on improving the qualification and assessment of the creative competence of scientific and technical staff
The Federal Ministry of Technical and Investment Development, in agreement with the Czechoslovak Academy of Sciences, the Federal Ministry of Labour and Social Affairs, the Ministry of Construction and Technology of the Czech Socialist Republic and the Ministry of Construction and Technology of the Slovak Socialist Republic, according to § 52 (a) (4) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries:
SCIENTIFIC WORKERS AND SCIENTIFIC QUALIFICATIONS STUFF
This decree regulates the system of obtaining and increasing the qualifications of scientific and technical staff in centrally managed research and development base organisations, universities, organisations and workplaces of research and development base within production units, or other organisations where wage and wage regulations require scientific and technical qualifications for the performance of certain functions or combine possible salary and wage consequences with them.
Scientific and technical works1) are creative workers who further develop knowledge of basic or applied research, verify their applicability under specific conditions, propose and participate in the social practice of innovative change and whose creative capacity has been verified by the award of a scientific and technical qualification degree ("degree ').
(1) The evaluation and verification of the creative competence of scientific and technical staff shall distinguish between three stages, the award of which is subject to the following conditions:
(a) for the recognition of stage III, the proven ability of the worker to apply scientific knowledge in the management of follow-up research and development tasks and to participate in the implementation of their results; eligibility for collective management of tasks is required.
(b) For the recognition of level II, the demonstrated ability of the worker alone, in a non-traditional way, to address the planned research and development tasks with the applicable result, to fully assess the results of the tasks solved, to familiarise the professional public with the results of his work and to assist the implementation of the results of research and development in social practice.
(c) To be recognised I demonstrated the ability of the worker in an original way to solve complex problems relevant to the objectives of scientific and technical policy, to manage the working groups both in the management of research and development tasks and in the implementation of them, and to increase the qualifications of entrusted staff.
(2) By admitting stage III, the basic creative competence is verified, by admitting stage II or Even more creative.
RECOGNITION AND EVALUATION OF THE QUALITY OF SCIENTIFIC TECHNICAL WORKERS
(1) The preparation for the qualification of a scientific and technical worker and the further improvement of his or her qualification is carried out in accordance with the personal development plan of the worker and is an integral part of his or her tasks.
(2) The plan for the personal development of the worker is based on current and prospective needs and tasks of the workplace, on the inclusion of the worker in the work process and on the conclusions of his periodic tests. It contains a programme of comprehensive professional growth of the worker. In particular, it sets out the objectives, tasks, time limits and method of intermediate and final control, the length of the relevant cycle of organised qualification enhancement (Section 6 (2)), as well as the practice and internships to be completed by the worker.
(3) The personal development plan of the worker is prepared by its direct supervisor and approved by the head of organisation, as instructed by the head of organisation and with the participation of the worker.
(1) Care for improving the qualifications of staff is one of the responsibilities of all managers. The results of the work on this section are assessed as their other basic tasks.
(2) Leaders shall be required to create the material technical and other conditions necessary to continuously increase the qualifications of scientific and technical staff.
(1) All forms of adult education and education may be used in universities and in corporate and non-educational education and education to improve the qualifications of scientific and technical staff.
(2) The acquisition and improvement of qualifications of scientific and technical staff is carried out in three cycles according to the degree of scientific and technical qualification to which it is directed.
(1) The basic cycle prepares staff with higher education to acquire basic creative competence. The head of the organisation selects into it personnel who have already participated in the solution of research or development tasks and have gained initial experience from the application of their results in practice. In each individual case, the head of the organisation shall designate an experienced trainer who shall assist the worker in raising his / her qualifications and shall evaluate the implementation of his / her personal development plan.
(2) In the basic cycle, the main forms of increasing qualifications are organised, comprehensive vocational training and leadership in the performance of the job. Education takes place mainly by courses, seminars, lectures, graduate studies at universities, consultations, study visits at home and abroad.
(1) In the higher cycle, staff shall be prepared to achieve a higher creative capacity, which shall correspond to scientific and technical qualification level II. The head of the organisation selects staff who have already reached stage III and have proven their qualifications for further increase in creative competence in their practice and study.
