Decree of the Czech Office for Safety of Labour and the Czech Mining Office on Vocational Ability in Electrical Engineering

on competence in electrical engineering
The Czech Labour Safety Authority pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, and the Czech Mining Authority pursuant to § 57 (1) (d) of Act No. 41 / 1957 Coll., on the Use of Mineral Wealth (Upper Law), and pursuant to § 10 (a) of the Czech National Council Act No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration, provides in an agreement with the Czech Trade Union Council and other central bodies:

I. oddíl

Preliminary provisions
§ 1
(1) The Decree sets out the degrees of professional competence (hereinafter referred to as "qualifications") of personnel engaged in or operating (1) of electrical equipment (hereinafter referred to as "activity") on them, by design of such equipment, management of the activity or design of electrical equipment in organisations which manufacture, install, operate or design electrical equipment, or perform activities on electrical equipment in a supplier's way; lay down the conditions for obtaining qualifications and responsibilities of organisations and personnel in relation to qualifications.
(2) For the purposes of this decree, electrical equipment likely to endanger life, health or electrical property and equipment intended to protect against atmospheric or static effects shall be considered as electrical equipment.
§ 2
The staff referred to in Paragraph 1 (1) must be physically and mentally competent (2) and must comply with the conditions laid down in this Decree.

Qualification of workers
§ 3
Meeting staff
(1) Workers familiar are those who have been familiar with the regulations on the treatment of electrical equipment within the scope of their activity (3) and are alerted to the potential threat to these facilities.
(2) The information and warnings referred to in paragraph 1 shall be made by an organisation authorised by a staff member with a qualification appropriate to the nature of the activity and shall be recorded and signed by the staff member.
§ 4
Lessons learned
(1) Workers who have been instructed by the organisation within the scope of their activities are aware of the regulations for the operation of electrical equipment, trained in this activity, are alerted to potential threats to electrical equipment and to the provision of first aid in electrical accidents.
(2) The organisation shall determine the content and duration of the training, taking into account the nature and scope of the activities to be carried out by the personnel referred to in paragraph 1, and ensure that the knowledge of such personnel is verified within the time limits specified in advance.
(3) The familiarisation, training, notification and verification of knowledge referred to in paragraphs 1 and 2 shall be carried out by an organisation responsible for the operation of electrical equipment by an organisation qualified for the character of the activity and, if applicable, by a worker with one of the qualifications referred to in paragraphs 5 to 9; it shall draw up a record thereof, which it shall sign with the staff instructed.
§ 5
Expert staff
(1) Expert staff shall be those who have completed the vocational training referred to in Annex 2 and have passed the examination after training to the extent provided for in Section 14 (1).
(2) The training and examination referred to in paragraph 1 shall be provided by the organisation. The content and duration of training shall be determined by the organisation taking into account the nature and scope of the activities to be carried out by the staff. It shall also ensure that they are checked at least every three years.
(3) The training shall be carried out by an organisation authorised by the staff member qualified to carry out the activities to be carried out by the staff. The tests or examinations referred to in paragraph 2 shall be carried out by an organisation authorised by a worker with one of the qualifications referred to in paragraphs 6 to 9; they shall make a record thereof, which they shall sign together with experts.
§ 6
Independent workers
(1) Self-employed workers are highly qualified workers who:
(a) meet the requirements for workers referred to in Article 5 (1);
(b) have at least the shortest required experience as set out in Annex 1;
(c) they have demonstrated, by passing a further examination to the extent set out in Paragraph 14 (1), the knowledge required for a separate activity.
(2) The examination referred to in paragraph 1 must be carried out by the organisation; it shall also be required to ensure at least once every three years that the staff are checked for a separate activity.
(3) The examination or examination shall be carried out by an organisation appointed by a three-member examination committee, at least one member of which shall have one of the qualifications referred to in paragraphs 7 to 9. The Commission shall draw up an minutes thereof, signed by its members.
§ 7
Activity management personnel
(1) Activity management staff shall be highly qualified staff who:
(a) meet the requirements for workers referred to in Article 6 (1) or Article 5 (1);
(b) have at least the shortest required experience as set out in Annex 1;
(c) they have demonstrated, by passing a further examination to the extent set out in Paragraph 14 (1), the knowledge necessary for the management of the activity.
(2) The examination referred to in paragraph 1 shall be carried out by the organisation; it shall also ensure at least every three years that the staff responsible for the management of the activity are checked.
