DECLARATION
of 10 July 2025
on health support programmes
According to Article 95 (1) of Act No. 373 / 2011 Coll., on Specific Health Services, as amended by Act No. 202 / 2017 Coll. and Act No. 120 / 2025 Coll., ("the Act '), the Ministry of Health provides for the implementation of Article 55a (3) of the Act:
Preliminary provisions
This decree sets out the health prevention tools provided under the Health Support Programme, the range of persons with whom the employer can cooperate in the provision of the Health Support Programme and the way in which the Health Support Programme is assessed.
Health prevention tools
(1) The health prevention instrument provided by the employer under the Health Support Programme aims to protect and promote the health of workers and is based on knowledge of the risk factors of working conditions and effects of work on workers' health and the impact of civilisation diseases.
(2) The medical prevention instrument referred to in paragraph 1 shall be support:
(a) preventive care;
(b) mental health and psychological resistance;
(c) reducing the influence of addiction;
(d) the development of health literacy;
(e) proper nutrition; and
(f) improving the condition of the movement apparatus.
Heading of persons cooperating in the provision of a health promotion programme
(1) In providing a health promotion programme for its introduction, the employer shall cooperate with persons with demonstrable experience in the field of public health protection, which shall:
(a) a doctor with specialised competence in the field of general practitioners (1);
(b) a doctor with specialised competence in the field of occupational medicine (1); or
(c) a person with competence to pursue the profession of professional worker in the protection and promotion of public health2).
(2) In providing the health promotion programme for its implementation, the employer shall cooperate with persons with appropriate professional qualifications according to the nature of the instrument chosen to implement the measures under the health promotion programme, which are:
(a) a person with competence to pursue a medical profession under the Law on Medical Professions1);
(b) a person with competence to pursue a medical profession under the Law on non-medical health professions (2); or
(c) a competent natural person to carry out risk prevention tasks under the Law on other conditions of safety and health at work3).
Method for evaluating health support programmes
(1) The evaluation of health support programmes is based in particular on:
(a) a comparison of baseline and final cumulative values of the development of work incapacity at the workplace;
(b) the usefulness of health support programmes by employees;
(c) during the overall organisation and implementation of health support programmes;
(d) the financial effectiveness of the health promotion programme, where appropriate;
(e) the benefits of the health promotion programmes implemented.
(2) The evaluation of the health promotion programme shall be carried out by a person with proven experience in the field of public health protection and, where appropriate, by other persons who have cooperated in the provision of health support programmes; The evaluation shall include a proposal to streamline the measures under the Health Support Programme for the following period.
(3) The evaluation period for the health support programme shall be 12 consecutive months of the calendar year in which the health support programme is implemented and the impact of the programme is monitored.
This Decree shall take effect on the day following that of its publication.

3) Act No. 309 / 2006 Coll., which regulates other requirements of safety and health at work in employment relations and on ensuring health and safety in the activity or provision of services outside employment relations (Act on other conditions of safety and health at work), as amended.
