DECLARATION
of 16 February 2009
amending Decree No. 466 / 2006 Coll., on the Safety Flight Standard
The Ministry of Transport provides pursuant to § 22a (1) of Act No. 49 / 1997 Coll., on Civil Aviation and on the amendment and amendment of Act No. 455 / 1991 Coll., on Business Business (Trade Code Act), as amended, as amended, as amended by Act No. 225 / 2006 Coll.:
Decree No. 466 / 2006 Coll., on the Safety Flight Standard, is amended as follows:
1. in Article 1, the words "following the directly applicable legislation of the European Communities" shall be inserted at the beginning of point (a).

Basic concepts
For the purposes of Part Two of this Order:
(a) the time difference between two time zones according to winter time;
(b) a flight crew member, a pilot, a flight engineer and an air navigator, intended for duty on an aircraft during the flight period;
(c) a flight crew member and cabin crew member;
(d) a split flight service consisting of 2 parts separated by partial rest;
(e) on the day of the period of 24 hours consecutive starting at 0.00 hours of single world time,
(f) on the day of leave, the calendar day indicated in the schedule of services where the flight crew member is not required by the air carrier's duties;
(g) a suitable room for partial rest and a flight advance of a reasonably equipped space, located in a quiet environment and not accessible to the public; and
(h) by appropriate accommodation, a separate room for each member of the flight crew, located in a non-noisy environment, equipped with a bed, with sufficient ventilation and, where appropriate, a device to control the temperature and intensity of light. ';
3. In the introductory part of Paragraph 3 (1), the word "at least 'shall be added at the end of the sentence.
4. In Article 3 (1) (c), the word "transport 'is replaced by" local transfer time to and from the place of suitable accommodation';
5. in Article 3 (1), the following point (e) is inserted after point (d):
"(e) the period of flight activity;"
Points (e) to (g) shall be renumbered as points (f) to (h).
6. Paragraph 3 (2) reads as follows:
"(2) The air carrier shall determine the flight time after the last flight of the service concerned, by type of aircraft and type of operation. Post-flight activity means an activity established by the approved Air Operator's Manual. The duration of the flight activity shall be at least 30 minutes. ';
7. In Article 3, the following paragraph 3 is added:
"(3) If a member of the crew of an aircraft so agrees and if the conditions laid down in this Decree are met, the additional service may commence before the end of the specified rest period after the completion of the previous service. ';

Total flight time
Notwithstanding the maximum extent of the total flight time under the directly applicable legislation of the European Community1), the air carrier shall ensure that the total flight time does not exceed 280 hours during 90 calendar days consecutive. ';
9. In the introductory part of Paragraph 5 (1), the word "at least 'shall be added at the end of the sentence.
10. in Article 5 (1), point (d) is deleted;
Point (e) shall be renumbered as point (d).
11. in Article 5 (1) (d), the word "basic" shall be deleted;
12. in Article 5 (2), "home" is replaced by "maternity."
13. in Article 5, paragraphs 3, 4, 5, 6 and 7 are deleted;

15. in Article 7 (1) (c), the words "transport time in both directions between the place of service and the place of suitable accommodation" shall be replaced by the words "local transfer time to and from the place of suitable accommodation."
16. in § 7 (2), the words "and the double crew of an aircraft" shall be replaced by the words "as amended in § 8 and 9."
17. in Paragraph 8, paragraph 2 is deleted;
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
18. in Paragraph 9 (1):
"(1) An air carrier may designate an enhanced flight crew for which all the functions of the essential flight crew as determined by the air carrier for the type of aircraft concerned (" the double crew ') are duplicated. Paragraph 8 (1) and (2) shall not apply to the double crew.';
19. in Paragraph 9 (4), "4" is replaced by "3."
20. In Section 10, the first sentence is deleted.