(2) In addition to the forms applied in the base cycle, experience in the performance of the entrusted function and the follow-up of independent studies shall be used in this cycle.
(3) During the higher cycle, the worker must, in particular, gain experience in independent problem solving, in cooperation with the practice of implementing innovation, defending his own results, publishing them and consulting him.
(1) In the highest cycle, staff are preparing to achieve a higher creative capacity, which corresponds to scientific and technical qualification level I. The head of the organisation shall include, on the basis of a narrow selection, personnel who have already achieved scientific and technical qualification level II. In doing so, it takes particular account of the worker's ability to manage systematically a wide range of professional themes, to lead a collective of people, to develop their skills and to mobilise them to solve challenging tasks.
(2) In this cycle, in particular, independent study and planning to impose tasks particularly demanding on the prompt and versatile application of creative capabilities shall be applied. In particular, the content of increasing qualifications is the study of people's work and the management of creative activities, the management of professional and political, economic and social development issues, and methods of managing, conceptual, prognostic, educational, advisory and similar activities.
RECOGNITION OF SCIENTIFIC QUALIFICATIONS
(1) Grade II is generally awarded to scientific and technical staff who have already acquired stage III, grade I is generally awarded to scientific and technical staff who have already been awarded grade II.
(2) The scientific and technical qualification degree may exceptionally also be awarded to a staff member with lower than university education, provided that he has demonstrated the results of his work that he has acquired knowledge at higher education level.
(1) The award of the grade of the worker shall be decided by the Ministry Attestation Board set up with the central authority of the superior organisation to which the worker is employed.
(2) A central authority may set up several ministerial committees. In that case, they shall define the headings of the organisations whose proposals they decide on and, in the cases in question, decide which of the commissions is responsible for discussing the proposal.
(3) On the basis of the agreement of the participating central authorities, a joint ministerial committee may be set up.
(1) The degree granted by the Ministry Attestation Committee is valid for all organisations whose proposals to award degrees are decided by the Ministry Attestation Committee.
(2) When transferring a scientific and technical worker to another organisation, the proposals for the award of degrees of which are decided by another ministerial attestation committee, the head of that organisation may, after a statement by the organisation's committee of inquiry, recognise the validity of the degree granted to that organisation, unless otherwise specified by the central authority of that organisation.
(1) The Ministry Attestation Board has at least nine members. Its chairman and members shall be appointed by the Head of the Central Authority with which the commission is set up, including the Chairperson, and, where appropriate, some other members of the managers of the Central Authority, the other members of the management managers and representatives of the implementation practice and of the experts of the highest qualification in the relevant fields, such as the scientific and scientific and educational staff of ČSAV, SAV and universities and research and development staff of the highest qualification. A representative of the relevant trade union body and, as a rule, a representative of the Federal Ministry for Technical and Investment Development, or of the Ministry of Construction and Technology of the Republic, is a member of the ministerial committee. The President of the Commission may invite other experts who participate with an advisory vote or request opinions from other experts or institutions.
(2) The appointment of a member of the ministerial committee shall require the consent of the organisation (body) of which the person to be appointed is a worker.
(3) The head of the central body with which the ministerial meeting committee is set up will determine how administrative work related to the work of the commission is to be carried out, in particular by keeping records of decisions.
(1) The proposal for a decision of the Ministerial Attestation Commission is submitted to the Commission by the head of the organisation to which the worker is employed.
(2) Where an organisation which is not directly managed by a central authority is concerned, proposals shall be submitted by its head through an authority which, in the field of competence of that central authority, fulfils the function of central management.
(3) The body referred to in paragraph 2 shall direct the drawing up of proposals for the ministerial attestation committee in subordinate organisations, assess such proposals in both material and formal terms and return them to the subordinate organisation, where appropriate, for completion. When submitting the proposal to the ministerial accreditation committee, it shall give its opinion on it.
(4) Where the content of the proposal referred to in paragraph 1 does not correspond to the proposed scientific and technical qualification step, the authority referred to in paragraph 2 may reject the proposal or reduce the proposed scientific and technical qualification step when submitting the proposal to the ministerial certification committee.
