Government Regulation
of 20 December 1946
on determining the reimbursement of postal charges for consignments in court proceedings.
The Government of the Czechoslovak Republic hereby orders pursuant to Section 3 of the Act of 19 December 1946, No. 236 Coll., on the reimbursement of postage for consignments in court proceedings:
§ 1.
The amount of the refund to be paid by advance payment from the Treasury shall be determined, unless otherwise specified below, on the basis of the number of order numbers of the case file in which the post office was paid.
§ 2.
The derogation shall be:
1. in the civil procedure at issue 30 Cds in the first three row numbers, starting with the fourth row number 50 Ccs for each additional ten row numbers started;
2. In proceedings reminding 20 Cds; where, after the opposition has been brought, the proceedings have been contested, provision 1 shall apply;
3. in the execution and hedging proceedings:
(a) to immovable property:
(aa) by the forced establishment of a lien or forced administration of 70 Ccs for each of the ten series numbers started,
(bb) by the forced auction of 100 Cds for each start of ten series numbers,
(b) for movable goods, 15 ccs in the first three row numbers, and starting with the fourth row number 30 ccs for each additional ten row numbers started,
(c) in all other cases, 30 Cds in the first three row numbers, starting with the fourth row number 40 Ccs for each additional ten row numbers started;
4. in the proceedings for the application for bankruptcy of 30 Cds, in the proceedings for bankruptcy and settlement of 120 Ccs, in both cases for each of the ten series numbers started;
5. in library management:
(a) in cases to be recorded in the library journal, 50 Cds for each journal number, if no more than 10 participants are delivered, 100 Cds, however, if more than 10 participants are delivered,
(b) in all other cases, 30 Cds for each beginning of ten series numbers;
6. in the proceedings of the survivor 60 Kns for each beginning of ten series numbers, remove the series numbers arising from the activities of the notary as a judicial commissioner;
7. in the proceedings of the guardian and guardian 25 Cds for each beginning of ten series numbers;
8. in the other proceedings of the undisputed 30 Cds for each start of ten series numbers;
9. in criminal proceedings 30 Cds for each starting ten series numbers.
§ 3.
Where the measure is determined according to the number of series numbers, the number of series numbers shall be determined for the determination of the measure at the time when the decision which terminates the case is taken or at the time when it is deleted from the register; In the custody and custody proceedings, an assessment shall be made if the matter is not terminated before the end of the proceedings, each time after the completion of 50 consecutive numbers.
§ 4.
This Regulation shall enter into force on 1 January 1947; they shall be carried out by the Minister of Justice.
