GOVERNMENT REGULATION
of 22 December 2017
amending Government Regulation No. 172 / 2016 Coll., on the establishment of thresholds and amounts for the purposes of the Public Procurement Act
The Government orders pursuant to § 18 (3) and § 25 of Act No. 134 / 2016 Coll., on Public Procurement:
Government Regulation No. 172 / 2016 Coll., on the setting of thresholds and amounts for the purposes of the Public Procurement Act, is amended as follows:
1. In footnote 1, the fifth and sixth sentences are replaced by "Communication from the Commission - Corresponding values of the thresholds under Directives 2014 / 23 / EU, 2014 / 24 / EU, 2014 / 25 / EU and 2009 / 81 / EC of the European Parliament and of the Council. ';
2. footnote 2 shall read:
"(2) Commission Delegated Regulation (EU) 2017 / 2365 of 18 December 2017 amending Directive 2014 / 24 / EU of the European Parliament and of the Council as regards the thresholds for the use of public procurement procedures. Commission Delegated Regulation (EU) 2017 / 2364 of 18 December 2017 amending Directive 2014 / 25 / EU of the European Parliament and of the Council as regards the thresholds for the use of public procurement procedures. Commission Delegated Regulation (EU) 2017 / 2366 of 18 December 2017 amending Directive 2014 / 23 / EU of the European Parliament and of the Council as regards the thresholds for the use of public procurement procedures. Commission Regulation (EU) 2017 / 2367 of 18 December 2017 amending Directive 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds used in public procurement procedures. ';
3. In § 2 (1) (a) and § 3 (1) (a), "3 686 000 CZK" is replaced by "3 873 000 CZK."
4. In § 2 (1) (b) and § 3 (1) (b), "5 706 000 CZK" is replaced by "5 944 000 CZK."
5. In § 2 (2) and § 3 (2), the amount "11 413,000 CZK" is replaced by "11 915 000 CZK."
6. In § 3 (3) and § 4, the amount "142 668 000 CZK" is replaced by "149 224 000 CZK."
7. Paragraph 3 (4) reads as follows:
"(4) The financial limit for determining the above-limit public service contract, for which more than 50% of the expected value constitutes social and other specific services as referred to in Annex 4 to the Act, is CZK 20 172 000, with the exception of:
(a) sectoral public service contracts for which the amount is CZK 26,897 000,
(b) concessions for services of CZK 149 224 000. ';
8. In § 5 (a), "CZK 2 184 000" is replaced by "CZK 2 151 000."
9. In § 5 (b), the amount of "27 305 000 CZK" is replaced by "26 897 000 CZK."
Efficacy
This Regulation shall enter into force on 1 January 2018.
