DECLARATION
of 21 December 2004
amending Decree No 442 / 1991 Coll., on the termination of studies in secondary schools and schools, as amended
The Ministry of Education, Youth and Sports, in agreement with the Ministry of Health, provides, pursuant to Sections 25 (9) and 26 (2) of Act No. 29 / 1984 Coll., on the System of Primary Schools, Secondary Schools and Higher Vocational Schools (Education Act), as amended by Act No. 171 / 1990 Coll. and Act No. 138 / 1995 Coll.:
Čl. I
Decree No. 442 / 1991 Coll., on the termination of studies in secondary schools and schools, as amended by Act No. 138 / 1995 Coll. and Decree No. 235 / 2003 Coll., is amended as follows:
1. Part one, including the headings and footnote 1, is deleted.
2. Paragraph 8 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
3. In Paragraph 8 (1), the words "or the successful completion of the examination of the subject concerned for all the years of study (1) 'are deleted and the dot is inserted after the words" studies'.
4. In Article 8 (2), the words "(§ 11 (1) to (3)) 'shall be deleted; the words" Gymnasium' shall be replaced by "Gymnasium '; the words" fields of study' shall be replaced by the words "fields of education '; the sentence" Practical examinations of vocational subjects and practical examinations of vocational training shall be inserted after the sentence of the second sentence at the earliest 15 April'.
5. In Article 8, the following paragraph 4 is added:
"(4) The oral examinations of pupils who have successfully completed the last year of study by 31 August of the relevant school year and have not carried out oral examinations by the deadline referred to in Section 8 (2) shall take place in the month of September of the following school year. The dates shall be set by the principal of the school. ';
6. Paragraph 9, including the title and footnote 1, reads as follows:
„§ 9
Graduation exam in secondary school providing vocational training and in conservatory
(1) Graduate examination in the fields of education with the code name of the category of education achieved L consists of examination of Czech language and literature, examination of an optional subject, theoretical examination of professional subjects and practical examination of professional training.
(2) The graduation examination in the extension studies (code name of the category of education achieved L) for applicants who have obtained a secondary education with a certificate, consists of an examination of Czech language and literature, an examination of an optional subject, theoretical examinations of professional subjects and practical examinations of professional subjects.
(3) Graduate examination in the fields of education with the code name of the category of education achieved M consists of examination of Czech language and literature, examination of optional subject, theoretical examination of professional subjects and practical examination of professional subjects.
(4) Graduate examination in the fields of education of group 82 Arts, used art with code name of category of education M in the conservatory consists of a examination of Czech language and literature, examinations of optional subject and examinations of professional subjects. The examination of professional subjects shall be divided into a theoretical examination of professional subjects and a practical examination of professional subjects. A practical examination of professional subjects may take the form of a public appearance.
(5) Graduate examination in other fields of education in group 82 Arts, used art with code name of category of education M consists of examination of Czech language and literature, examination of foreign language, examination of the history of art culture and examination of professional subjects. The examination of professional subjects shall be divided into practical examinations, including the oral defence of the work done on the subject and the oral examination of professional subjects according to the field of education.
(6) Professional subjects, the subject of which is the subject of a theoretical examination of professional subjects, practical examinations of professional subjects or practical examinations of vocational training, and optional subjects are set out in the school curriculum. The concept and content of these examinations shall be determined by the school director. Optional items may be only items whose total subsidy is at least 4 hours.
(7) The practical examination of vocational training and practical examination of professional subjects shall be carried out by the pupil before the theoretical examination of professional subjects. The practical examination of vocational subjects shall not take place separately in those fields of education where the school curriculum is established as part of the theoretical examination of vocational subjects.
(8) The theoretical examination of the professional subjects referred to in paragraphs 1 to 4 may be divided into two separately classified examinations, provided that the school curriculum so provides.
