of 27 September 2005
on the formalities and breakdown of regulatory reports, including their models and rules for drawing up regulatory reports
Pursuant to Article II (18) of Act No. 670 / 2004 Coll., amending Act No. 458 / 2000 Coll., on the Terms and Conditions of Entrepreneurship and on the Enforcement of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended, for the implementation of Article 20 (7) of Act No. 458 / 2000 Coll., on the Conditions of Business and on the Enforcement of Government Administration in the Energy Sector, and on the Amendment of Certain Laws (Energy Act No. 151 / 2002 Coll., Act No. 262 / 2002 Coll., Act No. 308 / 2002 Coll., Act No. 278 / 2003 Coll., Act No. 356 / 2003 Coll., and Act No. 670 / 2004 Coll., hereinafter "the Act ':
Breakdown and formalities of regulatory reports
(1) The regulatory reports shall be broken down into reports:
(a) assets;
(b) assets and liabilities;
(c) profit or loss;
(d) costs;
(e) the investment plan;
(f) balance sheet,
(g) technical;
(h) tariff statistics;
(i) operationally technical;
(j) technical and calculation patterns for the price of heat energy;
(k) auxiliary.
(2) The list of regulatory reports is set out in Annex 1.
(3) The regulatory statements are identified by the group number of each licensed activity. The groups per licensed activity are:
(a) group 11 - electricity generation; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 2;
(b) group 12 - electricity distribution; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 3,
(c) group 13 - electricity transmission; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 4;
(d) group 14 - electricity trade; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 5,
(e) group 15 - activities of the electricity market operator,
(f) Group 22 - gas distribution; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 6;
(g) group 23 - gas transport; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 7;
(h) group 24 - gas trade; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 8;
(i) group 25 - gas storage; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 9;
(j) group 31 - heat generation; the details and breakdowns of the regulatory reports, including their models and compilation rules, are set out in Annexes 10 and 11;
(k) Group 32 - thermal energy distribution; the details and breakdowns of the regulatory reports, including their models and compilation rules, are set out in Annexes 10 and 11;
(4) Each licence holder shall submit an annex to the regulatory reports within the scope of Annex 12.
(5) The regulatory reports shall be processed for the preceding calendar year and, where appropriate, for the part of the calendar year. Regulatory reports shall also be processed as a plan for a regulated year, where appropriate, as a plan for a regulatory period, except for licence holders of groups 11, 25, 31 and 32.
Rules for drawing up regulatory reports
(1) The compilation of regulatory reports is carried out by the licence holder for:
(a) electricity transmission for electricity transmission, trade in system and support services, auctions on cross-border profiles (hereinafter referred to as "auctions"), participation in the compensation mechanism between transmission system operators or other activities under the licence and other activities not performed under the licence under the law;
(b) distribution of electricity for distribution of electricity and other activities not carried out under a licence under the law;
(c) trade in electricity for electricity, the activity of the supplier of the last instance and other activities which are not carried out under a licence under the law;
(d) the transport of gas for the transport of gas under the transit system, the transport of gas under the national system and other activities not carried out under a licence under the law;
(e) gas distribution for gas distribution and other activities not carried out under a licence under the law;
(f) gas trade for gas trade, last resort supplier's activity and other activities which are not carried out under a licence under the law;
(g) storage of gas for the storage of gas and other activities not carried out under a licence under the law;
(h) the production of heat energy or the distribution of heat energy for the activity of the production and distribution of heat energy.
(2) The separate cost, income and asset records are kept in accordance with the Czech Accounting Standards under the Specific Legislation (1).
Assets
(1) The assets of the licence holder shall be recorded in the asset statements. The property of the licence holder group 12 shall be reported on a voltage level basis and the property of the licence holder group 22 by type of network in such a way as to objectively express the use of the assets for the voltage level or type of network.
(2) The asset statements are marked A.
(3) For the purposes of this decree, operating assets shall mean long-term assets necessary to ensure the relevant licensed activity, less:
(a) outstanding fixed assets;
(b) advances granted on long-term intangible assets;
(c) outstanding fixed assets;
(d) advances on fixed assets,
(e) the valuation difference to the assets acquired;
(f) long-term financial assets.
(4) In addition, operating assets are increased by the value of articles purchased in the form of financial leasing. The classification of the value of an object acquired in the form of financial leasing is carried out in accordance with International Accounting Standards according to the directly applicable European Communities2).
(5) The asset statements contain operating assets and other fixed assets and are reported in:
(a) the carrying amount;
(b) the accounting balance price.
Assets and liabilities accounts
(1) Statements of assets and liabilities include data on assets and other assets, liabilities and other liabilities under the special legislation1). The declaration shall be drawn up separately for licensed activities by the holder of a licence of category 31 or 32 for the production of heat energy or the distribution of heat energy and the activity of the production and distribution of heat energy, which is not carried out under a licence under the law (hereinafter referred to as "unlicensed heat energy production and distribution ') and, in aggregate, for all the activities of the licence holder.
