of 11 December 2018
amending Decree No. 55 / 1999 Coll., on the method of calculating the amount of damage or damage caused to forests
In agreement with the Ministry of Finance, the Ministry of Agriculture provides in accordance with § 21 paragraph 4 of Act No. 289 / 1995 Coll., on Forests and on the amendment and addition of certain laws (Forest Act):
Decree No. 55 / 1999 Coll., on the method of calculating the amount of damage or damage caused to forests, is amended as follows:
1. in Article 1 (1) (b) (6), the words "wood matter" are replaced by the words "wood."
2. Paragraph 1 (3), including footnote 1, reads as follows:
"(3) The decree does not apply to the calculation of the amount of damage to products except wood, in particular to Christmas trees from Christmas trees plantations, to forest reproductive material, to recognised sources of reproductive material1) or to raw wood products produced.
1) Article 11 of Act No. 149 / 2003 Coll., on the putting into circulation of forest reproductive material of forestry important species and artificial cross-breeds, intended for forest renewal and afforestation, and on the amendment of certain related laws (Act on trade in forest reproductive material), as amended. "
3. In Paragraph 2 (2), the word "discover 'is replaced by" determine'.
4. In Article 2 (5), the words "the degree of damage to forest crops 5) 'shall be inserted after the words" the types', and at the end of the paragraph, the words "The conversion table of forest forest trees is set out in Annex 10 to this Decree. In the event of differences between the relative creditworthiness listed in the forestry plan or forest economic curriculum and the result of the transfer referred to in Annex 10 to this decree, the values of the relative creditworthiness of that annex shall apply. ';
5. In Section 2, the following paragraph 7 is added:
"(7) The amount of damage caused by imimism may be determined under this decree for imitations for which an imitation limit is set for the protection of ecosystems and vegetation under another legislation8). At the same time, the amount of such damage can only be determined for the calendar year in which the limit for a particular pollutant has been exceeded in accordance with another legislation8).

6. In paragraphs 3 to 6, the words "total adjusted potential forest rent 'are replaced by the words" total potential annual forest rent' and the words "adjusted potential forest rent 'are replaced by the words" potential annual forest rent'.
7. In Article 8 (1), the words "wood materials' are replaced by the words" wood '.
8. In Article 9 (3), the words "threat zones 5) and damage levels' are replaced by the words" forest damage levels 5) 'and the words "threat zones and damage levels' are replaced by the words" forest damage levels'.
(9) footnote 6 shall read as follows:
"(6) Decree No. 139 / 2004 Coll., laying down details of the transfer of seeds and seedlings of forest trees, the registration of the origin of reproductive material and the details of the restoration of forest crops and the afforestation of land declared as land intended for the performance of forest functions."
10. In Article 10, the following paragraph 3 is added:
"(3) Paragraphs 1 and 2 shall not apply where the reduction in forest production has been due to the substitution of trees caused by the action of imitations. ';
11. in Article 11 (1), "1,02n" is replaced by "1,01n."
12. In Section 13, the words "wood matter 'are replaced by the words" wood'.
13. In Section 13, the words "wood 'are replaced by" wood', the words "stolen 'are replaced by the words" stolen' and the words "Section 7 (1) 'are replaced by the words" Section 8 (1)'.

Percentage of mythical immaturity Mn
a) The percentage of mythical immaturity for the age of the crop 1 to 20 years inclusive is equal to 100.
(b) The percentage of mythical immaturity for the age of the crop from 21 years up to the maximum washing for a given group of forest trees shall be determined using the following formula:
Mna = M0 + M1 × a + M2 × a2 + M3 × a3 + M4 × a4 + M5 × a5,
where
Mna - percentage of mythical ripeness of forest vegetation at age and
a - age of the crop
M0 - M5 - polynomial coefficients by groups of forest trees and relative bonites in Tables 1-13
The following rules shall apply to the calculation of the percentage of toll maturity by means of a polynomial:
(a) the domain of definition shall be 21 years of age up to maximum washing for a given group of forest trees;
(b) only the integer part shall be used from the calculated value;
(c) If the value is greater than 100, the value is 100, but if the value is less than zero (negative number), the value is 0.

Efficacy
This Decree shall take effect on 1 January 2019, with the exception of Article I (11), which shall take effect on 1 July 2019.