Rest requirements
(1) If the minimum rest period laid down in the directly applicable European Communities legislation (1) is determined by the length of the previous service, this period shall be increased by a partial rest period, if the previous service has been divided.
(2) Where a service is started for at least 5 days consecutive days outside a parent aerodrome, a member of the crew of an aircraft shall be provided in accordance with the directly applicable legislation of the European Communities1) rest of the same duration as if the service is started at a parent airport.
(3) Where appropriate accommodation has been provided to a crew member during a partial rest period of at least 8 hours, the partial rest period shall not be counted for the purpose of determining rest.
(4) The air carrier shall extend the rest period by a period by which the local transfer time to and from the appropriate accommodation has exceeded 2 hours.
(5) The air carrier may shorten the rest period by a period of time by which the local transfer time to and from the appropriate accommodation is less than 2 hours, provided that the local transfer time to and from the appropriate accommodation does not exceed 1 hour 30 minutes for the journey back and forth, but the rest time spent by the flight crew member at the appropriate accommodation site must not be less than 10 hours.
(6) The air carrier will extend the rest period
(a) for 36 hours comprising two local nights in a period of 7 calendar days consecutive starting at 0.00 hours of single world time on the day following the day on which the crew member took up duty after the completion of the previous extended rest period referred to in this provision or in point (b);
(b) 60 hours covering three local nights in a period of 10 calendar days consecutive starting at 0.00 hours of single world time on the day following the day on which the crew member took up duty after the completion of the previous extended rest period referred to in (a) or under this provision.
(7) If the time difference between the opening point and the end of FDP is 4 hours or more, the air carrier shall extend the rest period to 14 hours and for each time zone exceeded, starting with the fifth time zone, by an additional 30 minutes.
(8) The air carrier shall determine to a member of the crew of an aircraft which has performed 1 or more flight services during which the time difference between the points of departure and the end of service was at least 4 hours and which has ended the flight duty in a place with a time difference of less than 1 hour from the place of its parent aerodrome, the rest period subject to the following conditions:
(a) if the time spent by a member of an aircraft crew outside a parent airport is 60 hours or less, the rest period shall be at least 24 hours or four times the time difference between the time at the place of the parent aerodrome and the time at the place situated in the outermost time zone where the member of the aircraft crew has retired, whichever is the higher;
(b) if the time spent by a member of an aircraft crew outside a parent airport is more than 60 hours, the rest period shall be at least 48 hours or eight times the time difference between the time at the place of the parent aerodrome and the time at the place situated in the outermost time zone where the member of the aircraft crew has retired, whichever is the higher;
(c) if the rest period of the flight crew member outside the parent airport was at least 48 hours and the rest was completed at a place with a difference of less than 4 hours from the place of the parent aerodrome, the air carrier may shorten the rest period determined in accordance with point (b) four times.
(9) If the flight service during which the difference at the time zones were exceeded was at least 4 hours and whose performance was terminated at a point with a time difference of less than 1 hour from the parent aerodrome, has not been terminated at the parent aerodrome, the air carrier shall, at the request of the commander, allow an additional 1 flight service to be performed at the place where the flight crew member must be relieved in accordance with paragraph 8.
(10) The air carrier shall establish days of leave in the schedule of services for the crew member within the scope of:
(a) 7 days in the calendar month into which the rest period may be included; and
(b) 24 days in the calendar quarter to which rest periods may be included.
(11) The day off must include 2 local nights. The day of leave set out in the schedule of services which has not been provided for operational reasons shall be replaced by another day of leave for the crew member within the earliest possible time.
(12) In addition to the days of leave referred to in paragraph 10, the air carrier may provide the crew member with additional days of leave to which rest periods may be included. ';
22. in Paragraph 12 (a), the words "base abroad" are replaced by the words "other base."
23. in Article 12 (a), (b) and (c), the words "home" and "home" shall be replaced by the words "mother" and "mother."
24. In Article 13, the following paragraph 5 is added:
"(5) If an aircraft crew member so agrees and the conditions laid down in this Regulation are met, the performance of an additional standby may commence before the end of the specified rest period after the end of the previous standby. ';
25. in Paragraph 14 (1) (b), the word "basic" shall be deleted;
26. Paragraph 14 (2) is deleted.
Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
27. in Article 14 (2), the word "basic" shall be deleted;
28. In Paragraph 14 (4), "4 'is replaced by" 3'.
This decree shall take effect on the first day of the month following its publication.