(3) The examination or examination shall be carried out by an organisation appointed by a three-member examination committee, at least one member of which shall have the qualifications referred to in § 8 or 9. The Commission shall draw up an minutes thereof, signed by its members. The organisation shall inform the competent supervisory authority (4) at least four weeks prior to the date and place of the tests or checking.
§ 8
Supplier management and traffic management personnel
(1) The management staff of the activities carried out in a supplier's way shall be those of senior qualified staff who:
(a) meet the requirements for workers referred to in Article 7 (1) or Article 6 (1);
(b) have at least the shortest required experience as set out in Annex 1;
(c) they have demonstrated, by passing a further examination to the extent set out in Article 14 (1), the knowledge necessary for the management of the activity carried out in a supplier's way.
(2) Traffic management staff are senior qualified staff who:
(a) meet the requirements for workers referred to in Article 7 (1) or Article 6 (1);
(b) have at least the shortest required experience as set out in Annex 1;
(c) they have demonstrated, by passing a further test to the extent set out in Paragraph 14 (1), the knowledge required for traffic management.
(3) The tests referred to in paragraphs 1 and 2 must be carried out by the organisation; it shall also ensure at least once every three years the checks of the management staff carried out in a supplier's way and the traffic management staff.
(4) The examination or examination shall be carried out by an organisation appointed by at least a three-member examination committee whose two members must have the qualifications referred to in paragraph 1 or § 9. The Commission shall arrange for the examination or examination of the minutes signed by its members. The organisation shall inform the competent supervisory authority at least four weeks before the examination or examination is carried out of the date and place of the tests or checking. Within the same time limit, it shall also inform the relevant organisational component (plant) of the electricity distribution organisation (s), (5) if it lends to the management of the activities carried out in a supplier's way or to the management of the operation of the electrical demand facilities connected directly to the public electricity distribution facility.
§ 9
Revision staff
(1) The staff involved in the revision of electrical equipment (hereinafter referred to as the "review technicians") shall be experts who have completed the professional training referred to in Annexes 1 and 2, the practice set out in Annex 1 and, at the request of the organisation, have passed the examination before one of the competent supervisory authorities.
(2) Specific rules issued by the competent supervisory authorities shall apply to the carrying out of the tests and checking of the review technicians.
§ 10
Self-design staff and design management staff
(1) Self-design staff and design management staff are those with vocational training and experience intended for specific regulations (6) and have passed an examination of the knowledge of the rules for ensuring the safety of work and technical equipment and of the rules related to design. 7)
(2) The test referred to in paragraph 1 shall be carried out by the design organisation; It shall also ensure at least once every three years that individual design and design management personnel are checked.
(3) The test or examination shall be carried out by an organisation appointed by at least a three-member examination panel, at least one member of which shall be qualified as referred to in paragraph 1 or § 8 or 9. The Commission shall arrange for the examination or examination of the minutes signed by its members. The organisation shall inform the competent supervisory authority at least four weeks prior to the date and place of the tests or checking. It shall also inform the relevant plant of the electricity distribution organisation concerned within the same time limit, if it lends to project management personnel or workers who design electrical demand facilities intended for direct connection to the public electricity distribution facility.
§ 11
Qualification in specific cases
(1) Graduates of the university of electrical engineering and graduates of the Faculty of Science of Physics, who work as assistants in laboratories of all grades, are considered to be employees in their workplaces when they have passed an examination to the extent provided for in Section 14 (1). Their knowledge shall be verified by checking at least every three years.
(2) The staff of scientific, research and development institutes having a higher education, in the course of teaching, have passed examinations on electrical engineering, electronics or physics, or have passed the final examination on electrical engineering or nuclear physics at a secondary vocational school and who carry out experimental work at defined scientific, research or development centres, shall be considered to be workers for a separate activity if they have passed the examination after training to the extent provided for in Section 14 (1). Their knowledge shall be verified at least every three years.
(3) Teachers who use on-line electrical equipment in school education are considered to be workers for this activity for a separate activity; However, they shall be shown to be trained in the use of the equipment and their knowledge of the safety regulations related to their activities shall be verified by a check at least every three years.
(4) The examination or examination of the staff referred to in paragraphs 1 to 3 shall be carried out by a three-member examination panel, at least one member of which shall have one of the qualifications referred to in paragraphs 7 to 9. The Commission shall draw up an minutes thereof, signed by its members. The Commission shall be established by the Head of Organisation.

