Decree on the provision of duty leave to professional soldiers affected by floods in 2024

DECLARATION
of 7 November 2024
on the provision of duty leave to professional workers affected by floods in 2024
According to § 39 (5) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
§ 1
Reason for duty leave
(1) A duty leave shall be granted to an occupational soldier (the "soldier") when providing for the care of a child under 10 years of age and a lone soldier who has permanent care of at least one child at the age until the end of compulsory education, on the ground that the child education establishment in whose care he is otherwise in or the school he is in has been closed due to floods which began in the Czech Republic on 13 September 2024.
(2) Staff leave shall also be granted to a soldier who is unable or unable to perform a service on the grounds of:
(a) care for an unprovided child or household who is dependent on the assistance of another person at least in Level I (easy dependency) under the Social Services Act, provided that the facility which otherwise provides care to him has been closed due to floods which began in the Czech Republic on 13 September 2024;
(b) care for an unprovided child with special educational needs under the Education Act, if a child with serious developmental behavioural disorders, concurrent disabilities, multiple defects or autisme1), who was given the recommendation of a school counselling institution for the purpose of establishing supportive measures for his or her education2), provided that he or she could not attend school due to its closure due to floods which began in the Czech Republic on 13 September 2024.
(3) The child's insecurity is assessed under the Pension Insurance Act.
§ 2
Scope of duty leave
Staff leave shall be granted throughout the period of closure of the children's educational establishment, school or establishment referred to in Article 1 (2) (a), provided that there is a need for care during that period, due to flooding and the duration of the consequences of flooding, but not later than 31 March 2025. Staff leave shall be granted only to one eligible soldier. Authorised soldiers can also take turns in the same case. Replacement is not possible in one calendar day.
§ 3
Common provision
The provision referred to in Paragraph 1 (2) (a) shall mean a facility intended for the care of persons who are dependent on the assistance of another person at least in Level I (easy dependency) under the Social Services Act.
§ 4
Transitional provision
Further leave, replacement leave, leave or proper leave, provided that they have been taken for the reason set out in Paragraph 1, after the exhaustion of the leave granted pursuant to Section 2 of Decree No 263 / 1999 Coll., setting out the reasons for the provision of duty leave to professional staff for obstructions and the scope of the leave granted before the date of entry into force of this decree, shall be deemed to be leave of service from the date of application of this decree.
§ 5
Efficacy
This Decree shall take effect on the day following that of its publication.
