amending certain government regulations in the context of the adoption of a government regulation amending Government Regulation No. 262 / 2012 Coll., on the establishment of vulnerable areas and an action programme, as amended
The Government mandates pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for the implementation of agri-environmental measures
Annex 3 to Government Decree No. 79 / 2007 Coll., on the conditions for the implementation of agri-environment measures, as amended by Government Decree No. 114 / 2008 Coll., Government Decree No. 45 / 2009 Coll., Government Decree No. 263 / 2012 Coll., Government Decree No. 448 / 2012 Coll., Government Decree No. 298 / 2013 Coll. and Government Decree No. 308 / 2014 Coll., is amended as follows:
1. In point I.2. of Part A., "§ 11 (2) 'is replaced by" § 11 (1)'.
2. In point I.3. of Part A., "§ 7 (6) 'is replaced by" § 7 (12)'.
3. In point I.4. of Part A., "§ 7 (8) 'is replaced by" § 7 (14)'.
4. In Part A. (5):
"5. the condition laid down in Article 11 (2) of Decree-Law No 262 / 2012 Coll., on the establishment of vulnerable areas and an action programme:" Has the prohibition on the use of nitrogen fertilisers on arable land with a gradient exceeding 10 ° or on permanent grassland with a gradient exceeding 12 °, with the exception of solid manure and solid organic fertilisers, been complied with in the case of arable land with no crops fixed within 24 hours of their use? ";
Amendment of the Government Regulation on certain conditions for granting direct payments to farmers
In Section 10 of the Government Decree No. 50 / 2015 Coll., laying down certain conditions for granting direct payments to farmers and amending certain related government regulations, the following paragraph 5 is added:
"(5) The infringement of the protection of permanent grassland under the directly applicable European Union25 Regulation is not a matter where, in the case of an applicant in connection with the termination of the land-use adjustment under the Land Adjustment Act, a decision on the exchange or transfer of property rights to agricultural parcels on the part of the land block has taken place after the decision on the exchange or transfer of property rights to agricultural parcels
(a) to change the registration of the type of agricultural culture of permanent grassland to another type of agricultural culture provided for in Government Decree No 307 / 2014 Coll., or
(b) to sever or convert permanent grassland into another type of agricultural culture as provided for in Government Decree 307 / 2014 Coll. ';
Amendment of the Government Regulation on the conditions for implementing agri-environmental climate measures
Government Regulation No. 75 / 2015 Coll., on the conditions for the implementation of agri-environmental climate measures and amending Government Regulation No. 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended, as amended, as amended, as amended by Government Regulation No. 113 / 2015 Coll. and Government Regulation No. 63 / 2016 Coll., is amended as follows:
1. In Article 23 (4), the text "§ 7 (5) 'is replaced by" § 7 (11)'.
2. In Paragraph 23 (13), the text "§ 7 (5) 'is replaced by" § 7 (11)'.
3. In Annex No 1, Part A., point I.2, the text "Paragraph 11 (2) 'is replaced by" Paragraph 11 (1)'.
4. In Annex No 1, Part A., point I.3, the text "Paragraph 7 (6) 'is replaced by" Paragraph 7 (12)'.
5. In Annex 1, Part A., point I.4., the text "Section 7 (8) 'is replaced by" Section 7 (14)'.
6. Point 5 of Part A. of Annex 1 reads as follows:

Amendment of the Government Regulation on the conditions for implementing organic farming measures
Government Regulation No. 76 / 2015 Coll., on the conditions for implementing organic farming measures, as amended by Government Regulation No. 64 / 2016 Coll., is amended as follows:
1. In Article 18 (3), "§ 7 (5) 'is replaced by" § 7 (11)'.
2. In Annex No 1, Part A., point I.2, the text "Paragraph 11 (2) 'is replaced by" Paragraph 11 (1)'.
3. In Annex No 1, Part A., point I.3, the text "Paragraph 7 (6) 'is replaced by" Paragraph 7 (12)'.
4. In Annex 1, Part A., point I.4., the text "Section 7 (8) 'is replaced by" Section 7 (14)'.
5. Point 5 of Part A. of Annex 1 reads as follows:

EFFECTIVE
This Regulation shall enter into force on 1 August 2016, with the exception of the provisions of points 4 and 5 of Part Two of Article II, which shall take effect on 1 January 2017.
