DECLARATION
of 30 September 2009
amending Decree No. 274 / 1998 of the Ministry of Agriculture Coll., on the storage and use of fertilisers, as amended
The Ministry of Agriculture shall determine, pursuant to Sections 8 (5) and 9 (9) of Act No. 156 / 1998 Coll., on fertilisers, soil aid substances, aids and substrates and on agrochemical testing of agricultural soils (Fertilisers Act), as amended by Act No. 9 / 2009 Coll.:
Decree No. 274 / 1998 Coll., on the storage and use of fertilisers, as amended by Decree No. 476 / 2000 Coll., Decree No. 473 / 2002 Coll., Decree No. 399 / 2004 Coll. and Decree No. 91 / 2007 Coll., is amended as follows:
1. In the heading of Part One, the words "and manure 'are deleted.
2. in Paragraph 1 (2) (a), "2" is replaced by "1."
3. In Article 1, the following paragraph 4 is added:
"(4) For a transitional period prior to use, but not more than 1 month, packaged solid mineral fertilisers may also be stored on free reinforced areas provided they are placed on pallets and protected from weather effects. '
4. In Article 2 (2), the words "in one stock 'shall be added at the end of the text in point (b).
5. In Article 3, the following paragraph 3 is added:
"(3) For a transitional period prior to use, but for a maximum period of 1 month, packaged liquid mineral fertilisers may be stored on free reinforced surfaces provided that they are protected from weather effects and the maximum volume of one pack is 1000 litres. ';
6. In Article 3a, the following paragraph 4 is inserted after paragraph 3:
"(4) For a transitional period prior to use, but not more than 1 month, packaged solid or liquid organic and organo-mineral fertilisers may also be stored on free reinforced surfaces, provided they are placed on pallets and protected from weather effects. '
Paragraph 4 shall become paragraph 5.
7. In Article 3a (5), the words "as compost 'shall be inserted after the words" for purposes'.
8. In Article 4, the sentence "Solid manure shall be stored in solid manure storage structures excluding the inflow of surface or segregated withholding waters where a liquid pool is part of such structures. 'is inserted at the beginning of paragraph 1.
9. In the third sentence of Paragraph 4 (1), the word "pro 'is replaced by the word" u'.
10. In Paragraph 4, the sentence "Liquid manure shall be stored in impermeable above and, where appropriate, partially embedded tanks, in ground sinks or in stables', is inserted at the beginning of paragraph 2.
11. in Paragraph 4 (3), the sentence "If no data on the weight of animals determined by weighing is available, the data referred to in Annex 3, Table B, shall be used for conversion into livestock units."
12. In the heading of Part Two, in Section 5 in the title, in Section 5 (1) and in Section 7 in the title, the words "manure," shall be deleted.
13. In Article 5, at the end of the text of paragraph 4, the words "; this shall not apply to secondary or main products produced in the cultivation of cultural plants' shall be added.
14. In Article 7 (1), the words "not later than the first calendar day of the calendar year following the calendar year in which fertilisers, manure, auxiliary substances and treated sludge have been used 'are replaced by the words" recorded'.
15. Paragraph 7 (2) reads:
"(2) Where the results of analyses are not available for the purpose of determining the nutrient intake to the soil in the manure used, the data set out in Annex 2 shall be used. Where secondary or main products resulting from the cultivation of cultural plants are left on the land, i.e. harvested plant residues, in particular straw, grass, grass and straw, they shall be entered in the register without indication of the amount of matter and nutrients. Total data on the production of faeces and urine as set out in Annex 3, Table A, and data on the supply of nutrients to soil in feces and urine as set out in Annex 2 shall be used for the recording of feed of feces and urinalysis of livestock during grazing or on agricultural land. The date of application of the manure is in this case the time ranges of individual grazing or animal stays on the parcel. The end of the use of fertiliser for the purposes of registration shall then be the date on which the animals last leave the land in question. Under the heading, the type of manure shall be indicated in the case of the leaving of feces and urinals of livestock on the agricultural land by the indication" grazing period "or" stay "identifying the species or category of animal. ';
16. the following Section 7a is inserted after Section 7, including the title:
Method of reporting the use of treated sludge
The report on the use of treated sludge shall be made using the form set out in Annex 4. ';
17. In Annex No 1, the words "manure," and in the first row of the fifth column of the table, the words "manure," are deleted.
18. In Annex No 1, in the heading of the table and in footnote 1, the words "agricultural entrepreneur 'are replaced by the words" agricultural entrepreneur'.
19. in Annex 2, note (b) shall read:
"(b) The levels of nitrogen, phosphorus and potassium in organic and organo-mineral fertilisers shall be recorded according to the label or package leaflet. In the case of organic fertiliser produced for its own use by anaerobic fermentation of manure or bulk feed in the production of biogas, nutrients shall be recorded on the basis of fertiliser analysis. ';
20. the following Annex 4 is added:

Efficacy
