of 3 November 2003
on animal health requirements for trade in animals and the animal health conditions governing their importation from third countries
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 8 (5), 10 (3) (e), 28 (5), 31 (3) (a) and 34 (5):
§ 1
Subject matter
(1) This decree implements the relevant provisions of the European Union1a) and provides for animal health conditions
(a) trade in animals between the Czech Republic and the Member States of the European Union (hereinafter referred to as "Member States");
(b) the importation and transit of animals from non-Member States ("third countries").
(2) This Regulation shall not apply to fish, crustaceans and molluscs, germinal products, poultry intended for exhibitions, shows or competitions, and shall be without prejudice to the legislation governing animal health requirements, its protection and protection of animals against torture, the labelling and registration of animals and their transport, the health of products of animal origin.
(3) The organisation and method of carrying out veterinary checks on animals traded or imported from third countries, as well as the measures resulting from the results of such checks, are governed by specific legislation.2)
§ 2
Definition of terms
For the purposes of this decree:
(a) trading - trade in goods originating in the Member States and in goods originating in third countries which are in free circulation in the Member States,
(b) bovine animals - animals of the species Bos including Bison bison and Bubalus bubalis,
(c) pigs - animals of the genus Sus reared or kept on the holding;
(d) bovine animals and swine for slaughter - bovine animals and swine intended for admission to a slaughterhouse or assembly centre from which they may only be moved for slaughter;
(e) breeding and productive bovine animals and swine - bovine animals and swine other than slaughter, intended for reproduction, production of products of animal origin or for work, shows and exhibitions, with the exception of animals involved in cultural and sporting events;
(f) ovine or caprine animals for slaughter - ovine or caprine animals intended either directly or through an approved assembly centre for slaughter;
(g) breeding sheep or goats - ovine and caprine animals other than those referred to in (f) and (h) intended for transport to their destination, either directly or through an approved assembly centre, for further breeding and production;
(h) fattening sheep or goats - ovine and caprine animals other than those referred to in (f) and (g) intended for transport to their destination, either directly or through an approved assembly centre, for fattening and subsequent slaughter;
(i) the holding of origin of ovine and caprine animals - any holding where ovine and caprine animals are continuously present in accordance with the requirements of this decree and where records of such animals are kept and kept (2a) which are provided on request to the authorities carrying out national veterinary surveillance;
(j) equidae - animals of the equine species (including zebras) and of the donkey, as well as hybrids of those species,
(k) registered equidae - equidae registered under specific legislation, (3) identified by means of a horse licence, (4)
(l) equidae for slaughter intended for slaughter in slaughterhouses, either directly after transport or after transit through the market or an approved assembly centre;
(m) equidae for breeding and production - equidae other than those referred to in (k) and (l),
(n) temporary entry - the status of registered equidae originating in a third country authorised to enter the territory of the European Union for a period of less than 90 days to be determined by decision of the institutions of the European Union depending on the disease situation in the country of origin,
(o) poultry - fowl, turkeys, guinea fowls, ducks, geese, quails, pigeons, pheasants, partridges, as well as runners bred or held in captivity for breeding, for the production of meat or table eggs or for the repopulation of wild game,
(p) hatching eggs - eggs from poultry referred to in (o) intended for hatching,
(q) day-old chicks - all poultry not yet fed under 72 hours; However, mussels (Cairo moschata) or its cross-breeds may be fed,
(r) breeding poultry - poultry of 72 hours or more intended for the production of hatching eggs,
(s) productive poultry - 72 hours old or older, reared for the production of meat or table eggs or for the repopulation of wild game,
(t) poultry for slaughter - poultry delivered directly to the slaughterhouse to be slaughtered there as soon as possible but in any case within 72 hours of its arrival at the slaughterhouse,
(u) other animals - animals not subject to the provisions on animal health requirements governing trade in bovine animals, swine, sheep, goats, equidae, poultry and hatching eggs and the conditions for importation of equidae, poultry, hatching eggs and ungulates listed in Annex 15 thereto,
(v) an undertaking - an establishment or part thereof located in a single place and intended for a specified activity;
