DECLARATION
of 14 November 2019
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended
According to Section 120 of Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision of Health Services (Health Services Act), as amended by Act No. 111 / 2019 Coll., for the implementation of Section 11 (4) of the Health Services Act:
Čl. I
Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended by Decree No. 287 / 2013 Coll. and Decree No. 285 / 2017 Coll., is amended as follows:
1. In Annex 1, Part II B, point 1 (a):
"(a) a radiologist, an interventionist radiologist, a neuroradiologist, a paediatric radiologist, or, in the case of the conduct of only a skin examination of the chest of a pneumologist,"
2. Annex 9, including footnote 21, reads:

"Annex No. 9 to Decree No. 99 / 2012 Coll.
Personnel security requirements for alcohol and toxic containment services
Personnel security is determined according to the individual expertise of health workers:
(a) doctor
1. with specialised competence in the field of anaesthesiological, dermatoenerological, gynaecological, obstetrics, surgical, internal, cardiothoracic, neurosurgery, neurologic, ophthalmological, orthopaedic, otorinolaryngological, paediatric, psychiatric, urological or general practical medicine - availability; availability for the purposes of this Annex means the physical presence of a doctor at the reception and release of a patient, the availability of advice and the assistance of a doctor by telephone or electronically, or, if requested, the physical presence of a doctor at the workplace within 20 minutes of the request; or
2. with the professional competence with the basic tribe certificate (21) referred to in point 1,
(b) a general nurse competent to pursue a profession without professional supervision or a practical nurse competent to pursue a profession without professional supervision; and
(c) an orderly or a nurse.
The provider of an alcohol and antitoxicomanical detention service shall provide personnel with an alcohol and antitoxicomanical detention service by medical professionals of individual expertise in the number corresponding to the local conditions for the provision of that medical service and the requirements for its provision at the appropriate professional level.

Čl. II
Transitional provision
The minimum staff security requirement for alcohol and antitoxic detention services pursuant to Decree No. 99 / 2012 Coll., as effective from the date of entry into force of this Decree, shall be deemed to be met by a specialist professional in the field of hygiene and epidemiological, maximofacialsurgical, pathological or radiological services, provided that the service was provided by that doctor before the date of entry into force of this Decree, until the end of its employment relationship with the provider of the alcohol and antitoxic services.
Čl. III
Efficacy
This Order shall take effect on the first day of the second calendar month following its publication.