(2) Assets and liabilities statements are identified by the letters AP.
(3) Assets and liabilities statements contain the operational assets necessary to hedge the activities referred to in paragraph 1, which are reported mutatis mutandis as operating assets pursuant to Article 4 (3) and (5).
Economic outturn accounts
(1) The statements of profit or loss shall include the proceeds and costs of the licence holder for each activity referred to in Article 2 (3).
(2) The statements of profit or loss are identified by the letters HV.
(3) For the purposes of this decree, the proceeds of the licence holder are the proceeds of the licensed activity and other revenues resulting from the licensed activity under the special Regulation (1).
(4) The authorised costs for licences of groups 12 to 14 and 22 to 25 shall mean, for the purposes of this Order, the costs of securing the licensed activity charged under the special legislature1) after deduction of the unauthorised costs.
(5) For licences of groups 12 to 14 and 22 to 25, for the purposes of this Decree, the costs which cannot be recognised as expenses (costs) to achieve, secure and maintain income under the special legislature3), financial costs, extraordinary costs, differentiated instalments of financial leasing, income tax, reserve creation and drawing costs, residual price of sold fixed assets and materials.
(6) For licences of groups 12 to 13, 22 and 23, part of the financial costs necessary to cover the licensed activity, relating to bank charges and insurance of assets and liability for damages, may be recognised on presentation of the licence holder's application.
Cost statements
(1) The cost statements contain the eligible costs of the licensed activities, broken down by type of production of electricity and heat energy, by type of fuel for the production of electricity from renewable sources, by type of activity and by type of technology for the transmission of electricity, by voltage levels and types of technology for the distribution of electricity, by type of network and by type of technology for the distribution of gas.
(2) The cost statements are identified as N.
Investment plan reports
(1) The investment plan reports shall include the investment expenditure of the licence holder and the related technical data.
(2) The report of the investment plan is indicated in point I.
Balance sheet reports
(1) The balance sheets shall show the energy balance, broken down by part of the resources and part of the consumption for the part of the electricity system for which a group 12 or 13 licence has been granted. The balance sheets shall also include the maximum power at the interface of different parts of the electricity system operated by different licence holders.
(2) The balance sheets of the licence holder group 22 or 24 shall show the balance sheet of the quantity of natural gas, the daily maximum distribution or supply of natural gas, broken down by part of the resources and part of consumption.
(3) The balance sheets are marked with the letter B.
Technical reports
(1) The following categories of data shall be reported in the technical statements of the licence holder group 12 or 13:
(a) data relating to resource support in accordance with specific legislation4);
(b) data on support and system services related to ensuring the stability of the operation of the electricity system.
(2) The following categories of data shall be reported in the technical statements of the licence holder groups 22 to 24:
(a) the quantity of natural gas purchased, transported, stored or distributed;
(b) the daily maximum supply of natural gas;
(c) data for the determination of the distribution price.
(3) The technical statements of the licence holder of a group 31 or 32 shall show the data for the relevant licensed activity and the unlicensed activity of the production and distribution of heat energy and, in aggregate, for all the activities of the licence holder. The statements shall contain the following basic data categories:
(a) the production balance;
(b) the distribution balance.
(4) The technical statements are indicated in D.
Tariff statistics reports
(1) The statements of the licence holder's tariff statistics of groups 12 and 14 shall be reported:
(a) for the collection of voltage levels of very high voltage and high voltage data on the reservation of capacity and consumption of electricity by final customers, including the sales of the licensee for the licensed activity;
(b) for low voltage voltage voltage voltage consumption data on the reserved power consumption and consumption of final customers, including the licensee's sales for the licensed activity.
(2) Data on the following shall be reported in the declaration of tariff statistics of the licence holder groups 22 and 24:
(a) quantities of natural gas sold or distributed;
(b) the maximum daily and the number of sampling points;
(c) statistics on the parameters for determining the price of natural gas energy.
(3) The statements of tariff statistics are marked T.
Operational technical reports
(1) In the operational technical statements of licence holders of groups 11 to 14, data on the operation of individual parts of the electricity system shall be reported.
(2) The following data categories shall be reported in the operational technical statements:
(a) data on individual installations, operational events and evaluation of the operation of the electricity system;
(b) data for the compilation of the electricity balance of the electricity system;
(c) data for the compilation of the performance balance.
(3) Operating technical statements shall be identified by the letters ERO, VD or VA.
Technical statement and calculation formula of heat energy price
(1) The technical report and the calculation formula for the heat energy price are completed by the licence holder in Group 31 or 32. The data for the licensed activity and for the unlicensed activity shall be reported separately for each price location.
(2) The following data categories shall be reported in the technical statement and calculation formula of the heat energy price:
(a) the production balance;
(b) the balance of the divorce;
(c) an overview of the sources at the price location;
(d) details of the home boilers;
(e) the calculation formula for the price of heat energy.
