THE LAW
of 3 March 2011
amending Act No. 25 / 2008 Coll., on an integrated register of environmental pollution and an integrated system of environmental reporting obligations and amending certain laws, as amended, and other related laws
Parliament has decided on this law of the Czech Republic:
Amendment of the Integrated Environmental Pollution Register Act and the Integrated Environmental Reporting System
Act No. 25 / 2008 Coll., on the Integrated Register of Environmental Pollution and Integrated System of Implementation of Environmental Reporting Duties and on the Amendment of Certain Acts, as amended by Act No. 227 / 2009 Coll. and Act No. 281 / 2009 Coll., is amended as follows:
1. in Article 3 (1) (a), the words "and shipments of waste" shall be inserted after the words "pollutants."
2. In Section 3, at the end of paragraph 5, the words "or through the Ministry's data box for the fulfilment of environmental reporting obligations, if the Ministry had it set up 'shall be added.
3. In Article 4 (3), the words "or through the Ministry's data box intended to fulfil environmental reporting obligations' shall be inserted after the words" the environment 'and the words "each reporting year' shall be replaced by the words" any reporting obligation '.
4. In Article 4, paragraphs 4 to 8 are added, including footnote 6a:
"(4) The data standard for the transmission of data through an integrated system of reporting obligations in the field of the environment or through a Ministry data box intended to fulfil reporting obligations in the field of the environment describes the data structure and data format of the electronic document and automated checks of the content of the reports submitted for each reporting obligation.
(5) The mandatory reporting body shall enter into the integrated environmental reporting system through the designated electronic service.
(6) The condition for using an integrated environmental reporting system or a Ministry data box designed to fulfil environmental reporting obligations is a prior registration in an integrated environmental reporting system.
(7) The mandate to represent the mandatory reporting body shall be demonstrated by full power in electronic form or by the output resulting from the transfer of the power of attorney in paper form by the authorised conversion of documents6a) submitted through an integrated environmental reporting system or through a Ministry data box to fulfil environmental reporting obligations.
(8) An integrated environmental reporting system processes personal data.

5. in Article 5 (1) (a), the words "or carry-overs of waste" shall be inserted after the words "pollutants."
6. in Article 5 (2) (a), the words "or carry-overs of waste" shall be inserted after the words "pollutants."
7. In Article 7 (c), the words "by 31 December of the calendar year for the following reporting year 'are replaced by the words" at least six months before the date of implementation of each reporting obligation'.
Amendment of the Water Law
In Article 126 (6) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 25 / 2008 Coll., the words "or the Ministry's data boxes intended to fulfil environmental reporting obligations' are inserted before the words" under the law '.
Amendment to the Packaging Act
In Article 15 (1) (b) of Act No. 477 / 2001 Coll., on packaging and on the amendment of certain laws (the Law on Packaging), as amended by Act No. 25 / 2008 Coll., the words "or the Ministry's data boxes intended to fulfil environmental reporting obligations' are inserted before the words" under the Act '.
EFFECTIVE
This Act shall take effect on the day of its publication.
