implementing Article 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for non-alcoholic beverages and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits and other alcoholic beverages, fermented vinegar and yeast
According to Article 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws (hereinafter referred to as "the Act") for soft drinks and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits and other alcoholic beverages, fermented vinegar and yeast:

ODDÍL 1

NON-ALCOHOLIC BEEPS AND CONCENTERS FOR PREPARATION OF NON-ALCOHOLIC BEEPS
§ 1
For the purposes of this decree:
(a) non-alcoholic beverage - a drink containing not more than 0,5% by volume ethanol (measured at 20 ° C), made mainly of drinking water, spring water, natural mineral water, or infant water, 1) fruit, vegetable, vegetable or animal raw materials, natural sweeteners, 1c) sweeteners, honey and other substances and, where appropriate, saturated with carbon dioxide;
(b) concentrate for the preparation of non-alcoholic beverages - a product containing, after adjustment for final consumption in the manufacturer's recommended ratio, not more than 0,5% by volume ethanol (measured at 20 ° C) and the raw materials referred to in (a),
(c) drinking concentrate - a concentrated mixture of individual raw materials used for the manufacture of soft drinks, intended for the preparation of beverages by dilution,
(d) fruit or vegetable juice - a fermented but unfermented product obtained from edible parts of ripe and healthy, fresh, chilled or frozen fruit or vegetables, of one or more species, with a characteristic colour, odour and taste which are typical of the juice coming from the fruit or vegetables concerned; the aroma, pulp and cells obtained by appropriate physical processes from the same fruit or vegetable species may be returned to the juice; tomatoes shall be considered fruit for the purposes of this decree,
(e) citrus fruit juice - juice obtained from the endocarp of its internal parts; However, lime juice may be obtained from the whole fruit,
(f) fruit or vegetable juice from concentrated fruit or vegetable juice (fruit or vegetable juice from concentrate) - the product obtained from concentrated fruit or vegetable juice by replenishing the drinking water content (10) as removed at the concentration of the juice; aroma, pulp and cells obtained by appropriate physical means from the same fruit or vegetable species may be returned to the juice,
(g) powder drink - a mixture of the individual raw materials referred to in (a) in the form of powder, granules or comprimates intended for the preparation of soft drinks by reconstitution,
(h) concentrated fruit or vegetable juice - the product obtained from fruit or vegetable juice of one or more fruits or vegetables by physical removal of a specific proportion of the water content; where the product is intended for final consumption, the reduction in volume shall not be less than 50%; the aroma, pulp and cells obtained by appropriate physical means from the same fruit or vegetable species may be returned to concentrated fruit or vegetable juice;
(i) dried fruit or vegetable juice (fruit or vegetable juice powder, dehydrated fruit or vegetable juice) - the product obtained from fruit or vegetable juice of one or more fruits or vegetables by physical removal of almost all water content,
(j) nectar - unfermented but fermented product obtained in accordance with Table 1 of Annex 1 by addition of drinking water and, where appropriate, sugars or honey for fruit or vegetable juice, fruit or vegetable juice from concentrate, concentrated fruit or vegetable juice, dried fruit or vegetable juice, fruit or vegetable juice, fruit or vegetable pulp, concentrated fruit or vegetable pulp, fruit or vegetable pulp, fruit juice extracted with water or a mixture of these products; the aroma, pulp and cells obtained by suitable physical means from the same fruit or vegetable species may be returned to the juice; without prejudice to the Regulation on nutrition and health claims made on foods, (11) in the manufacture of fruit nectars without added sugars or with reduced energy value, sugars may be replaced in whole or in part by sweeteners under the Food Additives Regulation, 12)
(k) fruit juice extracted with water - the product obtained by diffusion by means of water from the whole of the pulp fruit from which the juice cannot be removed by any physical means or from the whole of the dehydrated fruit;
(l) fruit or vegetable drinks - flavoured soft drinks, made from fruit or vegetable juices or their concentrates and the raw materials referred to in (a);
(m) lemonade - flavoured non-alcoholic drink made from drinking water, beverage concentrates or raw materials for their preparation, generally saturated with carbon dioxide,
(n) mineral water flavoured - flavoured non-alcoholic drink made from natural mineral water, beverage concentrates, or raw materials for their preparation, generally containing carbon dioxide,
o) spring-flavoured water - flavored non-alcoholic drink made from spring water, drinking concentrates, or raw materials for their preparation, usually saturated with carbon dioxide,
(p) sodium water - a drink made from drinking water and carbon dioxide for which the carbon dioxide content is at least 4 g / l,
(q) drinking water seasoned - flavoured non-alcoholic drink made from drinking water, containing only the addition of flavourings, possibly also enriched with a food supplement, generally saturated with carbon dioxide.