(3) Economically justified costs, intra-company revenues and revenues are given by the licensee in summary terms for the licensed activity of heat energy production and heat distribution and for the unlicensed activity of heat energy production and distribution. Economic eligible costs are defined in Annex 11.
(4) The technical statement and the calculation formula for the heat energy price are referred to as DK.
Method of submission of regulatory reports
(1) The regulatory statements shall be submitted by the licence holder at the dates set out in Annex 1.
(2) The form and presentation of the regulatory reports are set out in Annex 1.
(3) A local distribution system operator using the prices of a regional distribution system operator under a special regulatory provision (5) shall not submit the regulatory reports referred to in paragraph 1, except for those listed in Annex 3.
(4) The holder of a group 14 licence who does not perform the activities of the supplier of the last instance shall not submit the regulatory reports referred to in paragraph 1, except for those listed in Annex 5.
(5) The holder of a group 24 licence who does not carry out the last instance supplier's activities and does not supply protected customers shall not submit the regulatory reports referred to in paragraph 1, except for those listed in Annex 8.
(6) The licence holder who does not keep full accounts under the special legislature1 does not submit the regulatory statements referred to in paragraph 1, except for the licence holder group 31 or 32.
Transitional provisions
For the first time, the licence holder shall submit the regulatory reports in accordance with this 2006 Decree. The licence holder of Group 31 or 32 submits the regulatory reports under this Decree for 2005, and the holders of other licences submit the regulatory reports for 2005 in accordance with the existing legislation.
Repeal
The following shall be deleted:
1. Decree No. 439 / 2001 Coll., laying down rules on the keeping of separate records of sales, costs and revenues for regulatory purposes and rules on the allocation of costs, revenues and revenues from the injected capital in energy.
2. Decree No. 74 / 2003 Coll., amending Decree No. 439 / 2001 Coll., laying down rules for the keeping of separate records of sales, costs and revenues for regulatory purposes, and rules for the allocation of costs, revenues and revenues of the injected capital in the energy sector.
Efficacy
This Decree shall take effect on 1 January 2006.

Where the licence holder sends the regulatory statements electronically signed by the guaranteed electronic signature, the regulatory reports need no longer be sent in writing by the licence holder or by the person authorised to act as the licence holder. This option does not apply to the transmission of regulatory reports VD 1-12, VD 2-12, VA 1-12, ERÚ 1-12, ERÚ 2-01, MZ 1-12 and the statement Documentation for the preparation of EC networks of the Czech Republic.

Rules for drawing up regulatory reports for holders of electricity licence - Group 11
(A) Rules for drawing up regulatory reports for holders of an electricity licence - Group 11 with a total installed power of less than 0,5 MWe
The holder of a licence group 11 shall submit the following statements to the Authority according to the type of electricity generation source operated:
| 1. | Výkaz VD 1-12: | Čtvrtletní výkaz o výrobě elektřiny v parních a spalovacích elektrárnách se součtovým instalovaným výkonem menším než 0,5 MWe, |
| 2. | Výkaz VD 2-12: | Čtvrtletní výkaz o výrobě elektřiny ve vodních elektrárnách se součtovým instalovaným výkonem menším než 0,5 MWe, |
| 3. | Výkaz VA 1-12: | Čtvrtletní výkaz o výrobě elektřiny v elektrárnách s alternativními zdroji se součtovým instalovaným výkonem menším než 0,5 MWe. |
The model of the reports shall be published in a way that allows remote access or may be requested in writing.
The licence holder shall complete the statements in accordance with the following rules.
1. Statement VD 1-12
The declaration shall be completed by the holder of a licence of group 11 operating steam, gas and combustion plants (electricity plants).
In the statement, the licence holder shall provide details of:
- the installed power of individual generators,
- the number of production sites,
- installed, achievable and prompt power of the source,
- electricity generation and own consumption for electricity production,
- fuel consumption for electricity production.
The report shall show energy flows.
The licence holder shall submit a separate statement per establishment, unless otherwise specified. The data shall be submitted to the Authority in the quarterly reporting period broken down into each month of that quarter.
2. Statement VD 2-12
The declaration shall be completed by the licence holder of group 11 operating hydropower plants (electricity plants).
In the statement, the licence holder shall provide details of:
- the installed power of individual generators,
- the number of production sites,
- installed, achievable and prompt power of the source,
- electricity production, gross.
The report shall show energy flows.
The licence holder shall submit a separate statement per establishment, unless otherwise specified. The data shall be submitted to the Authority in the quarterly reporting period broken down into each month of that quarter.
3. Statement VA 1-12
The report shall be completed by group 11 licence holders operating power plants with alternative sources of electricity production.
In the statement, the licence holder shall provide details of:
- the installed power of individual generators,
- the number of production sites,
- installed, achievable and prompt power of the source,
- electricity generation and own consumption for electricity production,
- consumption of individual types of fuels for electricity production.