(w) breeding undertaking - an undertaking whose activity consists in producing hatching eggs intended for the production of breeding poultry;
(x) breeding undertaking - an undertaking whose activity consists in producing hatching eggs intended for the production of productive poultry;
(y) breeding undertaking - breeding poultry for reproduction which consists of breeding poultry for reproduction before the reproductive stage, or production poultry for laying,
(z) hatchery - an undertaking whose activity is to store hatching eggs in the incubator, hatch them and supply day-old chicks,
(aa) establishment - an approved undertaking in which other animals of one or more species are kept, whether commercial or non-commercial, but solely for the purpose of exposure to animals and public education, the preservation of animal species, basic or applied scientific research or animal husbandry for the purpose of such research;
(bb) herd - animal or group of animals kept on the holding as an epidemiological unit. If more than one herd is kept on the holding, each of these herds shall be a separate unit having the same health status,
(cc) flock - all poultry of the same health status, kept in the same place or in the same compartment, thus forming one epidemiological unit; all birds in the same airspace shall be considered as flocks in a poultry holding;
(dd) the diseases subject to compulsory notification under this Order - the diseases listed in Annex 1 thereto,
(ee) veterinary checks - any physical control or administrative action concerning live animals intended to protect human or animal health directly or indirectly;
(ff) specific animal health guarantees - health guarantees applied by the Member States of origin and destination for each animal species on the basis of decisions taken by the institutions of the European Union.
§ 3
The methods (tests) laid down in this decree and, where appropriate, the methods (tests) for reliability shall be used for the examination of animals at least equivalent.
Veterinary requirements for bovine and porcine animals intended for trade
§ 4
Cattle and pigs may be traded if:
(a) comply with the conditions laid down in this Decree;
(b) has not been in contact with other biungulates since leaving the holding of origin until arrival at the place of destination, unless such biungulates have the same health status;
(c) come from a holding or region which is not subject to restrictive or prohibited veterinary measures, taken for animal health reasons and applicable to animals of the species concerned ("emergency veterinary measures"), 5)
(d) was not intended to be defeated;
(e) are not subject to restrictions in relation to the implementation of the animal recovery programme (6) from certain diseases;
(f) they were identified and clinically examined by an official veterinarian within 24 hours prior to dispatch and did not show any clinical signs of disease during the clinical examination (s),
(g) are marked in the manner laid down and registered (7) so that both the animal and the holding of origin can be identified at any time;
(h) are transported under the conditions laid down by law and specific legislation. 15)
§ 5
(1) Cattle and pigs covered by this order must be accompanied from dispatch to the place of destination by the original of the correct and fully completed health certificate in accordance with the model issued by the State Veterinary Administration in accordance with Article 48 (1) (k) of the Act (hereinafter referred to as the "veterinary certificate").
(2) The health certificate certifies compliance with the conditions laid down in this Decree and, where appropriate, with specific animal health guarantees. Must be
(a) displayed on the day of the clinical inspection (s) of the animal, in at least one of the official languages of the country of destination,
(b) issued on a single sheet; where this is not possible and the veterinary certificate is issued on multiple sheets, those sheets shall be suitably joined to form an indivisible whole and bear a serial number.
(3) The period of validity of the health certificate is 10 days from the date of issue.
(4) The veterinary certificate shall be issued in accordance with Section 56a of the Act by an official veterinarian on the basis of a clinical inspection (examination) of the animals and, where appropriate, on the basis of animal health data certified by an approved veterinarian of the holding of origin or a collection centre. If specific legislation so requires, 8) the official veterinarian completing the veterinary certificate shall ensure that on the date of issue of this certificate the movement of the animal is registered in the Animo system.
(5) Where an animal comes from a collection centre or from an approved holding, included in the epidemiological surveillance network (hereinafter referred to as the "surveillance network '), it may be accompanied by a document drawn up on the basis of a health certificate containing the relevant particulars, including details of compliance with the specific animal health guarantees, certified by the approved veterinarian responsible for the holding of origin or in the form of a health certificate.
