amending Decree No 231 / 2004 Coll., laying down the detailed content of the safety data sheet for hazardous chemical and chemical preparation
The Ministry of Industry and Trade provides pursuant to § 23 paragraph 9 of Act No. 356 / 2003 Coll., on Chemicals and Chemicals and on the amendment of certain laws, as amended by Act No. 345 / 2005 Coll.:
Decree No 231 / 2004 Coll., laying down the detailed content of the safety data sheet for a hazardous chemical and chemical preparation, is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
The detailed content of the safety data sheet (1) to the hazardous chemical (hereinafter referred to as the substance) and the chemical preparation (hereinafter referred to as the preparation) is set out in the Annex to this Decree.
1) Paragraph 23 (1) of Act No. 356 / 2003 Coll., on Chemicals and Chemicals and on the Amendment of Certain Acts, as amended by Act No. 345 / 2005 Coll. Article 27 of Council Directive of 27 June 1967 on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances (67 / 548 / EEC), as last amended by Commission Directive 2004 / 73 / EC of 29 April 2004 adapting for the 29th time to technical progress Council Directive 67 / 548 / EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances. Article 14 of Directive 1999 / 45 / EC of the European Parliament and of the Council of 31 May 1999 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the classification, packaging and labelling of dangerous preparations, as last amended by Regulation (EC) No 1882 / 2003 of the European Parliament and of the Council of 29 September 2003 adapting Council Decision 1999 / 468 / EC to the provisions relating to committees assisting the Commission in the exercise of its implementing powers provided for in the measures adopted in accordance with the procedure laid down in Article 251 of the EC Treaty. Commission Directive of 5 March 1991 defining and laying down details of a system of specific information for dangerous preparations (91 / 155 / EEC) for the implementation of Article 10 of Directive 88 / 379 / EEC, as last amended by Commission Directive 2001 / 58 / EC of 27 July 2001 amending for the second time Directive 91 / 155 / EEC defining and laying down details of a system of specific information for dangerous preparations pursuant to Article 14 of Directive 1999 / 45 / EC of the European Parliament and of the Council and for dangerous substances pursuant to Article 27 of Council Directive 67 / 548 / EEC (safety data sheets). '
(2) Paragraph 2, including footnote 3, is deleted.
3. In point 1 of the Annex, "manufacturer or importer 'is replaced by" manufacturer, importer, first distributor or distributor'.
4. Point 1.3 of the Annex reads as follows:
"1.3. The identification of the manufacturer, importer, first distributor or distributor U of the manufacturer, importer, first distributor or distributor shall be given by the name or, where appropriate, the name, surname, business name, place of business and telephone number, if any, the natural person authorised to do business, or the name or business name, legal form, registered office and telephone number, if applicable, if the person is legal. In the case of a substance or preparation transported within the territory of the Czech Republic from another Member State of the European Communities, the first distributor shall provide the identification details of his person and the manufacturer, importer or distributor established in the territory of another Member State of the European Communities (Section 23 (2) of the Act). '
5. In point 16 of the Annex, "producer or importer 'is replaced by" producer, importer or first distributor'.
Efficacy
This decree shall take effect on the day of its publication.