(9) Where a school curriculum so provides, one of the two theoretical examinations of professional subjects may be replaced by a foreign language test, which may include a written examination, the content, concept and length of which shall be determined by the school director.
(10) Graduate examination is oral except for written work from Czech language and literature, practical examinations from vocational training and practical examinations from professional subjects.
(11) Graduate examination from Czech language and literature is a comprehensive examination; contains written work from Czech language and literature and oral examination from language and literary knowledge. For written work from Czech language and literature, the school director sets 4 topics, from which the student chooses one topic. Written work from Czech language and literature takes no more than 240 minutes. The results of the written work from the Czech language and literature will be announced to pupils no later than one week before the beginning of the oral examinations.
(12) For individual oral examinations, 25 to 30 subjects shall be determined, one of which the pupil draws. If required by the nature of the field of education, it may be part of a theoretical examination of the professional subjects graphic or written solution of the task. The preparation for each test takes 15 minutes; If a graphical or written solution is included, the Chairman of the Examination Committee may extend this period by another 15 minutes. Individual oral examinations shall take a maximum of 15 minutes. If the theoretical test from professional subjects is not divided into two separately classified tests, the preparation for the test takes 30 minutes and the test takes a maximum of 30 minutes.
(13) In the practical examination, pupils demonstrate the level of practical skills in the relevant field of education. The number of subjects of practical examinations shall be determined by the school director. If more than one topic is set, the student draws one topic. The topic of practical examinations in the fields of education of group 82 Arts, used art with code name of the category of education achieved by M is determined by the school director. The practical examination shall be carried out by the pupil for a maximum of 3 days; for classes of education group 82 Arts, used art 2 to 4 weeks, in conservatory for no more than 3 days. In one day, the practical test shall last a maximum of 7 hours.
(14) In the event that a practical examination of professional subjects takes place in the form of a written work and its defence, the topic of practical examination shall be determined by the school director. The subject of practical examinations may be determined at the earliest at the beginning of the school year in which the pupil is to complete his studies. The defence of written work shall last a maximum of 30 minutes. "
7. In Paragraph 10 (1), the words "the field of study 'are replaced by" the field of education'.
8. In Paragraph 10 (2), the words "fields of study 'are replaced by the words" fields of education'.
9. Paragraph 10 (3) reads as follows:
"(3) Where a written examination is part of a foreign language examination, it shall determine the content, concept and length of the test by the school director. The examination of the Czech language and literature shall be carried out according to § 9 (11)."
10. In Paragraph 10 (4), the last sentence is replaced by the sentence "Individual oral examinations shall last no more than 15 minutes."
11. in Article 10 (5), the words "the field of study" are replaced by the words "with the exception of foreign languages (Article 25 (4))," the sentence of the second sentence is deleted, and in the third sentence part of the sentence after the semicolon is read: "physical education is classified as optional graduation courses in the gymnasium only in the field of training and physical education."
12. In Article 10 (6), the words "one file 'are replaced by the words" one topic', the words "the file 'are replaced by the words" the topic' and the last sentence is replaced by the words "The individual test of an optional subject takes no more than 15 minutes'.
Article 13 (11) to (13) shall be deleted, including the headings.
(14) Part Four shall be deleted, including the headings.
15. In § 20 the title reads: "Classification and Evaluation of Graduate Exams."
16. in Paragraph 20 (1), the words "final post-graduate and discharge" shall be deleted and the words "account shall be taken of in the design of the resulting benefit of the test for their evaluation" shall be replaced by the words "take into account in the design of the resulting benefit of the test, at least once a third."