(6) If the animal has passed a collection centre in the Czech Republic prior to its arrival in the Member State of destination, the official veterinarian responsible for that collection centre shall issue a new health certificate, bear the serial number of the health certificate, issued by the official veterinarian of the Member State of origin, and attach it to the original or officially certified copy of that health certificate. The validity of both certificates shall not exceed the period of validity referred to in paragraph 3.
§ 6
(1) In addition, breeding and productive bovine animals and pigs must come from a holding where they have been kept for at least 30 days prior to dispatch and go for animals less than 30 days old in which they have been reared since birth. On the basis of an identity check, the official veterinarian must verify that the animals comply with this condition and that they come from the European Union or have been imported from a third country under the conditions laid down in this Decree and in specific legislation. 9) Where animals pass through the assembly centre in the State of origin, the period of their collection outside the holding of origin shall not exceed six days.
(2) Animals imported from a third country may not be moved further after arrival at the place of destination unless they fulfil the conditions of this Order, in particular the requirement referred to in paragraph 1, and may not be included in the herd unless the official veterinarian responsible for the holding concerned confirms that such animals do not endanger the health status of the holding. Where an animal imported from a third country is placed on a holding, animals from that holding may not be traded for the next 30 days unless the imported animal has been isolated from other animals on the holding.
(3) After importation into the Czech Republic from a third country which is not the State of destination, the animals must be transported to the State of destination as quickly as possible. It shall be accompanied by a health certificate issued under specific legislation. 9)
§ 7
Breeding and productive bovine animals must also meet the following requirements:
(a) come from an officially tuberculosis-free herd (10) and, in the case of animals over six weeks of age, react negatively to intradermal tuberculin testing carried out within 30 days before leaving the herd of origin. Such tuberculinisation is not required when animals come from a State or part thereof which is officially tuberculosis-free or where a monitoring system has been established,
(b) come from an officially enzootic-bovine-leukosis-free herd, 10) and, if older than 12 months, be individually examined with a negative result by an immunodiffusion test carried out within 30 days prior to leaving the herd of origin. This test shall not be required if animals come from a Member State or part thereof which are officially enzootic-bovine-leukosis-free or where a monitoring system has been established,
(c) if uncastrated animals come from an officially brucellosis-free herd, 10) and are over 12 months of age, be tested within 30 days prior to leaving the herd of origin by an agglutination test with serum, or by a complement fixation test, a buffered brucellosis antigen method or an ELISA method; the test used must be indicated on the health certificate. This test shall not be required when animals coming from a State or part thereof which are officially brucellosis-free or where a monitoring system has been established,
(d) during the period between leaving the holding of origin and arriving at the place of destination, they must not come into contact with a bovine animal from a herd which is not officially tuberculosis-free and enzootic bovine leukosis-free and, if uncastrated animals, officially brucellosis-free.
§ 8
Moreover, bovine animals for slaughter must come from a herd which is officially tuberculosis-free and enzootic bovine leukosis-free and, if uncastrated animals, officially brucellosis-free.
§ 9
Cattle and pigs accepted after arrival in the Czech Republic
(a) in slaughterhouses, they must be slaughtered as soon as possible and no later than 72 hours after their arrival at the slaughterhouse in accordance with animal health requirements;
(b) to the assembly centre, they must be transported directly to the slaughterhouse after the market (sale) and slaughtered as soon as possible in accordance with the animal health requirements, but not later than three working days after their arrival at that centre. During the period between their arrival at the assembly centre and their arrival at the slaughterhouse, such animals shall not come into contact with biungulates other than animals meeting the animal health conditions laid down in this Decree.
