DECLARATION
of 1 March 2022
amending Decree No. 104 / 1997 Coll., implementing the Road Law, as amended
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll., Act No. 64 / 2014 Coll., Act No. 268 / 2015 Coll., Act No. 225 / 2017 Coll., Act No. 193 / 2018 Coll., Act No. 227 / 2019 Coll., and Act No. 284 / 2021 Coll., for the implementation of § 38b. 5 and § No. 38d. 4 Act:
Decree No. 104 / 1997 Coll., implementing the Road Law No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll., Decree No. 367 / 2001 Coll., Decree No. 555 / 2002 Coll., Decree No. 490 / 2005 Coll., Decree No. 527 / 2006 Coll., Decree No. 317 / 2011 Coll., Decree No. 288 / 2012 Coll., Decree No. 26 / 2014 Coll., Decree No. 9 / 2015 Coll., Decree No. 338 / 2015 Coll. and Decree No. 208 / 2018 Coll., is amended as follows:
1. In the heading above the title of Section 51a, "(K § 38b (6) of the Act) 'is replaced by" (K § 38b (5) of the Act'.
2. The heading of Section 51a reads:
"Scope and method of carrying out low-speed control weighing '.
3. In Section 51a, the following paragraph 1 is added:
"(1) A low-speed inspection may be carried out
(a) the mass of the vehicle or combination;
(b) the weight ratio of the vehicles in the combination;
(c) distribution of mass on axles or groups of axles;
(d) dimensions of the vehicle and combination of vehicles, including cargo;
(e) compliance with the compatibility conditions of the vehicles in the combination. ';
The current text becomes paragraph 2.
4. in Article 51b (1) (c), including footnote 10:
"(c) data on the maximum permissible mass of the vehicle, the maximum permissible mass of the axle and the group of axles of the vehicle and the maximum authorised dimensions of the vehicle and its load resulting from the special legislature10);
10) Decree No. 209 / 2018 Coll., on the masses, dimensions and continuity of vehicles. '
5. in Article 51b (1), the following point (d) is inserted after point (c):
"(d) data on the maximum technically permissible mass of the vehicle and combination and, if available, data on the maximum technically permissible mass per axle;"
Points (d) to (p) shall be renumbered as points (e) to (q).
6. in Article 51b (1) (e), the words "and the immediate mass of the vehicle" shall be replaced by the words "the immediate mass of the vehicle and the combination of vehicles and the immediate dimensions of the vehicle and its load,";
7. in Article 51b (1), the following point (h) is inserted after point (g):
"(h) the result of checking the mass ratio of vehicles in the combination and compliance with the compatibility conditions of vehicles in the combination,"
Points (h) to (q) shall be renumbered as points (i) to (r).
8. in Article 51b (1) (n), the words "and signature" shall be inserted after the words "surname."
9. In Section 51b, the following paragraph 2 is added:
"(2) The document shall not contain the data referred to in paragraph 1 which have not been collected by a low-speed inspection weighing. ';
Paragraph 2 shall become paragraph 3.
10. In the heading above the designation § 51c, the words "(K § 38d (5) of the Act) 'are replaced by the words" (K § 38d (4) of the Act'.
11. The heading of § 51c reads:
"Scope and method of carrying out high-speed control weighing and the need for proof of the result of high-speed control weighing '.
12. in Article 51c, the following paragraphs 1 and 2 are inserted:
"(1) A high-speed inspection shall be carried out
(a) the mass of the vehicle or combination;
(b) distribution of mass on axles or groups of axles.
(2) High-speed control weighing shall be carried out by non-portable high-speed weights located on the road at a place that is technically suitable for this. When performing a high-speed control balance, the driver of the vehicle or combination shall cross this point and a visual recording containing at least a front and rear view of the vehicle or combination and a plate bearing the registration mark shall be taken on the high-speed weighing. High-speed control weighing may not be carried out in continuous mode. ';
Paragraphs 1 and 2 shall be renumbered paragraphs 3 and 4.
13. in Article 51c (3) (c):
"(c) data on the maximum permissible mass of the vehicle and the maximum permissible mass of the vehicle and group of axles resulting from the special legislature10), ';
14. in Article 51c (3) (j), the words "authorised person of the owner of the infrastructure or of the authorised person or region, where the weighing or the authorised person" shall be replaced by the words "person who issued the document."
15. in Article 51c (3) (k), the words "and time" shall be deleted;
16. in Paragraph 51d (1):
"(1) The weighing note shall contain:
(a) the information referred to in § 51c (3) (a) to (e), (g) and (i);
(b) details of the vehicle or towing vehicle registration plate, the distinguishing mark of the country of registration of the towing vehicle, the trailer registration plate and the distinguishing mark of the country of registration of the trailer,
(c) an indication of the name and, where appropriate, the names and surnames of the person who issued the weighting note; and
(d) an indication of the date and time of drawing up of the notice. ';
17. Annex 10 shall read:
"Annex No 10 to Decree No 104 / 1997 Coll.
1. Model of the document of low speed control weighing Proof of the result of low speed control weighing
2. Model of the document of high speed control weighing Proof of the result of high speed control weighing
3. Model of the Serious List of High Speed Control Weights
"
Efficacy
This Decree shall take effect on 1 April 2022.