(5) The head of the organisation submitting a proposal for a decision by the Ministry of Attestation will ensure prior discussion of the proposal in the bodies of the social organisations and in the association committee.
(6) Proposals for the award of grade by the head of organisations directly managed by the central authority and the chairmen of the test committees of such organisations shall be submitted to the ministerial meeting committee by an authorised representative (s) of the head of the central authority concerned. The preparation of proposals for the award of a scientific and technical qualification degree by management organisations which are not directly subject to a central authority and the chairpersons of the test committees of such organisations shall be provided by the body referred to in paragraph 2 and submitted to the ministerial accreditation committee.
(1) The ministerial committee is capable of a quorum if an absolute majority of the members are present. The proposal shall be adopted if the majority of the members present votes for it, but at least four. The vote is public. Minutes shall be taken of the proceedings of the Commission.
(2) The Ministerial Attestation Committee is entitled to require the appellant to further supplement the supporting documents necessary for an objective decision. In its decision, the Ministry Attestation Committee shall either admit the proposed scientific and technical qualification degree or admit a lower degree or reject the proposal.
(3) Within 30 days of the meeting of the Commission at which it has taken its decision, the committee responsible shall communicate its decision to the appellant. The negative decision shall be justified. The appellant may, within two months of service of the decision, submit a breakdown to the ministerial attestation committee against the negative decision. If the head of the organisation submits a breakdown, it shall be discussed in the organisation's certification committee.
(4) If a proposal to award a scientific and technical qualification degree has been rejected, a further proposal, justified by the new facts, may be submitted no earlier than one year after the decision on the previous proposal.
(5) The head of the organisation shall notify the decision in writing of the Ministry Attestation Committee to the worker within 15 days of receipt of the decision. The records of decisions of the Ministry Attestation Commission are based on the personal files of the worker.
PERIODIC EVALUATION OF THE DEVELOPMENT OF HIGH ELIGIBILITY (PERIODIC ATESTATION) OF SCIENTIFIC TECHNICAL WORKERS
(1) The periodical procedure shall evaluate the results of the scientific and technical staff and the implementation of its personal development plan over the past period. This period is the longest four years.
(2) The conclusions of the periodic attestation are the nature of the recommendation for the management organisation.
(1) Periodic attestations of scientific and technical staff shall be carried out by the testing committees set up in the organisations referred to in Section 1 (the testing committee of the organisation). If the size of the organisation or the thematic fragmentation of its research or development activity so requires, several test committees may be set up. For organisations directly managed by a central authority, the central authority shall approve the composition of the certification committee, and for other organisations the central management function. The Association Attestation Committee also refers to proposals submitted by the Head of Organisation to the Ministry of Attestation.
(2) The Chairman of the Commission shall be the head of the organisation or any other manager of the organisation appointed by it. The Head of Organisation shall appoint at least four other members of the Commission, of which at least one member of the experts active in the field of research or development centres and in the field of implementation practice, with the agreement of their managers. The other members of the Commission are representatives of social organisations at the workplace, appointed on their proposal.
(3) For the evaluation of individual staff, the chairman of the Commission may invite other experts who participate with an advisory vote or request written opinions from him.
(4) The head of the evaluated staff appointed by the head of the organisation shall prepare the necessary documents with draft conclusions in accordance with his instructions for the deliberations of the commission and shall participate in the meetings of the committee without the right to vote. The evaluated staff member shall attach an opinion on the draft conclusions.
(1) The Association Attestation Committee is capable of a quorum if an absolute majority of the members are present. The proposal shall be adopted if the majority of members present votes for it, but at least three. The vote is public. Minutes shall be taken of the proceedings of the Commission. Within 15 days, the senior officer shall notify him in writing of the conclusions of the periodic attestation.