§ 10
(1) Where an infringement of the provisions of this Regulation or of European Union provisions has been found, the Regional Veterinary Administration shall, in accordance with Article 49 of the Act, take appropriate measures to ensure animal health and prevent the spread of the disease provided for by the Act, consisting in particular of:
(a) the completion of the transport or return of animals to their place of dispatch by the shortest route, provided that the activity carried out in this way cannot further endanger the health or well-being of the animals;
(b) keeping the animals in suitable housing with adequate care to ensure the welfare of the animals in the event of interruption of transport;
(c) slaughter of animals; animal products derived from such animals may be:
1. assessed as edible in accordance with specific legislation, (11); or
2. assessed as inedible and processed in accordance with specific legislation. 12)
(2) The State Veterinary Administration shall immediately inform the competent authority of the Member State of origin, in accordance with Section 48 (1) (o) of the Act, of the failure to comply with the animal health conditions laid down in this Decree.
§ 11
The State Veterinary Administration shall, in accordance with Article 48 (1) (o) of the Act, inform the Commission of the European Union ("the Commission ') by 31 May of the calendar year at the latest of the occurrence of the diseases listed in Annex 1 to this Regulation to which bovine and porcine animals are susceptible and of the occurrence of diseases subject to additional guarantees from the European Union in its territory in the previous calendar year, including details of the monitoring and implementation of animal recovery programmes. The criteria for providing information shall be communicated by the Commission.
Specific animal health guarantees for trade in pigs in relation to Aujeszky's disease
§ 12
The dispatch of pigs intended for Member States or regions thereof free of Aujeszky's disease as listed in the Annex I Commission Decision laying down further guarantees concerning Aujeszky's disease in intra-Community trade in pigs and laying down criteria for the provision of information on this cassette 17), originating in other Member States or regions not listed in the Annex to this Decision, is only authorised under the conditions set out in Annex 3 to this Decision.
§ 13
Without prejudice to the provisions of Section 78 (2) of this Decree, the State Veterinary Administration shall inform the Commission of the occurrence of Aujeszky's disease, including details of the monitoring and implementation of animal health programmes, at least once a year in accordance with the uniform criteria set out in Annex 4 thereto.
§ 14
Specific animal health guarantees for trade in bovine animals concerning infectious bovine rhinotracheitis
Cattle coming from Member States or regions other than those listed in Annex II to Commission Decision implementing Council Directive 64 / 432 / EEC as regards additional guarantees for intra-Community trade in bovine animals relating to infectious bovine rhinotracheitis and the approval of eradication programmes proposed by certain Member States (18) and intended for Member States or regions listed in Annex II to this Decision shall comply with the conditions set out in Annex 6 to this Regulation.
Veterinary requirements for ovine and caprine animals intended for trade
§ 15
(1) Sheep and goats may be traded only if:
(a) comply with the conditions laid down in this Decree;
(b) are marked in the manner laid down and registered (7) so that both the animal and the holding of origin can be identified at any time;
(c) have been clinically examined by an official veterinarian within 24 hours of dispatch and showed no clinical signs of disease during the clinical examination (s);
(d) have been born or reared since birth in the territory of the European Union or have been imported from a third country appearing on the list of third countries and parts thereof from which animals may be imported into the European Union, drawn up and published by the institutions of the European Union, subject to the conditions laid down in this Decree and in specific legislation, 13)
(e) do not come from a holding and have not come into contact with animals from a holding which is subject to emergency veterinary measures, taken in view of the presence or risk of spreading of the disease to which such animals are susceptible, namely brucellosis, rabies or anthrax. These measures must last at least 42 days after the slaughter of the last sick or susceptible animal on the holding, if it is brucellosis, 30 days if it is rabies and 15 days if it is anthrax,
(f) they do not come from a holding and have not come into contact with animals from holdings which are subject to restrictions adopted in connection with the control of foot-and-mouth disease, or which must not leave the animals because they are in a protection zone defined by the presence or risk of spreading of the disease to which they are susceptible;
(g) during the period between leaving the holding of origin and arriving at the place of destination, they did not come into contact with biungulates other than animals of the same health status and did not at any time jeopardise the health status of ovine and caprine animals not intended for trade;
(h) before the last certificate for trade was issued for dispatch to the final destination in another Member State indicated in the health certificate, they have not been outside the holding of origin for more than 6 days; that period is extended by the duration of the sea voyage,
(i) after leaving the holding of origin they have been sent directly to a destination in another Member State or after leaving the holding of origin before arriving at the place of destination only one approved assembly centre situated in the Member State of origin; in the case of ovine and caprine animals for slaughter, that centre may be replaced by approved premises of a trader situated in the Member State of origin;
(j) the slaughter animals were delivered to the slaughterhouse on arrival in the Member State of destination and slaughtered there as soon as possible and no later than 72 hours after arrival in the Member State.
