DECLARATION
of 26 August 2015
amending Decree No. 78 / 2013 Coll., on the Energy Performance of Buildings
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 131 / 2015 Coll., for implementation of Sections 7 (8) and 7a (6) of the Act:
Decree No. 78 / 2013 Coll., on the energy performance of buildings, is amended as follows:
1. Paragraph 7 (1) is deleted.
Paragraphs 2 to 5 shall be renumbered paragraphs 1 to 4.
2. In Article 7 (1), the words "alternative energy supply systems' shall be inserted after the words" feasibility '.
3. In Article 7 (2), the words "alternative energy supply system referred to in paragraph 1 (c) 'are replaced by the words" thermal energy supply system';
4. Paragraph 8 (1) reads as follows:
"(1) The licence shall include the setting of recommended technically, functionally and economically appropriate measures to reduce the energy performance of the assessed building (hereinafter referred to as" recommended measures to reduce the energy performance of the building ').'
5. In Article 9 (2) (f), the words "when a building is more completed," shall be replaced by the words "including measures to change the building element of the envelope, or the technical system."
6. In Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following point (h) is added:
"(h) a source where information can be obtained on the energy performance certificate of the building, in particular the possibility of implementing recommended measures to reduce the energy performance of the building and of determining the costs of implementing these measures and their financing."
7. Paragraph 9 (5) reads as follows:
"(5) A card processed for the sale or lease of a building in the absence of an obligation to process a licence for other purposes may not contain part of the protocol referred to in paragraph 2 (e). ';
8. In Annex 4, the group heading "Recommended technically and economically appropriate measures to reduce the energy performance of a building 'is replaced by the heading" Determination of recommended measures to reduce the energy performance of a building'.
9. In Annex 4 to the table under the group heading "Determination of recommended measures to reduce the energy performance of the building ':

Transitional provision
A card processed before the date of entry into force of this Order shall be considered as a proof of the energy performance of the building issued pursuant to Decree No. 78 / 2013 Coll., as effective from the date of entry into force of this Order.
Efficacy
This Decree shall enter into force on 1 December 2015.