(2) Periodic attestations of the management organisations and the chairmen of the management committees of the organisations shall be carried out by the ministerial committee on the basis of supporting documents prepared by the staff responsible by the central authority. for management organisations which are not directly subject to a central authority, and for the chairmen of the certification committees of such organisations, the staff responsible for the authority performing the function of central management shall prepare these documents. The conclusions of these attestations shall be communicated in writing by the ministerial committee, which shall be evaluated within 30 days. Where the head or chairman of the committee of inquiry is an organisation which is not directly subject to the central body, the committee of inquiry shall make such notification through the authority which plays the role of the central section of the proceedings.
(3) The plan of periodic tests is part of the organisation's cadre work plan.
(1) An assessment of the development of the worker's creative capacity on the basis of an evaluation of the results of his work and the implementation of his personal development plan and an opinion on the existing scientific and technical qualification stage of the worker is a binding content of the conclusions of the organisation's Committee on Attestations.
(2) Records of the conclusions of periodic tests are incorporated into the personnel files.
TRANSITIONAL AND FINAL PROVISIONS
The evaluation of staff and the preparation of proposals for the award of a scientific and technical qualification degree shall be based on the principles set out in the Annex to this Order.
(1) The Ministerial Attestation Commission set up pursuant to § 11 of Decree No. 32 / 1976 Coll. performs the function of the Ministerial Attestation Committees pursuant to § 11 of this Order, and the Attestation Commission established under § 16 of the quoted Decree performs the function of the Association Attestation Committees pursuant to § 17 of this Order.
(2) The scientific and technical qualification stages awarded and the measures taken pursuant to Decree No 32 / 1976 Coll. are the scientific and technical qualification stages awarded and the measures taken under that decree.
Decree No. 32 / 1976 Coll., on Scientific and Technical Workers in Centrally Controlled Organisations of Research and Development Base, is hereby repealed.
This Decree shall take effect on 1 August 1977.

PRINCIPLES
for evaluation of staff in proposals for the award of scientific and technical qualification grades
A. Presumption and components of the creative competence of scientific and technical staff
(1) The competence of a scientific and technical worker is based on theoretical knowledge, professional skills and experience.
(2) Theoretical knowledge is essentially due to undergraduate education and is further developed by the participation of a worker in a system of increasing the qualifications of scientific and technical staff.
(3) The professional skills are in particular:
(a) control of the methodology for solving research or development tasks in the field;
(b) the ability to successfully address research or development tasks, to bring new, original knowledge and to work successfully as a member of the research and development teams set up to help implement the results of research and development;
(c) the ability to evaluate the results of the solutions to research or development tasks, both in terms of the requirements for the task or the field concerned and in the wider social context;
(d) control of the methodological and organisational aspects of the process of addressing research and development tasks and the conditions for implementing their results up to the ability to manage research or development work;
(e) the ability to foresee possible conditions and problems of implementation when establishing and addressing research and development tasks and to effectively assist in the implementation of research and development results.
(4) In doing so, mutual proportions between professional skills may change, in particular following tasks falling within different stages of the research cycle, in connection with the performance of the management of research and development work, etc.
B. Results of scientific and technical staff
(1) An objective evaluation of the results of the work of a scientific and technical worker and their proven application in the proposals for the award of a scientific and technical qualification degree is a prerequisite for this, taking into account in particular:
(a) the stage of the R & D cycle in which the results have been achieved and the way the worker is involved in the division of work at the appropriate stage;
(b) the nature and importance of the personal contribution of the worker;
(c) the potential and actual social importance of the results in terms of technical economic or other benefits in the implementation and use.
(2) The results of the work to be carried out for the recognition of the scientific and technical qualification level shall be demonstrated in proposals submitted to the ministerial accreditation committees for example:
(a) submitted applications for inventions and discoveries and already granted safeguard documents for inventions and discoveries;
(b) significant technical parts or other significant implementation actions the worker has actively contributed to;
(c) successfully opposed results of addressing the tasks of state plans for the development of science and technology in which the worker was actively involved;
(d) successfully opposed results in the resolution of the tasks of the department or branch and business (constitutional) in which the worker was actively involved;
(e) significant improvements made or accepted;
(f) the results of the publication activity of the worker;
(g) works on the development of methodology or technology for the processing of information, or analyses, where appropriate, for the practical application of the results of research and development (provided that they are results in addressing the tasks of the scientific and technological development plan).