§ 2
Breakdown of groups and sub-groups
The breakdown of non-alcoholic beverages and concentrates for the preparation of non-alcoholic beverages per group and sub-group is given in Annex 2.
§ 3
Labelling
(1) The following additional labelling requirements are laid down in addition to those laid down in the law and in the Decree regulating the labelling of food 4:
(a) non-alcoholic beverages and concentrates for the preparation of non-alcoholic beverages, with the exception of beverage concentrate, shall be marked with the name of the sub-group or, where Annex 2 does not contain the name of the sub-group, the name of the group;
(b) the beverage concentrate shall be marked with the name of the subgroup or, if the food does not meet the requirements laid down for the subgroup, the name of the group;
(c) if fruit or vegetable juice, fruit or vegetable juice from concentrate, concentrated fruit or vegetable juice, dried fruit or vegetable juice, concentrate for the preparation of non-alcoholic beverages, fruit juice extracted from water or non-alcoholic drink from juice of one fruit or vegetable type shall be replaced by the word fruit or vegetable name of the fruit or vegetables used;
(d) non-alcoholic beverages and concentrates for the preparation of non-alcoholic beverages shall be marked with an indication of the energy value, excluding sodium water;
(e) in the case of fruit and vegetable drinks, juice or nectar, if the carbon dioxide content is at least 2 g / l, indicate that the drink is saturated,
(f) in the case of lemonade, mineral water flavoured, spring water flavoured or drinking water flavoured with carbon dioxide content of less than 2 g / l, the indication shall be that it is unsaturated lemonade, unsaturated mineral water flavoured with, unsaturated spring water flavoured with, or saturated drinking water flavoured with,
(g) in the case of fruit nectar, the minimum content of fruit juice, fruit pulp or a mixture of these ingredients shall be indicated by the words "proportion of fruit ingredient: at least...%" to be indicated in the same field of view as the name of the product,
(h) in the case of a powdered beverage, indication shall be given as to whether the preparation gives rise to a sparkling drink;
(i) for mineral waters flavoured, indicate:
1. indication that the drink is saturated if the drink has been subsequently saturated with carbon dioxide,
2. the location (municipality or place) where the source is received;
3. name of source,
4. an indication of the analytical composition indicating the characteristic constituents of mineral water, indicating the laboratory,
5. indication of the increased content of ions for which specific legislation is required for the mineral water type used, 1)
6. information on modifications made under special legislation, 1)
(j) in the case of spring-flavoured waters:
1. indication that the drink is saturated if the drink has been subsequently saturated with carbon dioxide,
2. the location (municipality or place) where the source is received and the name of the source;
3. information on modifications made under special legislation, 1)
(k) the lemonade for which fruit or vegetable juice or concentrate has been used shall be classified as fruit or vegetable lemonade;
(l) the beverage concentrate shall be labelled as fruit or vegetable concentrate if, after its prescribed dilution, it contains the fruit or vegetable juice obtained,
(m) a beverage concentrate or non-alcoholic drink flavoured, made from fruit or vegetable juice or concentrates thereof, flavoured with a flavouring of a kind other than fruit or vegetable of the basic fruit or vegetable component used, shall be labelled as fruit or vegetable concentrate or a non-alcoholic beverage with a declared flavour;
(n) a beverage concentrate or a soft drink flavoured, made from fruit or vegetable juices or their concentrates, shall be designated as a beverage concentrate or a soft drink flavoured with fruit or vegetable juice, or only as a beverage concentrate or a flavoured soft drink;
(o) a beverage concentrate or a lemonade flavoured with a flavouring or emulsion which replaces the fruit or vegetable ingredient used in the name shall be labelled as a beverage concentrate or soda with a declared flavour;
(p) for concentrated fruit juices not intended for final consumption, indicate the quantity of added lemon or lime juice and acidifying substances authorised under the Regulation on food additives (12); this indication shall be indicated on the package, on the label attached to the package or on the accompanying document,
(q) in the case of a mixture of fruit juice and fruit juices from concentrate and fruit nectar obtained in whole or in part from one or more concentrated products, the indication "from concentrate or concentrates" or "partly from concentrate or concentrates" shall be given; this indication shall be clearly visible in letters close to the product name and shall be good in the background,
(r) in the case of fruit juices, fruit juices from concentrate, concentrated fruit juices, dried fruit juices, fruit juices extracted with water and fruit nectar, produced from two or more fruits, a list of the fruit species used shall be given in descending order for the name of the product; in the case of products made from three or more fruit species, the designation of the fruit species may be replaced by the words "of several fruit species' or by another indication corresponding to the meaning or number of fruit species used; the use of lemon or lime juice or concentrated lemon or lime juice in quantities up to 3 g / l (expressed as anhydrous citric acid) is not considered as an addition of lemon or lime juice.
