THE LAW
of 26 October 2001
on the granting of a State guarantee to the Czech Republic in the event of liability for damage caused by acts of war or terrorism involving the operation of aircraft in connection with air transport operations
Parliament has decided on this law of the Czech Republic:
(1) The Czech Republic grants to an air carrier operating commercial air transport on the basis of a licence, (1) a State guarantee in the event of liability for damage to life, health or goods caused by acts of war or terrorism to third parties in connection with the operation of aircraft in the course of air transport.
(2) The State guarantee referred to in paragraph 1 shall be granted in the event of liability for damage which is not insured or which exceeds the upper limit of the insurance performance for the damage thus incurred as agreed in the insurance contract concluded by the air carrier.
(3) The State guarantee referred to in paragraphs 1 and 2 shall be granted up to a maximum of USD 500 000 000 per event, irrespective of the number of injured third parties.
(4) For the purposes of this Act, a third party shall mean a person who is not a party to a transport contract, is not in employment with a carrier or is not engaged in an activity other than an employment relationship.
This Act shall take effect on the day of its publication.