17. In Paragraph 20, the following paragraph 2 is inserted after paragraph 1:
"(2) The classification of the individual final examinations shall be based on the following benefit scale:
(a) 1 - excellent,
(b) 2 - praiseworthy,
(c) 3 - good,
(d) 4 - sufficient;
(e) 5 - insufficient. ';
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
18. In Article 20 (4), the words "final post-graduate examinations and discharge ', the words" or at the final post-graduate examination or discharge', the words "or graduate performance from the main field of study 'and the words" or final post-graduate examination or discharge' shall be deleted and the words "in secondary schools and conservatories' shall be replaced by the words" in the fields of education of the group 82 Arts, used art with the code name of the category of education obtained by M and in the conservators in the fields of education with the code designation of the category of education M ';
19. in Paragraph 20 (6), the words "or final graduation or discharge" shall be deleted;
20. Paragraph 21, including the title, reads:
„§ 21
Corrective tests
(1) If a pupil has been classified as insufficient at a grade 5 graduation exam, he / she will perform the correction exam in September in the next school year.
(2) If the pupil has been classified from at least two examinations at grade 5 - insufficient or has not benefited from the correction test, he shall repeat the full exam in the next calendar year at the time specified by the school director.
(3) If the pupil first took a graduation exam in September and was classified from one exam level 5 - insufficient, he / she shall perform the correction examination by the end of the first semester of the school year concerned within the deadline set by the school director.
(4) If the student first passed the graduation exam in September and was classified as at least two examinations at level 5 - insufficient, he shall repeat the full graduation exam in the next calendar year within the deadline set by the school director.
(5) If the pupil has been classified as insufficient from a single degree 5 exam at the same time, he shall repeat the exam at the time specified by the school director.
(6) Written work from Czech language and literature, written examination from a foreign language or written part of the examination from mathematics at the Gymnasium with a special focus on mathematics and a special focus on mathematics and physics, in the event of a correction examination from the subject referred to in paragraphs 1 and 3, or in the case of a repetition of the entire graduation examination referred to in paragraphs 2 and 4, only if it was classified as 5 - insufficient.
(7) The pupil may only repeat the full exam once. "
21.
„§ 22
Test Panel
(1) The graduation examination shall take place before the Examination Committee. The examination committee shall have permanent members and other members. The permanent members are the President, Vice-President and Class Teacher or head of the Conservatory Department in the fields of education with the code name of the category of education achieved by M. Other members are the teacher of the subject and the associate; in the fields of education with the code designation of the category of educational attainment L, the teacher of vocational training, for the graduate examination of the vocational subjects in the fields of education group 82 with the code designation of the category of education achieved M and in the conservatory in the field of education with the code designation of the category of educational attainment M, the leading educator of the main field and, in the case where the vocational training is provided at the workplace by another legal or natural person on the basis of an agreement between the school and that other legal or natural person, the worker providing the teaching of the pupil at the workplace.
(2) By the end of February each school year, the President of the Examination Committee shall be appointed by the Regional Office competent under the seat of the secondary school in agreement with the employer of the proposed chairman. The chair of the Examination Board shall be appointed as a teacher from another secondary school who has the professional and pedagogical competence appropriate to the relevant or related field of education and to at least five years of teaching experience. The head of the examination committee shall be the head of the school in which the examinations are to be held and, where appropriate, the deputy director of the school.
(3) The chairman of the examination committee shall direct the work of the committee, check the readiness of the examinations, evaluate the level of the graduation exam. It shall be responsible for the proper conduct of the test and classification. If the Chairman of the Examination Board cannot perform his duties for serious reasons in the short term, the Vice-President shall assume his duties.
(4) The Vice-President and other members of the Examination Board shall be appointed by 31 March of each school year by the Director of the School in which the examinations are carried out, from the teaching staff of that School. A pedagogical worker with at least five years of teaching experience shall be appointed Vice-President of the Examination Committee. If he is not an employee of the school, the school director shall be appointed as a member of the examination committee after consulting his employer.
(5) If the organisation and duration of the written or practical examination exclude the permanent presence of the test panel during the test, its chairman shall designate a member of the test committee responsible for the proper conduct of the test and propose to the test panel the classification of that test.
(6) In the event that a member of the Examination Board is unable to perform his duties for serious reasons, the appointing authority shall appoint a new member of the Panel.
