customs duties up to a value of up to 600 CZK.
(5) Goods imported in consignments shall be exempt from customs duty up to a price of up to 300 CZK.
(6) Where, in accordance with paragraphs 3 to 5, goods the price of which exceeds the amount fixed for exemption from customs duties are imported, the duty shall be levied on such goods only on an amount which exceeds the price fixed for duty-free importation of the goods.
(7) The price means the domestic retail price of the same or similar goods. "

„§ 42
(1) To the extent and under the conditions laid down in Section 41, the removal from customs duties of the above-mentioned Czechoslovak nationals returning from their permanent residence abroad to their permanent residence in the country of residence.
(2) Czechoslovak nationals returning from abroad after a temporary stay of at least one year shall be exempt from customs duties under the conditions laid down in paragraphs 5 and 6 of Paragraph 41 of this Article.
(3) Czechoslovak nationals returning from abroad, after a temporary stay of at least one year, shall be exempt from customs duties on goods which they have acquired while staying abroad and which they import in quantities for their own use and persons living with them in the common household except motor vehicles. "
3. § 48 Propulsive substances, lubricating oils and fats for the operation of means of transport are:
„§ 48
Powders, lubricating oils and fats for the operation of transport equipment
(1) Propellants, lubricating oils and fats required to operate a means of transport which are imported by the same means of transport in containers firmly incorporated in the means of transport shall be exempt from the duty.
(2) Propagating substances, lubricating oils and fats carried in reserve containers are exempt from customs duty in a quantity of a reasonable length of travel and consumption of the means of transport.
(3) The duty shall also be released on propellants, lubricating oils and fats imported by foreign transport organisations for their own means of transport. This exemption shall not apply to propellants, lubricating oils and fats for road vehicles. ';

This Decree shall take effect on 15 July 1980.
