DECLARATION
of 3 August 2012
establishing a list of diseases, conditions or defects which exclude or restrict medical fitness to pursue the profession of doctor, dental practitioner, pharmacist, non-medical health professional and other professional personnel, the content of medical examinations and the particulars of a medical opinion (Ordinance on medical fitness and other professional staff)
The Ministry of Health shall determine, pursuant to Section 37 (1) (e) of Act No. 95 / 2004 Coll., the conditions for obtaining and recognising professional competence and specialised competence for the exercise of the medical profession of a physician, dental practitioner and pharmacist, as amended by Act No. 189 / 2008 Coll., and under Section 90 (2) (f) of Act No. 96 / 2004 Coll., the conditions for acquiring and recognising competence for the exercise of non-medical medical medical professions and for the exercise of activities related to the provision of medical care and the amendment of certain related laws (Act on non-medical medical medical professions), as amended by Act No. 189 / 2008 Coll.:
§ 1
Preliminary provisions
This Decree sets out a list of diseases, conditions or defects which exclude or restrict medical fitness to pursue the profession of doctor, dental practitioner, pharmacist, non-medical health professional and other professional (hereinafter referred to as "the person under consideration '), the content of medical examinations of the person under assessment and the particulars of the medical assessment for the profession of the person under consideration.
§ 2
List of diseases, conditions or defects
The list of diseases, conditions or defects which exclude or restrict professional fitness is set out in Annex 1 to this Decree.
§ 3
Content of medical examinations
The content of medical examinations of the person under assessment shall be:
(a) analysis of the data
1. anamnestic, with a targeted focus, in particular, on the occurrence of hereditary diseases which may affect professional fitness;
2. on diseases and accidents so far,
3. the long-term use of medicines or combinations thereof,
4. the use of alcohol and psychoactive substances; and
5. from a work history,
(b) evaluation of the anamnestic data in the health documentation kept
1. the person assessed by his or her registered health service provider in the field of general medical practice,
2. the provider of occupational medical services or, where appropriate, the assessment of the conclusion of a medical opinion issued by the provider of occupational medical services, where the person is an employee,
(c) a comprehensive physical examination, including an indicative examination of hearing, vision and skin and an indicative neurological examination, with a view to detecting the diseases, conditions or defects listed in Annex 1 to this Decree;
(d) basic chemical examination of urine; and
(e) a professional examination requested by the medical assessor for the purpose of assessing the medical condition in respect of the diseases, conditions or defects listed in Annex 1 to this Regulation, where the medical condition of the person under consideration so requires or is suspected of such disease, condition or defect; as regards the carrying out of a professional examination for the purpose of assessing the health status with regard to the diseases, conditions or defects listed in Annex 1, Part B, it shall be evident, at the conclusion of a professional examination carried out by a doctor with specialised competence in the relevant field, that healing or remission has occurred or that clinically satisfactory maintenance or prophylactic treatment has been carried out to enable the health profession to continue.
§ 4
Medical assessment requirements
(1) The conclusion of the medical opinion shall make it clear whether the person to be assessed is medically, medically or medically qualified for the purpose for which he is assessed. The medical evaluation does not contain a diagnosis.
(2) The elements of the medical opinion are set out in Annex 2 to this order.
§ 5
Efficacy
This Decree shall take effect on the 15th day following its publication.

List of diseases, conditions or defects which exclude or restrict professional fitness
A. Diseases, conditions or defects which exclude the medical fitness of the person under consideration for the pursuit of the profession and at the same time cause health complications or derogations adversely affecting the safe provision of health services
(a) clinically serious disturbances in attention, memory, intellect, judgment and orientation,
1. dementia of atrophic-degenerative origin, secondary dementia, organic amnesty syndrome, chronic or recurrent organically conditioned impaired consciousness,
2. organically conditioned personality disorder; or
3. clinically serious forms of specific personality disorder, namely paranoid, schizophreid, dissociative or emotionally unstable personality disorder,
(b) untreated, recurrent or chronic psychotic disorders, namely:
1. schizophrenia,
2. schizophrenic disorder,
3. delusional disorder; or
4. Schizotypic disorder,
(c) untreated, recurrent or chronic mood disorders, namely:
First manic episode,
2. a depressive episode; or
3. bipolar affective disorder,
(d) personality or behavioural disturbances caused by alcohol abuse, psychoactive substances, medicines or combinations thereof,
1. inability to give up the use of alcohol or the abuse of psychoactive substances, medicines or their combinations which directly and repeatedly affect the ability of the health profession;
4. active dependence on alcohol, psychoactive substances, medicines or their combinations;
5. Residual conditions or psychotic disorders with late onset caused by the effect of alcohol, psychoactive substances, medicines or their combinations, namely personality or behaviour disorders, psychotic reminescence, amnesty syndrome, dementia.
B. Diseases, conditions or defects which restrict the medical fitness of the person under consideration for the pursuit of the profession and for which the condition of recognition of medical fitness for the pursuit of the profession with restriction is to carry out a professional examination
(a) symptomatic organic psychological disorders or persistent organic psychological disturbances of clinical severity, including postencephalic or postcontusion syndrome;
(b) transient psychotic disorders, namely:
1. acute psychotic disorder with or without symptoms of schizophrenia;
2. Acute schizophrenic psychotic disorder; or
3. Induced Delusion Disorder,
(c) mood disturbances with satisfactory remission,
1. recurrent depressive disorder,
2. bipolar affective disorder,
3. dystymias; or
4. Cycling,
(d) severe forms of obsessive-compulsive disorder, phobic anxiety disorder or persistent personality change after catastrophic experience;
(e) clinically serious forms of specific personality disorders, namely histrionic, anancastic or anxiety personality disorder,
(f) personality disorders or behavioural disturbances caused by the effect of alcohol, psychoactive substances, medicines or their combinations, in particular dependence on alcohol or psychoactive substances or medicinal products or their combinations; the person concerned may be recognised as disabled with a restriction if the withdrawal period lasts continuously for at least 2 years; the duration of the withdrawal period shall be confirmed by an honorary declaration of the person under consideration and by the confirmation of the anti-alcoholic treatment physician.