(2) For mineral water flavoured and for spring water flavoured
(a) additional particulars may be used in the labelling in accordance with specific legislation, (1) only if they comply with the criteria laid down in the specific legislation, (1)
(b) the name of the site (municipality or place) may be indicated as part of the designation only if it is a non-alcoholic beverage made from natural mineral water or spring water originating from the site mentioned in the name of the product. The name shall not be misleading or misleading as regards the place of source of natural mineral water or spring water used for production.
(3) The designation "mineral water '," mineral water', or expressions of similar importance shall not be used in the name of, or in the designation of, a soft drink, except for mineral water flavoured.
(4) The designation of "juice '," juice', "juice '," 100%', "100% '," 100%' or expressions of similar importance shall not be used in the name of or on the name of a soft drink, except fruit and vegetable juice.
(5) No geographical indication may appear in the name of the sodium water and drinking water flavoured or labelled.
(6) For concentrated drinks containing more than 50% by weight of natural sweeteners, the name syrup may be used.
(7) The permitted negative mass and volume deviations are set out in Annex 2a.
§ 4
Quality requirements
(1) The physical and chemical requirements for fruit and vegetable nectars are set out in Annex 1, Table 1.
(2) The physical and chemical requirements for fruit and vegetable juices from concentrate or concentrate are set out in Annex 1, Table 2.
(3) The sensory quality requirements for soft drinks and concentrates for the preparation of soft drinks are set out in Annex 2.
(4) Mineral water flavored and spring water flavored must meet the chemical requirements for bottled waters laid down by special legislation1).
(5) The drinking water flavored shall meet the requirements for drinking water in accordance with specific legislation. (g)
§ 4a
Technological requirements
(1) When fruit or vegetable juices are processed from fruit or vegetables with kernels, stone and bark, parts of kernels, stone and bark must not be contained in the juice. The first sentence shall not apply where parts of the kernels, stone or bark cannot be removed by an appropriate production process. A mixture of fruit juice and fruit pulp is permitted in the production of fruit juice.
(2) Fruit or vegetable juice from concentrated fruit or vegetable juice must have at least organoleptic, physical, chemical and nutritional characteristics corresponding to the average levels of juice obtained from the same fruit or vegetable species as referred to in Article 1 (d). A mixture of fruit juice or concentrated fruit juice with fruit working or concentrated fruit working is permitted in the manufacture of fruit juice from concentrate.
(3) Other technological requirements are set out in Annex 13 to this Decree.
§ 5
Entry into circulation
The non-alcoholic beverage in transparent packaging must be stored and transported protected from direct sunlight.

