DECLARATION
of 12 August 2004
amending Decree No. 471 / 2000 Coll., implementing certain provisions of Act No. 154 / 2000 Coll., on the Breeding, Breeding and Registration of Animals and amending certain related acts (Breeding Act), as amended by Decree No. 326 / 2003 Coll.
The Ministry of Agriculture provides, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll., ("the Act '), for the implementation of Sections 5 (1), 7 and 8 of the Act:
Decree No. 471 / 2000 Coll., implementing certain provisions of Act No. 154 / 2000 Coll., on Breeding, Breeding and Registration of Animals and amending certain related laws (Breeding Act), as amended by Decree No. 326 / 2003 Coll., is hereby amended as follows:
1. in Article 2 (2), the following point (b) is inserted after point (a):
"(b) a written declaration of non-discriminatory access to its members;"
Points (b) to (e) shall be renumbered (c) to (f).
2. In Article 13, the following paragraphs 3 and 4 are inserted after paragraph 2, including footnote 6a:
"(3) Where testing and assessment of horses in classical horse racing disciplines, racing, breeding shows or breeding shows (hereinafter referred to as" competition ') is carried out, there shall be no discrimination in accordance with the rules of horse racing, the racing rules or other competition rules (6a) of horses registered in other Member States of the European Union or originating in other Member States of the European Union, in particular by the criteria for admission to competition, testing and assessment of horses during competitions, monetary winnings or other profits which may result from competitions. This provision shall not apply to competitions organised for testing the characteristics of horses entered in a breeding book, regional breeding competitions or traditional or historical competitions.
(4) The share of the money prize or other gain resulting from competitions intended to maintain, develop or improve horse breeding shall not exceed 20%.
(6a) Council Directive 90 / 428 / EEC of 26 June 1990 on trade in equidae intended for competitions and the conditions for their participation in competitions. "
Paragraphs 3 to 7 shall be renumbered paragraphs 5 to 9.
3. In Paragraph 13 (6), the first sentence reads: "The recognised breeders' associations and beneficiaries shall keep records of the results of the testing and assessment of mare and stallion, including the list 6b) of the competitions referred to in paragraph 3 of the last sentence by 31 January of the following calendar year at the latest to the person responsible for the central register. '
footnote 6b reads:
"(6b) Commission Decision 92 / 216 / EEC of 26 March 1992 on the collection of data relating to competition between equidae pursuant to Article 4 (2) of Council Directive 90 / 428 / EEC."
4. In Paragraph 13 (8), the words "in accordance with paragraph 2 (c) 'shall be added at the end of the second sentence.
5. in Article 30 (3), point (c) shall be deleted;
6. In Annex No 2, Part I. Breeding of bovine animals of the dairy breed and of the combined type A. Testing and assessment of the performance characteristics I. Dairy performance in point (a) of variant A4 of point 1, the words "between 24 and 36 days' are replaced by the words" between 22 and 37 days'.
7. In Annex No 2, Part I. Breeding of bovine animals of dairy breed and combined type A. Testing and assessment of utility characteristics IV. The growth rate in paragraph Main principles of the self-performance test in point (e) shall be "; in the case of free housing, fixation is ensured when feeding compound feedingstuffs, or the dosing of feed by means of feeding boxes using microchips in collars'.
8. In Annex No 2, Part I. Breeding of bovine animals of milk and combined type A. Testing and assessment of the performance characteristics of V. Meat performance of combined type breeds is deleted from point (b) of paragraph Main principles for testing meat performance.
Points (c) to (f) shall be renumbered (b) to (e).
9. In Annex No 2, Part I. Breeding of bovine animals B. Description and assessment of the exterior I. Linear description and evaluation of the exterior of cows in paragraph (b), the words "30 - 300 days" shall be replaced by the words "for the purposes of checks on inheritance within 30 - 210 days."
10. In Annex No 2, Part I. Breeding of bovine animals of the dairy breed and of the combined type B. Description and evaluation of the external I. Linear description and evaluation of the external cows in paragraph Linear description in point (b) of the word "; minimum range of characteristics according to the breeds evaluated is given in Table 1 'is deleted.
11. in Annex No 2, Part I. Breeding of bovine animals of milk breed and combined type B. Description and evaluation of the exterior I. Linear description and evaluation of the outside of cows, Table 1 is deleted.
12. In Annex No 2, Part I. Breeding of bovine animals of the breed of milk and combined type B. Description and evaluation of the external part I. Linear description and evaluation of the external part of cows, the sentence "For the purposes of the control of inheritance, the body dimensions of cows shall be determined according to Table 4." is replaced by the sentence "For the purposes of the control of inheritance, the height of cows shall be determined in the cross."
13. In Annex No 2, Part I. Breeding of bovine animals of milk breed and combined type B. Description and evaluation of external I. Linear description and evaluation of external cows, Table 4 is deleted.
14. In Annex No 2, Part I. Breeding of bovine animals of milk breed and combined type B. Description and evaluation of exterior II. The linear description and evaluation of the exterior of breeding bulls shall be deleted from point (b) of paragraph Evaluation.
Point (c) shall be renumbered (b).
15. in Annex No 2, Part I. Breeding of bovine animals of milk breed and combined type B. Description and evaluation of exterior II. The linear description and evaluation of the exterior of breeding bulls shall be in paragraph Linear description of the sentence "It shall be carried out for the characters listed in Table 1 and adjusted in accordance with the amendments supplemented and declared by the recognised breeding association, at least between 3 and 4 years of age of the bull '.
16. In Annex No 2, Part I. Breeding of bovine animals of milk breed and combined type B. Description and evaluation of exterior II. For the purposes of the linear description and assessment of the exterior of breeding bulls, point (b) shall be deleted from the paragraph "when carrying out a linear description of the exterior between 3 and 4 years of age of the bull '.
Point (c) shall be renumbered (b).
17. In Annex No 2, Part I. Breeding of bovine animals of the dairy breed and of the combined type B. The description and evaluation of the exterior is shown in Table 2:

Efficacy
This Decree shall take effect on 1 September 2004.
