on certain conditions for implementing the common organisation of the markets in the sugar sector
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Subject matter
This Regulation provides for certain conditions for the implementation of the common organisation of the markets in the sugar sector following directly applicable European Union1.
Information provider
The manufacturer of sugar, isoglucose or bioethanol, based in the Czech Republic, who, as a food business operator, notifies the launch, modification or termination of the activity pursuant to § 3 (1) (i) of the Food and Tobacco Products Act, provides information to the Fund pursuant to § 3.
Provision of information
(1) The manufacturer of sugar from beet or raw cane sugar provides the Fund with information on:
(a) the weighted average selling price of sugar per month and of the total corresponding quantity of sugar sold in tonnes; provide information by the 20th day of the following month;
(b) the weighted average selling price of sugar from short-term contracts in tonnes; provide information by the 20th day of the month in progress;
(c) sugar stocks per month; provide information by the 20th day of the following month;
(d) an estimate of the sugar production for the current marketing year; provide information by 28 February of the current marketing year,
(e) the quantity of sugar beet processed in actual sugar content for the current marketing year; provide information by 28 February of the current marketing year,
(f) the date on which the processing of beet begins and ends in the current marketing year; the information is submitted by 28 February of the current marketing year,
(g) the total quantity of sugar produced and the total quantity of molasses produced for the marketing year; provide information by 31 October of the following marketing year;
(h) the quantity of raw cane sugar processed for the marketing year; provide information by 31 October of the following marketing year;
(i) the actual sugar content of processed sugar beet; provide information by 28 February of the current marketing year; and
(j) the total quantity of sugar sold per marketing year, broken down by quantity of sugar sold to retailers, quantities of sugar sold for processing in the food industry and quantities of sugar sold for processing in other industries, with the exception of the production of bioethanol; The information shall be provided by 31 October of the following marketing year.
(2) Furthermore, the beet sugar manufacturer provides the Fund with information on:
(a) the sugar beet harvesting area in actual sugar content for the current marketing year; provide information by 28 February of the current marketing year,
(b) an estimate of the beet crop area for the following marketing year; provide information by 30 April of the current marketing year;
(c) an estimate of the quantity of beet delivered for the following marketing year, including the list of growers with whom the beet sugar producer has a delivery contract; provide information by 30 April of the current marketing year; and
(d) the weighted average buying-in price of beet for the marketing year; the information shall be provided by 30 April of the following marketing year.
(3) The bioethanol manufacturer provides the Fund with information on:
(a) the sugar beet harvesting area in actual sugar content for the current marketing year; provide information by 28 February of the current marketing year,
(b) the quantity of processed sugar beet in actual sugar content for the current marketing year; provide information by 28 February of the current marketing year,
(c) an estimate of the beet crop area for the following marketing year; provide information by 30 April of the current marketing year; and
(d) the total quantity of bioethanol produced during the marketing year; The information shall be provided by 31 October of the following marketing year.
(4) The isoglucose manufacturer provides the Fund with information on:
(a) the volume of actual isoglucose production per month; provide information by the 20th day of the following month;
(b) stocks of isoglucose at the end of the marketing year; provide information by 31 October of the following marketing year; and
(c) the weighted average selling price of isoglucose per month; provide the information by the 20th day of the following calendar month.
(5) The manufacturer of sugar from beet or raw cane sugar, bioethanol or isoglucose shall provide the information referred to in paragraphs 1 to 4 on forms issued by the Fund.
(6) The Contracting Parties to the Interbranch Agreement shall provide the Fund with a copy or a copy of:
(a) interbranch agreements concluded under the directly applicable European Union2) by the end of August of each marketing year to which the interbranch agreement relates; and
(b) contracts concluded containing provisions for the sharing of the value of the parties to the interbranch agreement by the end of August of each marketing year to which the contract relates.
Transitional provisions
1. Legal relationships arising before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
2. A sugar undertaking approved pursuant to Article 3 of Decree-Law No 337 / 2006 Coll., laying down certain conditions for the implementation of the measures of the common organisation of the markets in the sugar sector, shall be considered as a sugar producer pursuant to Article 2 of this Regulation as from the date of entry into force of this Regulation.
Repeal
They shall be deleted:
1. Government Regulation No. 337 / 2006 Coll., laying down certain conditions for the implementation of measures of the common organisation of the markets in the sugar sector.
2. Government Regulation No. 44 / 2007 Coll., amending Government Regulation No. 337 / 2006 Coll., on certain conditions for implementing the measures of the common organisation of the markets in the sugar sector.
3. Government Decree No. 149 / 2008 Coll., laying down certain conditions for granting diversification aid to beet growers.
Efficacy
This Regulation shall enter into force on 1 October 2017.