ODDÍL 2

FRUIT WINE, OTHER WINE AND MEDALS
§ 6
For the purposes of this decree:
(a) a fruit wine-based beverage produced by the alcoholic fermentation of fruit juice, with the exception of grapes which may be adjusted before fermentation by the addition of water and sugar;
(b) malt wine drink produced by the fermentation of malt lees by means of sulphite yeast;
(c) a mead drink produced by the alcoholic fermentation of honey from bees diluted in water,
(d) herbal wine - a beverage made from fermented sugar with added water or made from malt wine, maceration of parts of herbs or of wood, with the exception of grapes, or the addition of their extracts; treatment by the addition of alcohol, spirit drinks or other alcoholic beverages is not permitted,
(e) liqueur fruit wine - a drink made from unfermented fruit juice, with the exception of grape juice, or from unfermented black beets with the addition of alcohol as provided for in Article 16 (a) or distillate and sugar;
(f) cider - a beverage produced by full or partial alcoholic fermentation of fresh or concentrated apple juice or dried apple juice to which water has been added or mixtures thereof; the addition of water, sugar and not more than 25% by volume of pear juice, both before and after fermentation, aromatised by natural fruit flavourings and the addition of acidity regulators are possible; the addition of fresh or concentrated apple juice after fermentation and adjustment of the carbon dioxide content by addition or partial or total removal is permitted,
(g) table fruit wine which has not been sweetened after fermentation;
(h) fruit wine of semi-sweet fruit wine, sweetened by the addition of sugar to the value laid down in Annex 3, Table 2;
(i) dessert fruit wine - fruit wine with the addition of sugar and alcohol referred to in Article 16 (a) to the values set out in Annex 3, Table 2;
(j) fruit wine with seasoned fruit dessert with the addition of spices or extracts made from such spices;
(k) semi-sparkling fruit wine saturated with carbon dioxide to at least 0,1 MPa, where appropriate sweetened;
(l) perry - a beverage produced by full or partial alcoholic fermentation of fresh or concentrated pear juice or dried pear juice to which water has been added or mixtures thereof; the addition of water, sugar and not more than 25% by volume of apple juice, both before and after fermentation, aromatised by natural fruit flavourings and the addition of acidity regulators are possible; The addition of fresh or concentrated pear juice after fermentation and adjustment of the carbon dioxide content by addition or partial or total removal shall also be permitted.
§ 7
Breakdown of species and groups
The breakdown of species and groups is given in Annex 4.
§ 8
Labelling
(1) In addition to the information provided for in the Act and the Decree regulating the labelling of foodstuffs (4), these additional labelling requirements are:
(a) the ethanol content shall be given as a percentage by volume of the number with a maximum of one decimal place; followed by the symbol "% 'followed by the word" volume' or "vol ';" alcohol "or" alc. "or" alc. "may be indicated before the figures; the absolute value of the deviation of the ethanol content from the information on the packaging may not exceed 1%,
(b) where the name of the fruit wine indicates that at least 95% by weight of the fruit juice comes from that kind.
(2) Other fruit wines shall always be indicated by the name of the species and group.
(3) The permissible negative volume deviation from the nominal volume (s), measured at 20 ° C, is given in Annex 7a.
(4) In the labelling of the wines listed in Annex No 4, the term "wine 'shall always be accompanied by a label expressing the group or type of fruit wine or other wine. The term" wine' alone may be used only for vine wine without indication of the attribute.
§ 9
Quality requirements
The sensory and chemical quality requirements are set out in Annex 3, Tables 1 and 2.
§ 10
Technological requirements
(1) The quantity of fruit juice shall be used for the production of fruit wine of one type of fruit in the proportion set out in Annex 3, Table 3.
(2) For the production of 1000 litres of mead, at least 280 kilograms of honey shall be used.

ODDÍL 3

LIVE AND DRINKS AT THE POINT OF LIVE
§ 11
For the purposes of this decree:
(a) a foaming drink made by the fermentation of a youth prepared from malt, water, unprepared hops, prepared hops or hop products which, in addition to the fermentation process of alcohol produced (ethyl alcohol) and carbon dioxide, also contains a certain amount of unfermented extract; the malt may be replaced by an extract of up to one third of the total extract of the original youth, in particular sugar, cereal starch, barley, wheat or rice; for beers flavoured, the alcoholic strength may be increased by the addition of spirit drinks or other alcoholic beverages,
(b) malt grain grains of barley, wheat or other cereals which have undergone enzymatic transformation of the endosperm by sweetening and typical flavourings and colouring agents,
(c) beer of lower fermented beer produced using brewery yeast of lower fermentation;
(d) beer of supra-fermented beer produced using brewing yeast of the upper fermentation and, where appropriate, spontaneous microflora of milk or vinegar bacteria;
(e) light beer beer made predominantly of light malt;
(f) dark and semi-dark beer beer made of dark malt, caramel malt, or colour malt mixed with light malt;
(g) beer made at the turning by mixing light and dark beers, with a cut beer,
(h) table beer beer made predominantly of barley malt with an extract of the original youth up to and including 6% by weight,
(i) by-catch beer, beer made predominantly of barley malt with an extract of the original youth of 7 to 10% by weight;
(j) lager beer made predominantly of barley malt with an extract of the original youth of 11 to 12% by weight,
(k) beer special beer made mainly of barley malt with an extract of the original youth of 13% or more by weight,
(l) a porter of dark beer made predominantly of barley malt with an extract of the original youth of 18% or more by weight,
(m) beer with an alcoholic strength by volume not exceeding 1,2% (1,0% by weight),
(n) non-alcoholic beer with an alcoholic strength by volume of not more than 0,5% (0,4% by weight),
(o) beer obtained from other cereals, with an extract of malt of cereals other than barley or wheat exceeding one third of the weight of the extract,
(p) wheat beer beer produced with an extract content of more than one third of the total extract delivered,
(q) yeast beer beer produced by addition of pure yeast culture or the proportion of fermented youth into finished beer;
(r) beer flavoured with beer made with the addition of flavourings, food supplements, food or raw materials with own flavouring, spirit drinks or other alcoholic beverages referred to in Article 16. The alcoholic strength by volume of spirit drinks and other alcoholic beverages may not exceed that of the original beer,
(s) sweet malt extract obtained using brewery technology,
(t) beer-based drink fermented malt drink or mixed beer drink,
(u) fermented malt drink drink made of sweetbread by brewery technology, possibly flavoured,
(v) a mixed beer drink (Beercooler) a drink made by mixing beer with a soft drink or with a beverage concentrate for the preparation of soft drinks and sodium water.