Common provisions
§ 12
Obligations of the organisation
(1) Organisations are required to ensure a continuous increase in the professional level of the personnel referred to in this Decree, the continuous addition of their knowledge in accordance with the latest knowledge of science and technology, in particular in the field of rules on safety of work and technical equipment, including technical standards related to their activities.
(2) The organisation may entrust activities, management of activities, separate design or design management and the implementation of revisions only to personnel with adequate qualifications within the meaning of this Decree.
(3) An organisation which entrusts not more than two personnel of activities requiring qualifications at least under § 5 must ensure that at least one of them is qualified under § 6.
(4) An organisation which entrusts more than two personnel to activities requiring at least a qualification under § 5 must ensure that at least one of them is qualified under § 7. For the management of all staff with qualifications of at least Article 5, the organisation shall appoint a manager and, where appropriate, his representative. These staff must be qualified in accordance with Section 8.
(5) The design organisation shall designate a worker responsible for the management of the design and, where appropriate, its representative. These staff must be qualified in accordance with Section 10.
(6) The organisation must ensure that apprenticeship electrical disciplines and trained workers carry out on electrical equipment only such activities as are consistent with their gradually acquired expertise, and always under the guidance of a designated worker with qualifications appropriate to the nature of the activity.
§ 13
Calculation of period of experience
(1) Pending the period of experience required for the acquisition of one of the qualifications referred to in paragraphs 6 to 9, the period of installation, maintenance or other operational practice shall be counted on the electrical equipment of the relevant type and voltage. 8)
(2) The period of experience obtained during the technical inspection or the revision of electrical equipment shall also be taken into account until the period of experience required for the acquisition of one of the qualifications referred to in paragraphs 7 to 9.
(3) Until the period of experience required for the acquisition of one of the qualifications referred to in paragraphs 7 and 8, the period of experience acquired in the design of electrical equipment shall also be taken into account if it is supplemented by the practice referred to in paragraph 1 for at least one year.
(4) The period of experience required for the acquisition of the qualification referred to in Section 9 shall also be counted against half the period of experience acquired in the design of electrical equipment, when supplemented by the practice referred to in paragraph 1 for at least one year.
(5) The period of practice referred to in paragraphs 1 to 4, obtained before the five-year interruption, is only half of the total period of experience.
§ 14
Tests and checks
(1) The subjects of the tests and tests are:
(a) rules to ensure safety and health at work, (9) which relate to the operation on the electrical equipment of the species concerned and to the voltage to be exercised by the tested worker and, where appropriate, to the management;
(b) local working and technological procedures, operational and safety instructions, instructions, directives and operating instructions related to the operation on the electrical equipment of the species concerned and the voltage to be exercised and, where appropriate, managed by the worker;
(c) theoretical and practical knowledge of the provision of first aid, in particular in electrical accidents.
(2) The organisation shall invite a representative of the Revolutionary Trade Union Movement, who shall have the approval of a member of the Examination Committee in the tests or examinations provided for in Sections 6 to 8, 10 and 11, to be tested or checked.
(3) The result of the tests or checks shall be evaluated by two stages of the marks (passed or failed).
(4) In the absence of a satisfactory result, the tests or examinations of the personnel may be repeated at the dates of the designated organisations. Pending successful completion of the tests or examinations, such personnel may be entrusted only with activities which correspond to their knowledge demonstrated during the test or examination.
(5) When changing the worker's employment relationship, the organisation shall decide on the extent of his examination and, where appropriate, confirm the validity of the existing certificate.
(6) Workers who suspend their activities for more than three years must be re-tested in full.
(7) If the organisation cannot entrust its worker to perform the test or check, or to establish its own test committee, it shall ensure that the test or check is carried out by the worker or test committee of another organisation.
§ 15
Certification
(1) The organisation shall issue to the staff referred to in Sections 6 to 8 and 10 who have passed the examination a certificate, a specimen of which is given in Annex 3.
(2) The personnel referred to in Section 9 shall be certified by the competent supervisory authority, indicating the type and voltage of the electrical equipment and the class of the building. 10)
(3) The organisation is required to keep records of certificates issued accessible to the competent supervisory authorities.
(4) A staff member certified must submit them on request to the competent supervisory authorities.

IV. oddíl

Transitional and final provisions
§ 16
(1) Workers certified for the management of partial assembly and maintenance work on electrical equipment under Decree No 95 / 1961 Coll., shall be regarded as having the qualifications referred to in § 7, unless the management activity has ceased for more than two years.
(2) Workers certified to manage a comprehensive assembly or maintenance activity under the Decree referred to in paragraph 1 in organisations operating on electrical equipment in a supplier manner shall be regarded as having the qualifications referred to in Section 8, unless the management activity has been interrupted for more than two years.
(3) Workers certified to manage partial assembly and maintenance work on electrical equipment pursuant to the Decree referred to in paragraph 1 who have been entrusted with an organisation within the meaning of Article 4 (1) of that Decree as personnel responsible for carrying out such work shall be considered to have been qualified as such in Article 8, unless they have ceased this activity for more than two years.
(4) The organisation shall ensure that the personnel referred to in paragraphs 1 to 3 are re-examined and certified at the latest three years after the date of their examination or the last examination.
§ 17
(1) Certificates to carry out the revisions of electrical equipment issued before 1 January 1979 shall be valid until 30 June 1983.
(2) The organisations are required to submit an application for a new certificate for their workers by 31 December 1982 at the latest.
(3) The worker is enrolled for the examination of the organisation (Section 9) with which he is engaged.
(4) Certificates issued before 1 January 1979 by the authorities of the State Mining Administration shall remain valid if the authorised personnel have undergone checks before the competent authority of the State Mining Administration before 30 June 1983.
§ 18
Exemptions from the training and experience requirements of this decree may be authorised by the competent supervisory authority, at the request of the organisation and, where appropriate, at the request of the competent central authority or authority, in particular justified cases.
§ 19
Decree No. 95 / 1961 Coll., on the conditions of competence for the implementation and management of electrical equipment, lightning ducts and antennas is hereby repealed.
§ 20
This Decree shall take effect on 1 January 1979.

12) At least half of the overall experience must be completed for electrical equipment for which the highest professional qualification is required to carry out revisions. If this half is longer than two years, it's enough for two years.