(2) Breeding and fattening ovine or caprine animals to be placed on a holding of ovine or caprine officially free from or free from ovine and caprine brucellosis (B. melitensis) must comply with the conditions laid down in a specific legislation. 10)
(3) In accordance with Section 48 (1) (f) of the Act, the State Veterinary Administration may authorise the movement of breeding and fattening sheep and goats, although the conditions of this decree are not fulfilled, if the movement of animals intended solely for temporary grazing is limited to the internal borders of the European Union.
§ 15a
(1) Sheep and goats for slaughter, fattening and breeding must:
(a) stay continuously on the holding of origin for at least 30 days or since birth if animals under 30 days are present;
(b) come from a holding where ovine or caprine animals have not been introduced within 21 days prior to dispatch;
(c) come from a holding to which biungulates imported from third countries have not been introduced during the 30 days prior to dispatch.
(2) The Regional Veterinary Administration may, in accordance with Article 49 (1) (g) of the Act, authorise an exemption from the requirements referred to in paragraph 1 (b) and (c) where ovine and caprine animals have been completely isolated from all other animals on the holding.
§ 15b
(1) Sheep and goats for slaughter
(a) need not comply with the requirements set out in Article 15a (1) (a) if they have remained continuously on the holding of origin for at least 21 days;
(b) need not comply with the requirements referred to in Article 15a (1) (b) if they are transported directly to slaughterhouses in another Member State for immediate slaughter without passing through the assembly centre or control post and if they meet the requirements referred to in points (a) and (h) of Article 15 (1);
(c) they need not comply with the requirements referred to in Article 15 (1) (i) if they have undergone a further journey after leaving the holding of origin and if they meet the requirements referred to in Article 15 (1) (h) and (2).
(2) In the cases referred to in paragraph 1 (c), it shall be required that:
(a) before the animals pass through the approved assembly centre referred to in Article 15 (1) (i) located in the Member State of origin, they have complied with the following requirements:
1. After leaving the holding of origin, it has passed through under the supervision of an official veterinarian who allows only animals of the same health status to be present at the same time; and
2. the animals accompanied by the animal health certificate have been transported from that journey to an approved assembly centre referred to in Article 15 (1) (i) where they must be equipped with a new health certificate and sent directly to a slaughterhouse in the Member State of destination; or
(b) after dispatch from the Member State of origin and before dispatch to the slaughterhouse to the Member State of destination, the animals may have passed through one approved assembly centre which:
1. is situated in the Member State of destination from which the animals must be dispatched under the responsibility of the official veterinarian directly to the slaughterhouse in order to be slaughtered within five days of arrival at the approved assembly centre; or
2. is situated in one Member State of transit from which the animals are dispatched directly to the slaughterhouse in the Member State of destination indicated on the health certificate issued in accordance with Article 17 (7).
§ 15c
A person who, as an entrepreneur 13b) directly or indirectly buys and sells ovine or caprine animals for profit, has a regular turnover of those animals which, within 29 days of the purchase, resales or moves from the original premises to other premises or directly to a slaughterhouse, where such other premises or slaughterhouses are not in his possession, and which have been approved and registered for that activity by the Regional Veterinary Administration in accordance with Article 49 (1) (h) and has been assigned a veterinary approval number (hereinafter referred to as "the person involved in the trade in ovine and caprine animals') shall keep records of the transactions which he has kept for at least three years in accordance with Article 5 of the Act on which he keeps the following information:
(a) the name and / or name, surname, business name or name of the breeder, the holding of origin, the date of purchase, the category, number and designation of the ovine and caprine animals or the registration number of the holding of origin of the animals purchased, or, where appropriate, the approval and registration number of the assembly centre, or the date on which the animals passed before purchase, and their intended destination;
(b) the registration number of the carrier or the registration number of the means of transport which brings and takes the animals;
(c) the name and address of the buyer and the destination of the animals;
(d) a copy of the travel plan or the serial number of the health certificates.