§ 12
Breakdown of species, groups and sub-groups
(1) Species
(a) beer;
(b) beer-based drink.
(2) Beer is divided into the following groups:
(a) table beer;
(b) nodding beer;
(c) lager,
(d) special beer;
(e) porter,
(f) alcohol-reduced beer;
(g) soft beer.
(3) Beer based drinks are broken down into the following groups:
(a) fermented malt drink;
(b) mixed beer drink.
(4) Beer groups may also be subdivided into the following subgroups:
(a) wheat beer;
(b) beer of other cereals;
(c) yeast beer;
(d) flavoured beer.
§ 13
Labelling
(1) In addition to the information provided for in the law and in the Decree governing the labelling of foodstuffs (4), for beer the following shall be added:
(a) the name of the species and group and, where appropriate, the subgroups, as provided for in Article 12;
(b) an alcoholic strength by volume of not more than one decimal place; followed by the symbol "% 'followed by the word" volume' or "vol ';" alcohol "or" alk. "or" alc. "may appear before the figures,
(c) the method of fermentation, if it is beer produced by the upper fermentation or by fermentation in a bottle;
(d) the entry "not filtered" if no filtration has been carried out;
(e) an indication of whether the beer is light, dark, semi-sparkling or cut,
(f) indication of the use of natural mineral water, 1a) if used for production.
(2) To specify the designation of a group of beers, only the value of the extract of the original youth, expressed as a percentage by weight, or the corresponding wording in Annex 5, may be used.
(3) In addition to the information provided for in the law and the Decree governing the labelling of foodstuffs (4), for beer-based drinks, the following shall be added:
(a) the name of the group;
(b) alcoholic strength by volume.
(4) For mixed beer drinks, the designation corresponding to the group of beer referred to in Article 12 (2) shall be given.
(5) Allowed negative volume deviations from the declared volume are given in Annex 5, Table 2.
(6) Beer from other cereals must be indicated in the name by the type of cereal from which it was produced.
§ 14
Quality requirements
(1) The physical, chemical and sensory requirements for beer quality are set out in Annexes 5 and 6.
(2) Dark and semi-sparkling beer cannot be produced by coloring light beers.
(3) The fermented malt drink must meet the physical and chemical requirements for beer set out in Annex 5. No indication of actual fermentation shall be provided.
(4) The blended beer drink shall meet the physical and chemical requirements for flavoured beer, non-alcoholic beer, alcohol-reduced beer or table beer referred to in Annex 5. No indication of actual fermentation shall be provided.
§ 15
Entry into circulation
Beer and beer-based drinks must be protected from direct sunlight and frost damage.

ODDÍL 4

CONSUMPTION LIMITS, SPIRITS AND OTHER ALCOHOLIC DRINKS
§ 16
Definition of certain terms
For the purposes of this decree:
(a) drinking alcohol, adjusted by the addition of drinking water to not more than 80% by volume of ethanol,
(b) other alcoholic beverages containing more than 1,2% by volume and less than 15% by volume of ethanol, excluding egg liqueur, in accordance with the directly applicable European Union provision for spirit drinks (9), beer, wine and partially fermented grape must - cigarillos,
(c) other alcoholic beverages with an alcoholic strength by volume of more than 0,5% ethanol and not more than 1,2% ethanol,