(7) The head of the school may also invite a practitioner, a university or a higher vocational school to graduate. This expert may ask questions to the pupil, but does not participate in the classification and evaluation of the graduation exam. '
22. Sections 23 and 24 are deleted.
23. Paragraph 25 (1) reads as follows:
"(1) The subjects or other comprehensive sections of the course from which the school director may choose the subjects of the theoretical examination of the vocational subjects and the optional subjects of the graduation examination are set out in the school curriculum; the subjects for the graduation exam are determined by the school director (§ 9 (6), § 9 (13), § 10 (5)). '
24. In Paragraph 25 (3), the words "field of study 'are replaced by the words" field of education' and the words "within two years at the latest after the graduation examination 'are deleted.
25. In Article 25, paragraphs 4 and 17 to 19, including footnotes 2 and 3, are deleted.
Paragraphs 5 to 16 shall be renumbered paragraphs 4 to 15.
26. In Paragraph 25 (4), the words "at their request 'are inserted after the words" with another language of instruction'.
27. in Article 25, paragraphs 6 and 7 read:
"(6) The pupil may take the final examination no later than 5 years after the completion of the course, even if it is assessed as leaving the course.
(7) If the student fails to attend the examination for serious reasons, he / she shall apologize in writing to the chairman of the examination committee by means of the principal of the school in which the examination is held no later than 3 days after the date of the examination. The importance of the reasons for which the pupil did not show up for the test shall be assessed by permanent members of the examination committee. If the examination committee admits the pupil's apology, the pupil shall be given a replacement test date. Failure to comply with the deadline may in serious cases be waived by the Chairman of the Examination Board. If the pupil did not show up for the test without an apology, or if the apology was not accepted, it shall be considered as being classified as being 5 - insufficient from the test. '
28. Paragraph 25 (8) reads:
"(8) If, after the start of a test, a pupil withdraws from the course of a graduate examination, it shall be considered as being classified as insufficient from the test. In cases where, for serious reasons, the pupil is prevented from completing an examination which is part of the final examination, the examination committee may set a replacement period for the pupil. If a pupil uses illicit aids or other serious disruptions in some of the examinations that form part of the graduation examination, the chairman of the examination committee may exclude him from the examination; in which case it shall be considered as being classified as insufficient from the test. ';
29. in Paragraph 25 (9), the words "full secondary education or full secondary vocational education" shall be replaced by the words "secondary education with a graduate examination" and the words "if the content of the subject in the previous study corresponds to the subject of the graduation examination" shall be replaced by the words "if those examinations are of a level comparable."
30. In Paragraph 25 (10), the words "in the workplaces of secondary vocational schools, schools or in the training centres and workplaces of practical training as well as in the operating premises of organisations' are replaced by the words" or in the workplaces of other legal or natural persons where practical training is carried out under an agreement concluded between the school and that person '.
31. in Article 25 (11), the word "education" shall be inserted after the word "fields."
32. in Paragraph 25 (12), the words "sensory and disabled" shall be replaced by the words "with disability and disability."
33.In Paragraph 25 (13), the second sentence is deleted.
34. in Paragraph 25 (15):
"(15) Pupils who have successfully passed the graduation exam shall be issued a Certificate of Graduation, no later than 7 days after the final panel meeting. The graduation certificate shall state the date of completion of the pupil's graduation exam. ';
35. Paragraph 26 (1) is deleted and paragraph 2 is deleted.
36. In Article 26, the words, "for secondary medical schools, the Ministry of Health of the Czech Republic," deleted and the text "in § 1 (3), § 5 (3), § 8 (3), § 19 (1) and § 26 (1) shall be replaced by" in § 8 (2). "
Čl. II
Transitional provision
Up to the time of the issue of the framework and school education programmes, the existing teaching documents of the fields of education shall be followed.
Čl. III
Efficacy
This Decree shall take effect on 31 December 2004.