§ 15d
The person involved in the trade in ovine and caprine animals may use stables and other premises for these animals ("approved premises') which:
(a) have been registered for this purpose by the Regional Veterinary Administration in accordance with Article 49 (1) (h), have been assigned a veterinary approval number and are under national veterinary supervision;
(b) are situated in an area which is not subject to restrictive or prohibited veterinary measures;
(c) have:
1. suitable premises with sufficient capacity, in particular areas for testing and isolation;
2. suitable premises for the loading and unloading of animals and, if necessary, for housing, feeding, feeding and necessary treatment of animals; the premises must be clean and disinfected,
3. sufficient storage facilities for litter and manure;
4. an appropriate system for collecting waste water;
(d) are cleaned and disinfected in accordance with the instructions of the official veterinarian before use.
§ 16
Breeding sheep and goats must in addition:
(a) come from a holding and come into contact only with animals from a holding;
1. in which contagious agalactiae of the ovine species (Mycoplasma agalactiae) or contagious agalactiae of the caprine species (Mycoplasma agalactiae, M. capricolum, M. mycoides subsp. mycoides "large colonies") have not been clinically diagnosed in the previous six months, paratuberuosis or caseous lymphodenitis, and in the previous three years pulmonary adenomatosis, Maedi-Visna or viral arthritis and encephalitis of the caprine species. However, a period of three years may be reduced to a period of 12 months if animals found to be Maedi- Visna or viral arthritis and encephalitis of goats have been slaughtered and the remaining animals have been tested with negative results of two, for these cases by decision of the European Union institutions, or
2. which, in the context of a programme for the recovery of animals from one of the diseases referred to in point 1 or taking into account the recognition of the territory of a State or part thereof as being free from one of those diseases, provides specific animal health guarantees equivalent to that of the designated disease or disease,
3. in which the official veterinarian responsible for issuing the veterinary certificate does not indicate that the conditions of points 1 and 2 are not fulfilled and the breeder has expressly confirmed that he has no knowledge of any such fact and has stated in writing that the animals fulfil the conditions of points 1 and 2,
(b) as regards uncastrated breeding rams with regard to contagious epididymitis of rams (B. ovis),
1. come from a holding in which the disease has not been diagnosed in the previous 12 months,
2. be kept permanently on that holding within 60 days prior to dispatch;
3. be tested serologically in the 30 days prior to dispatch with negative result on that disease, or comply with equivalent specific animal health guarantees, as recognised by the decision of the European Union institutions,
(c) be accompanied by a health certificate.
§ 17
(1) The ovine and caprine animals covered by this Order must be accompanied from dispatch to the place of destination by the original of the correct and fully completed health certificate in accordance with the model issued by the State Veterinary Administration in accordance with Section 48 (1) (k) of the Act.
(2) The health certificate certifies compliance with the conditions laid down in this Decree and, where appropriate, with specific animal health guarantees. Must be
(a) issued on the date of veterinary inspection of the animal in at least one of the official languages of the State of destination;
(b) issued on a single sheet; where this is not possible and the veterinary certificate is issued on multiple sheets, those sheets shall be suitably joined to form an indivisible whole and bear a serial number.
(3) The period of validity of the health certificate is 10 days from the date of issue.
(4) The veterinary certificate (including specific veterinary guarantees) for the consignment of animals shall be issued by the official veterinarian in accordance with § 56a of the Act on the basis of the veterinary inspection (s) of the animals carried out on the holding of origin, assembly centre or, in the case of slaughter animals, at the approved premises of the trader. Where specific legislation so requires (8), the official veterinarian completing the veterinary certificate shall ensure that the movement of the animal is registered on the relevant computer network on the date of issue of this certificate.
