adjusting certain compensation for loss of earnings after the cessation of incapacity for work caused by accidents at work or occupational diseases
The Government of the Czechoslovak Socialist Republic, in agreement with the Central Council of Trade Unions, hereby orders pursuant to § 202 (2) of the Labour Code (full version No. 55 / 1975 Coll.):
(1) The compensation for the loss of earnings due under the Labour Code or, where applicable, the previous Regulations, (1) to workers after the cessation of incapacity for work caused by accidents at work or occupational diseases, is adjusted to increase by 2% for each calendar year following the onset of entitlement to such compensation by 31 December 1980.
(2) Workers who have been entitled to compensation for loss of earnings and, where appropriate, to compensation provided for under Paragraph 1 of the Decree of the Government of the Czechoslovak Socialist Republic No 138 / 1976 Coll., on the adjustment of certain compensation for loss of earnings after the cessation of incapacity for work or occupational diseases, the adjustment of compensation provided for in the previous paragraph shall be made only for the period from 1 January 1972.
(1) The compensation for the loss of earnings after the cessation of incapacity for work is also valid after the adjustment made under § 1 of § 195 (2) of the Labour Code.
(2) In order to increase the invalidity or partial invalidity pension under the statutory measure of Bureau of the Federal Assembly No 7 / 1982 Coll., to increase pensions and to make certain changes to the Social Security Act and, where appropriate, to a similar increase, carried out in accordance with the former provisions, (2) the calculation of compensation for loss of earnings under Paragraph 1 shall not be taken into account.
The compensation for loss of earnings adjusted under Paragraph 1 shall be due from 1 January 1982.
This Regulation shall enter into force on the day of its publication.
