amending Act No. 191 / 2020 Coll., on certain measures to mitigate the effects of the Coronavirus SARS CoV-2 epidemic on persons involved in legal proceedings, damaged, victims of criminal offences and legal persons and amending the Insolvency Act and the Civil Code, and Act No. 182 / 2006 Coll., on bankruptcy and methods of resolution (insolvency law), as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on certain measures to mitigate the effects of the Coronavirus SARS CoV-2 epidemic on persons involved in legal proceedings, damaged persons, victims of crimes and legal persons
Act No. 191 / 2020 Coll., on certain measures to mitigate the effects of the Coronavirus SARS CoV-2 epidemic on persons involved in legal proceedings, injured persons, victims of criminal offences and legal persons and amending the Insolvency Act and the Civil Code, is amended as follows:
1. In Article 12 (2), "31 December 2020 'is replaced by" 30 June 2021';
2. In Section 14, at the end of paragraph 3, the words "or any other measure taken by the Czech Republic by 30 June 2021 in response to the spread of COVID-19 disease caused by the new Coronavirus SARS CoV-2 'are added.
3. In Article 23 (1), "30 June 2020 'is replaced by" 31 January 2021';
4. In Article 24 (1), "30 June 2020 'is replaced by" 31 January 2021';
5. In Article 27 (1), "31 December 2020 'is replaced by" 28 February 2021';
Transitional provision
Article 23 and 24 of Act No. 191 / 2020 Coll., as effective from the date of the entry into force of this Act, shall not apply if the case was granted before the date of entry into force of this Act.
Amendment of insolvency law

1. In Section 127a (1), "31 August 2020 'is replaced by" 30 June 2021' and "12 March 2020 'is replaced by" 5 October 2020'.
2. in Article 127a (2) (e) (2), "12 March 2020" shall be replaced by "5 October 2020";
3. In Article 127a (3), the words "or an extraordinary moratorium" shall be inserted after the word "proposal."
4. In Section 127a, at the end of paragraph 8, the sentence "The consent of creditors to extend an exceptional moratorium according to the first sentence shall not be required if the debtor has submitted a proposal for an extraordinary moratorium by 31 August 2020. '
5. In Article 418 (7), the second sentence is replaced by the following: "It shall do so after the proceedings ordered by the insolvency court, if the insolvency administrator or creditor so proposes or the debtor persists. The debtor shall not stay in the hearing unless, despite an appeal from the insolvency court, he has expressed his views within 10 days of the date on which it was delivered to him. The insolvency court shall bring the debtor, the insolvency administrator, the creditor committee and the creditor who has proposed the cancellation of the debt. '
EFFECTIVE
This Act shall take effect on the day of its publication.