(5) As regards fattening sheep and goats and breeding sheep and goats transported to another Member State from an approved assembly centre situated in the Member State of origin, the veterinary certificate shall be issued by the official veterinarian responsible for the collection centre, on the basis of veterinary checks carried out on animals imported into the centre and animal health data certified by the official veterinarian on the holding of origin.
(6) As regards ovine and caprine animals for slaughter transported to another Member State from an approved assembly centre or from an approved premises of a trader located in the Member State of origin, the veterinary certificate may be issued on the basis of veterinary checks on animals and animal health data certified by an official veterinarian on the holding of origin or an official veterinarian carrying out national veterinary surveillance on the sediments referred to in Article 15b (2) (a) (1).
(7) As regards ovine and caprine animals for slaughter transported through the approved assembly centre referred to in Article 15b (2) (b) (2), the official veterinarian responsible for the approved assembly centre in the transit Member State shall issue a new health certificate in which to complete the required data from the original animal health certificate, accompanied by a copy of that health certificate, which he shall certify by his signature. The validity of both certificates shall not exceed the period of validity referred to in paragraph 3.
§ 17a
(1) Only means of transport which:
(a) are secured against the loss or leakage of feed, litter, feces and other waste;
(b) have been cleaned and disinfected after transport and, if necessary, before transport by registered preparation 13c) or by a product authorised for marketing 13d).
(2) Carrier transporting ovine and caprine animals,
(a) ensure that it has suitable premises for cleaning and disinfection of means of transport, including premises for storage of litter and manure approved by the Regional Veterinary Administration, or provides proof to the Regional Veterinary Administration that this activity is carried out by another person authorised to carry out such activities;
(b) ensure that animals do not come into contact with animals of a lower health status between leaving the holding of origin and arriving at the place of destination;
(c) ensure that persons intended for the transport of animals have adequate knowledge and experience for this activity obtained by specific training or practice;
(d) ensure that records are kept for each vehicle used for the transport of ovine and caprine animals containing the following:
1. the date and place of loading of the animal and the details of the breeder or operator of the assembly centre (name and / or name, surname and place of permanent residence or residence 13e), if any, if any, if it is a natural person, or if it is a commercial company or the name and registered office or, where applicable, the address of the organisational body in the territory of the Czech Republic, if it is a legal person),
2. the date and place of unloading of the animal and the details of the breeder or operator of the assembly centre (name, name, surname and place of permanent residence or residence 13e), if any, if any, or business name or business name or registered office or, where applicable, the address of the organisational body in the Czech Republic, if applicable, the legal person) where the animals are unloaded,
3. the species and number of animals transported,
4. date and place of disinfection;
5. number and type of accompanying documentation;
(e) keep the documentation referred to in point (d) for at least 3 years and submit it on request to the authorities carrying out State surveillance.
§ 18
Where Member States apply a system of control providing guarantees equivalent to those provided for in Articles 15 (2) and 16 as regards the movement of ovine and caprine animals into their territory, in particular by means of an identification document, the State Veterinary Administration may, in accordance with Article 48 (1) (f) of the Act on the basis of reciprocity, grant further derogations from the provisions of Article 15 (1) (c) and from the obligation to issue veterinary certificates pursuant to Article 17. It shall inform the Commission of the exemptions granted.
Veterinary requirements for equidae intended for trade
§ 19
(1) Equidae may be traded only if:
(a) meet the conditions laid down in this Decree and other legislation, 2), 3)
(b) have been clinically examined by an official veterinarian within 48 hours prior to dispatch and showed no clinical signs of disease during the clinical examination (s);
(c) were not intended to be slaughtered or killed in connection with the implementation of the animal recovery programme (6) from a disease.
(2) Equidae shall not come from holdings for which, due to the presence or risk of spread of the disease to which equidae are susceptible, emergency veterinary measures have been ordered, provided that:
