THE LAW
of 26 January 2011
amending Act No 154 / 2000 Coll., on Breeding, Breeding, Breeding and Registration of Animals and amending certain related laws (Breeding Act), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 154 / 2000 Coll., on breeding, breeding and registration of livestock (Breeding Act), as amended by Act No. 309 / 2002 Coll., Act No. 162 / 2003 Coll., Act No. 282 / 2003 Coll., Act No. 444 / 2005 Coll., Act No. 130 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 281 / 2009 Coll. is amended as follows:
1. in Articles 1 (1) (d) and 2 (1) (r), the words "non-breeding fish listed in the Annex to this Act" shall be replaced by "aquaculture animals."
2. in Article 2 (1) (b), the words "with the exception of wild animals" shall be inserted after the words "Bovinae."
Footnote 15:
"15) § 3 (1) (d) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended."
3. In Paragraph 5 (1) of the Introductory Part of the provision, the words "p. 'are replaced by the words" state contribution organisation'.
4. in Article 5, the following paragraph 10 is added:
"(10) The Ministry shall draw up and keep up to date a list of recognised breeders' associations and make it available in a way that allows remote access to other Member States and to the public. ';
5. in Article 6 (4), point (g) shall be deleted;
Point (h) shall be renumbered as point (g).
6. In Article 6, the following paragraph 10 is added:
"(10) The Ministry shall draw up and keep up-to-date a list of pig breeding holdings and make it available in a way that allows remote access to other Member States and the public. ';
7. Paragraph 7 (4), including footnote 16, reads as follows:
"(4) Control of the inheritance of the health of the listed livestock shall be carried out by breeders and veterinary authorities and by authorised persons, recognised breeders' associations and authorised persons under this law.
16) Sections 5 (1), 44 and 52 of Act No. 166 / 1999 Coll. '.
8. In Article 23 (1), the introductory part of the provision reads: "Breeders of registered animals, breeders of at least 500 head per holding for poultry, breeders of at least 100 head per holding for hatching eggs and, in the case of chickens, a flock of laying hens for the production of table eggs marketed, with the exception of breeders of breeding fish, aquaculture animals breeders and breeders referred to in Article 22 (12), shall be required '.
9. In Article 23 (2), the introductory part of the provision, including footnote 17, reads: "Breeders of aquaculture animals susceptible to diseases, as laid down in the Ordinance on animal health requirements for aquaculture animals (17), who own or hold such animals for sale or for sale, with the exception of retail sales, and breeders of breeding fish are required to:
"(17) Annex 3, Section II, to Decree No 290 / 2008 Coll., on animal health requirements for aquaculture animals and products thereof, on measures to prevent and control certain diseases in aquatic animals."
10. in Article 23 (4), points (b) to (d), including footnote 18, read:
"(b) ensure that, to the extent and in the manner laid down by the Decree and directly applicable European Union18, correct and complete data are added to the horse's or bovine accompanying document and that any changes thereto are recorded;
(c) in the case of movements of a registered animal, to also transmit or take possession, together with the registered animal, a horse passport, except in cases provided for in the directly applicable provisions of the European Union18), or an accompanying certificate of bovine animals;
(d) if a horse's or a bovine accompanying document is lost or destroyed, request from the authorised person the issue of a duplicate of the horse's or a replacement of a horse's or a bovine accompanying document without delay.
(18) For example, Commission Regulation (EC) No 504 / 2008 of 6 June 2008 implementing Council Directives 90 / 426 / EEC and 90 / 427 / EEC as regards methods of identification of equidae. "
11. in Article 23a (1) (d):
"(d) ensure, after the slaughter of the registered animal, the dispatch of a movement certificate for bovine animals or a horse passport, or after processing of the registered animal in a rendering undertaking, the dispatch of a movement certificate for bovine animals or a horse licence to be issued to a person;"
12. in Paragraph 23b, paragraphs 9 to 14 are added:
"(9) The Ministry of Interior or Police of the Czech Republic provides the Ministry of Enforcement under this Act
(a) reference data from the population base register;
(b) data from the population registration agendas information system;
(c) data from the agency information system of foreigners.
(10) The data provided under paragraph 9 (a) are:
(a) surname;
(b) the name and, where appropriate, the names,
(c) the address of the place of stay,
(d) date, place and district of birth; the date, place and state of birth of the data subject born abroad;
(e) the date, place and district of death; if the death of the data subject is outside the territory of the Czech Republic, the date of death, the place and the State in whose territory the death occurred; if the court's decision on the declaration of death is given, the date indicated in the decision as the date of death or the date on which the data subject declared to be dead did not survive and the date on which the decision was acquired;
(f) citizenship and, where appropriate, multiple citizenship.
(11) The data provided under paragraph 9 (b) shall be:
(a) the name and / or the names, surnames and surnames,
(b) the date of birth;
(c) the address of the place of permanent residence;
(d) citizenship and, where appropriate, multiple citizenship;
(e) the beginning of the permanent residence or, where applicable, the date of cancellation of the residence or the date of termination of the permanent residence in the Czech Republic;
(f) depriving or restricting legal capacity;
(g) birth number,
(h) the date, place and district of death;
(i) the day which, in the judgment of the court, was declared dead as the day of death or the day which the declared dead did not survive.
(12) The data provided under paragraph 9 (c) shall be:
(a) the name and / or the names, surnames and surnames,
(b) the date of birth;
(c) the place and state where the alien was born,
(d) citizenship and, where appropriate, multiple citizenship;
(e) the type and address of the place of stay;
(f) the number and validity of the residence permit;
(g) the beginning of the stay or, where appropriate, the date of termination of the stay;
(h) removal or limitation of legal capacity;
(i) birth number,
(j) the date, place and district of death;
(k) the day on which the judgment of the court referred to the death declaration as the day of death or the day on which the declaration of death did not survive.
(13) Data which are kept as reference data in the population base register shall be used from the population registration agendas or from the alien agendas only if they are in the form preceding the current situation.
(14) Only such data as are necessary to fulfil the task may be used from the data provided in a particular case. ';
13. In Section 23c, at the end of paragraph 2, the dot is replaced by a comma and the following point (q) is added:
"(q) allocate numbers to manufacturers of electronic identifiers for the marking of designated animals which contain the country code for the Czech Republic in the code structure 19).
19) ČSN EN ISO 3166-1 Codes for names of countries and parts thereof - Part 1: Country codes. '
14. in Article 26 (1) (a) (1), the words "Article 19 (1)" shall be inserted after the words "Article 18 (2)."
15. in Article 27 (1) (b), the words "Article 19 (1)" shall be inserted after the words "Article 17 (4)."
16. In Paragraph 30, the following paragraph 4 is inserted after paragraph 3:
"(4) The person referred to in paragraph 2 or 3 who has not completed the required secondary education shall be considered as competent if he proves that he has practised in the relevant field for at least 5 years. ';
Paragraphs 4 to 10 shall be renumbered paragraphs 5 to 11.
17. in Paragraph 30 (6), "paragraphs 3 and 4" shall be replaced by "paragraphs 3 and 5";
18. the Annex is deleted.
Čl. II
Transitional provision
Until the date of recognition of the Národní stallion Kladruba nad Labem, a state contribution organisation, as a breeding association pursuant to § 5 (1) of Act No. 154 / 2000 Coll., as effective from the date of entry into force of this Act, the Národní stallion Kladruby n. L., a state enterprise shall be considered a breeding association.
Čl. III
Efficacy
That law shall take effect on the first day of the second calendar month following its publication.
