DECISION
President of the Republic
of 1 February 1994
on the delegation of power in the procedure for the grant of mercy
By virtue of the authority given to me by the provision of Section 366 (2) of Act No. 141 / 1961 Coll., on Criminal Procedure of the Court (Criminal Code), as amended, I issue the following
decision:
I. I delegate my authority to the Minister of Justice
1. Execute procedures for requests for mercy
2. deny unfounded requests for pardon
(a) except for applications:
- offenders of offences under Title I and Title X of Part Two of the Criminal Act, as well as military offences for which the lower limits of the criminal rates are at least 5 years old
- perpetrators who have been finely sentenced to life imprisonment
- persons convicted of crimes committed in the age of adolescents
- women over 55 years and men over 60 years
- women or lonely men taking care of children under the age of 15
- persons suffering from a serious illness or an incurable disease immediately threatening their life, unless the conditions for the application of the provisions of Paragraph 327 (2) of the Criminal Code are found by the court,
(b) except for other requests for mercy for which I reserve a decision on a case-by-case basis. To this end, I reserve the right to be informed of requests for pardon made directly to the Minister of Justice.
II. Cancel the decision of the President of the Republic of 6 February 1993 to delegate the power to apply for a pardon to the Prosecutor General, the Minister of Justice and the Minister of Defence.
